  • Your #1 key to success in your Chapter 13 case has to do with fully and timely funding your repayment plan.
    As I discuss in this video, the minute you file Chapter 13, you have an immediate obligation to start paying your trustee. You must not wait to make your payment. Even when your attorney has filed a payroll deduction order - which is required if you are a W-2 employe - you and you alone are responsible for sending money to the trustee until the payroll deduction kicks in.
    Further, you and your attorney should figure out exactly how much money you need to have paid in to the trustee’s office by your confirmation hearing date. There is no reason to guess and having a fully funded case gives you the option of a reset hearing date (if necessary) and a stronger argument if your attorney needs to present to the judge or negotiate with creditors.
    If funding is not an issue in your Chapter 13 case, your likelihood of success will be much greater.

    I have a question, I just filed chapter 13 today my number 1 goal is to stop the wage garnishment student loanI send the case number right away to our payroll department requesting to stop garnishment. But I remember our cut off payroll was yesterday October 15 and I just filed today October 16 for our October 21 paycheck. What if they tell me that they can't stop the garnishment for this coming payday because of the cut off
