    I declined a job contract today, knowing that the minimal cancellation period is two months. The HQ were further away from my home than I initially thought. I entered the companies Administrative Unit, thanked for the time and the opportunity and declined to sign the contract. The women was not happy.

      Meaning you had applied for a certain job position, been successfully through all interviews or whatever recruitment process, actually got the job... and then when it's already time for the job contract, you learn where exactly the headquarters are, and you learn about the cancelation time and steps needed? Wow, that must be some sh***y misuse of stages of information (I think on both sides) there! Glad you've had at least the guts to say no, although I think in the best case scenario this mutual ''unhappiness" could have been avoided way beforehand.

    Especially on calls you have to take care of.
    I allways repeat not with yes therefore i repeat what I understand.
    And I allways order a written summary of conditions.

    Again a very helpful video. Just a remark concerning #5. You are able to terminate a contract by e-mail if you do it well in advance and you require your counterpart to send you an e-mail acceptance of termination until a certain date. Once you have gotten this all is o.k.;: if your counterpart does not do it you still have the time to send a snail mail letter of termination. Within the last ten years I was able to terminate several contracts using e-mail without problems.

    Thing 3 is with ending of March 2022 notstandard any more, because of a change of law. Every new and old contract - with a few exceptions like insurance - can be cancelled after the first negoiatted contract duration monthly.
    Thing 5 is also not allowed sny more after march 2022 has to be confirmed after the sake call with a sigment by customer.

    I would like to ask. Is it possible to have a Full Time job, and, at the same time, have a Mini-Job? Is it legally accepted or should I ask for any permission to have both type of jobs simultaneously?

      Yes, you can! But you should most likely inform (or ask for permission) your full time employer. It depends on what your contract says. Sometimes it says that other employment is not allowed without written permission. All the best 😊

    For all expats or non Germans: Even the Germans fall into those contract traps. 🙄
    What I miss in this video is a notice about the *Kleingedruckte!*
    But maybe the Kleingedruckte is big enough to be a topic in its own right in another video.

    Somehow it sounds to me as if Yvonne helped Jen to get out of some of the less favorable contracts. That was a good summary of the contractual pitfalls that everyone in Germany can encounter.

    Hello, please, I have a question, should benefits such as offered gym membership be also mentioned in the contract? What about the relocation service that is provided, it also should be mentioned right? also, how should the overtime compensation be mentioned ? should they specify the amount of each overtime hour?

      Yes, if those things apply they should be mentioned and specified how they apply in the work contract or a second document for benefits.

    I paid for a language course in advance for a month, the course was very bad and after the first week I wanted to cancel it. The opportunist says that my 15-day withdrawal period has already ended. Of course, but how am I going to cancel a course without using it? Obviously I paid for a month in advance and then in about 15 days I'm going to cancel it? That's a legal loophole.

    I know when they had a phone oral agreement problem in the US, that salespeople started to record the phone calls, this then forced the salespeople to use a "beep" noise by US law to inform people they were being recorded. Does Germany have laws regarding privacy and recording on telephones?

      Yes, you also have to agree or disagree with being recorded. Although they always say the phone call may be recorded for training purposes.

      Usually rental contracts are unlimited with a notice period if 3 months. But we know that in Berlin short contract flats of a year or two are also being offered.

    This video is really helpful. I signed a contract to a Fitness Studio on Jan 21, 2022. I returned to the today Jan 25 to have it canceled for medical reason. But they insisted that they will just move the startof my contract for 2 months. I said no and I want to cancel it now because I am afraid that I will be billed on Feb 1. The contract states that the commencement of the agreement will start on Jan 31. They are still pushing for delay of the start of the program and insist that I have to fulfill the 6-month contract. My question is, do I have the right to cancel the contract since it has not commenced yet? By the way I signed the contract inside the Fitness Studio. Thanks

    Is it possible to cancel a rental agreement?

      Of course, any rental agreement can be cancelled, it just depends on how long the notice period is. You can find it in your rental contract.

      @@simplegermany no I want to know if I can cancel it before moving in to Germany. Currently I'm in my home country. I haven't paid any Amount. I won't be reaching in time due to personal reasons and when I mentioned this to landlord he said he will go to court

      In that case, it still depends what your contract states and we suggest you seek legal advise. We can't tell you, unfortunately.

Actually I'm in a similar situation but in my case the landlord himself terminated my contract just because I couldn't move in on the given date and now he's charging me 1 month rent even though he has already given that room to another person that too without my permission. So please let me know what you did? Do you really have to pay?

      @@Adarsh_- In my case, the landlord terminated the contract and he was able to find someone else just in time. Therefore I didn’t pay anything. It just depends on whats written in the contract. If he terminated and gave the room to someone else, I don’t think you should pay.

    Finally, great news! I was sending an actual paper letter the other day after a loooong time and thinking to myself: "Why is Germany not abandoning already these old rules and catching up with the rest of the digital world?" Eventho' it's revoked some good old memories I'll be happy to never have to lick another post mark in my life again :D Great updates to the Consumers law as well. Thanks for all the info and all your effort to make such a usefull content for us newcomers. I avoided many "traps" since i came to Germany, all thanks to you two!! 🤍🤍
