He then threatened the tow truck driver that he was going into the house to get a weapon. In a cop's mind, anyone who isn't on the force (directly or not) isn't a real human citizen, and can be arrested for no reason whatsoever. All that will accomplish, is getting paid 11 cents instead of 11 million, when cops screw up. You will never collect millions of dollars, from a thousandaire.
What's really funny, is that most of us normal citizens, simply put screen shields on to keep people from seeing the interior contents. Throw a blanket over packages to keep thieves from seeing them, or something else. A cameraman looking into a vehicle, the same thing that police do all the time, usually to develop 'suspicion' in order to support their reason for investigating. It's really low-hanging fruit that they are after, because it would be to hard to actually find crimes being committed.
My local PD has a lot of issues, but they're well aware of the First Amendment. I had a neighbor call the cops on me for filming her as she ranted in the street and both the 911 operator and the officers that showed up told her I was doing nothing wrong. There's a local auditor on UA-cam, too, and he doesn't bother to do 1A audits, he just cop-watches and does 4A audits.
I have no problem with them investigating and asking him questions. That's their right. It's the combative and instigatory nature they approached with that was the issue, as well as stating that he isnt allowed to film the interior of cars that was the issue. That was an overstep.
@penezu my understanding is that as far as a terry stop goes, yes it does matter. As far as an actual arrest, no you cant be arrested for filming whatever you want in public.
@@penezu Mostly no, but sometimes yes. Even if you're in a public location, it's still illegal to film places with an expectation of privacy, but only certain ones. For example, it's fine to film through an open window into someone's home (though in some places like NYC you're not allowed to use telescopic lenses to do so), even though there's normally an expectation of privacy, because the people in the home left the window open. But it's still illegal to film someone else's bathroom even if they left the door or window open. At least if you _know_ it's a bathroom, anyway. Same for locker rooms and changing rooms. It can also be illegal to film up skirts in public, but only if there's a statute against it. Such statutes have been upheld in various federal courts. Otherwise, police can initiate a consensual encounter any time and _briefly_ detain for questioning if there's good reason to suspect the filming is in aid of a crime.
Lol this guy was looking for trouble, I'm not a fan of these auditors that seek out an argument with cops, there's no point in recording an officers car unless you want to provoke them. Disclosing confidential information to those who don't have the right to it (i.e. by leaving it out in plain public view for everyone to look at) is breaking the law. Those cops need to arrest themselves. Imagine if you worked at a bank and you printed people's account information and stuck it up on notice boards for the public to read. Cops are relying on the good old "we can do what we want because we're the police" and their fall back of "we have the guns and we will arrest you" to avoid being held to account.
ANY deliberate attempt by police to violate ANY Constitutional RIGHT of the people to do what they do deserves a LOWER grade than a "C-" because the FIRST duty of ANY police officer by OATH is to PROTECT the constitution(al) protections. Disregarding or violating that oath should ALWAYS get a grade of "F"
As a current cadet in a police academy.. we as officers do not get enough training on the first amendment. To the state it is considered "advanced" training. Thank you for the work you do.
I think that's something guys like most of the commenters here miss. It's always "the police" that are the issue whenever a cod does something ridiculous. Now don't get me wrong, I've been stopped by both good and bad cops. And after the bad ones it's always "ya know what F cops" But when people really stop to think about it, it's the training that's the primary issue. Bear in mind I don't know any cops. But I think the point still stands
If you’re asked to swear an oath to uphold something, then training on said thing should be foundational and basic. Good luck! Hope the department you landed at has a good culture, or if not, a willingness to adopt one.
@lawrencearnemann3923 that's the point. It is incumbent on the officer to seek out the training. What they give us in the academy is to survive the street. How to not die, basically. I obviously believe in this cause, but others do not see the benefit of learning these things. They are just trying to make it through the day.
This Sergeant was promoted to keep him off the streets and away from people.. I've never seen subordinates take over so quickly, this tells me how much confidence they had in his ability to handle the situtation.

Wow! His bravery is commendable. It's critical to remember not all law enforcement is corrupt, just as not all civilians are law-abiding. An eye-opening dialogue!
Because how you feel if you saw someone snooping around taking pictures of your vehicle. Probably feel like they are stalking you or are looking to steal something.
wrong. He also stated that just because it is paid for by the taxpayers its city property and not the individual taxpayers property. that makes the the pd's cars and not yours. so it would be the same thing as someone sticking their camera in the window of your car.

Right or wrong he was exercising his rights and they were trying to violate them. So, think it through before commenting. Just because you don’t like he’s reacting to them escalating. Unfortunately the day of his arrest he lost my respect. His car was being repossessed and his wife refused to get out of the car. He then threatened the tow truck driver that he was going into the house to get a weapon. Tow truck driver had no choice but to call the police and this auditors confrontational and threatening manner caused the entire interaction.
Question. Does it matter what you film as long as you are in public area?

Exactly. I could write it down or just memorize it. But somehow filming is bad?
ANY deliberate attempt by police to violate ANY Constitutional RIGHT of the people to do what they do deserves a LOWER grade than a "C-" because the FIRST duty of ANY police officer by OATH is to PROTECT the constitution(al) protections. This Sgt is a danger to the public and department. He attempted to start and escalate a conflict, did not properly identify himself and lied when confronted. The failure to identify himself should be grounds for firing alone. De-fund the police NOW! They are no longer a force for good.
Cop doesn't even know who he is.
This is exactly how much arrogance is funded by us.
