- The plaintiffs say they rented a two-bedroom apartment from the defendant and claim they left it in turnkey condition. The defendant still withheld their security deposit, so they’re suing. The defendant says the plaintiffs left food in the cabinets and drawings on the wall, and she needed the security deposit for repairs.

I am so GLAD I had enough common sense as a young person to take photos of everything when I moved in and out of places. If I saw any little thing or imperfection I took a picture of it. I made sure the landlords saw me doing it too. I also made sure to only communicate with my landlords via email or text, no phone calls unless there was an emergency. But I made sure to follow up calls with confirmation emails of the conversation. I have never had an issue getting my security deposits back.
Same. I once had an apartment complex keep my entire security banking on my ignorance. However I watch peoples court 😉 and videoed everything moving in and out! I sent the video to them the day after getting the letter and low & behold I got a check the next day in the FULL amount!

Same, my first and only apartment I had tried to charge me when I gave it back in a better condition than it was given. I am glad I took photos and videos of every inch of that place. I took them to court and they folded before we went to court.
My ex landlord tried to keep my 1200 security deposit because of the holes in the wall that my tv brackets left in the living room and the 2 bedrooms! 6 holes!!! Like how else was I supposed to hang my TVs ? And if he would of said he's gonna keep a hundred bucks or something I would of just said screw it, but the whole 1200??? 200 bucks a hole?? Really???? Well he tried but ended up being court ordered to not only give me back my ENTIRE DEPOSIT, but was also ordered to pay my court fees and the days pay that I lost for having to miss work to attend court.. The judge told him "I better never see u back in my courtroom for doing this to another tenant!!! What a pos that a HOLE is lol

she was almost scammed by a prop manger who tried to pocket her security for work her contractor husband did which didn't cost them a dime. she claimed "damage" on items that were supposed to be redone in between tenants anyway. she knew she lost at the end, judge saw the scam. it's a very well known scam right now. they claim massive "damage" which winds up being simple basic things. they will do ANYTHING to keep a security deposit today.
My ears always go up when I hear a litigant try to talk over the judge.

Apparently that was what the plaintiff considers clean and immaculate. Only God knows what the apartment looked like when she lived there!
Any other judge would have had the plaintiff removed from court, there is no way you can shout at the judge and have that sloppy attitude, and get away with it...

Judge said it could be done in 5 minutes. That's a woman who hasn't cleaned anything herself in a long time.
she was scamming the tenants. it's a well known scam. they use photos from other apts, which she did with the stove. they try to recoup for things they're supposed to do (paint the walls & do the carpet between tenants). She claim hundreds of dollars for cleaning they supposedly did which costs this broad nothing. It's a scam, and the judge saw that.
The Plaintiff is a piece of work and believes she does nothing wrong. There was clearly work needed to be done. She thought the louder she was, the more she could bully everyone!Judge M showed her her different 😆
The Defendant deserved the entire amount requested. It is normal for a manager to do the work needed in smaller apts.

With that plaintiff's horrible, loud, obnoxious and entitled attitude, I feel so bad for her 5 year old. Especially when she said "I'm 47 and I have a 5 year old..." Like whose fault is that, you horrifically unpleasant ogre? I was waiting for the fiance to blink twice to show us that he'd written "HELP ME" on his eyelids.

Oh, my… If she was raised that way, no wonder…. Way back, I managed apartments while staying home with my children. I cannot tell you how many residents left their apartments in deplorable conditions. Since I managed older properties to clean them up from trashy, destructive residents, I saw a lot. Unbelievable how some people live.

@@KSakamoto its not that its free is thats hes an interested party, they could inflate the prices and make it look legit because the interested party is the one getting paid. They could have presented and estimate of another company and still did the work themselves to prove the price of the service.
On the one hand, the defendant was the property manager, not the property owner, so her husband has no obligation to work for free.
On the other hand, it could be considered a conflict of interest for the defendant, as the property manager, to hire her husband's company to clean the owner's building unless the owner has approved the arrangement.

I don’t feel bad when I see tenants lose cases like this. A few more garbage bags and some soap and water would’ve alleviated the majority of their issues. Take your Dollar Tree yarn ball cat toy and your bag of beans and your onion skins and throw them away. Thoroughly clean all appliances. Wipe down the walls. Spackle all nail holes and ask the property owner for the wall paint so you can repaint those patches. Keep an open and honest line of communication with the property owner throughout the entire tenancy documenting any damages. It’s better to be able to show a judge an email you sent before moving out that says, “Apologies that the towel bar in the bathroom cracked. Would you like us to replace it with the closest match to the original before moving?” Don’t give the property owner a chance to have to determine the value of the damages, because it’ll never be in your favor.
the walls & carpet are to be redone by the landlord in between tenants. HOwever, in the last few years landlords have become extremely lazy, they're now expecting tenants to pay for this, that's how they're getting out of doing something that was their obligations for almost a century. It's not hard to fill in a hole in a wall, or paint a room. Hell, I'd hand them a $20 bill and tell em to go to home depot. What was presented in this case was nowhere near real massive "damage". This broad tried to pocket her security for work that didn't cost them anything, well known scam right now. AFter covid these landlords are desperate, they'll fight to the death to not return a deposit, even if it means trashing the place themselves. I belonged to a landlord group, during lockdown they literally talked about doing this to recoup what they felt their losses were. I don't trust any of em.

Nothing should’ve been returned. Just because it’s not overtly dirty doesn’t mean it takes 5m to clean. I moved into a “clean” apartment that took 2 days for me to clean up to my standards.
I love litigants who wear these ostentatious crucifixes on the program to show off their righteousness. They generally turn out to be completely dreadful, unpleasant people.

It’s shady. Like she said, the lady has a vested interest being the property manager. She could charge $500 and an unknowing fool would pay it because well who are they gonna complain to?
Dependent gets paid by the owner to do it all regardless.

$150 (I think that is what she charged for cleaning) sounds good deal on cleaning. Not only for picking up garbage and throwing it away but also for deep cleaning from mopping to getting on hands and knees to clean kitchen cabinets. Then repainting and repairing holes. Is there way to show time on work or something when property manager does this?
There wasn't really much cleaning to do tho. She got the money for the carpet cleaning and money for the painting and those little indents. Other then that, there was literally beans, straws and some yarn in the cabinets and some crumbs in the oven drawer. She also stated she sends the owner a bill for the work they do. She gets paid for that, being the property manager.

The judge clearly does not hire out for cleaning. Five minutes to pick up, clear out and clean a two bedroom apartment in preparation for the next tenant?????? I've cleaned homes for a living for short of 40 years. I've also watched People's Court forever. That was truly the dumbest thing she's ever said.
NGL it was the last apartment I left it took a full like 8 hour day to make sure it was clean and orderly; spackle holes, make sure furniture/debris out/moved, cabinets clear etc and then I always have to check and double check to make sure I have photos for proof and a witness making sure that it looks nice like its vacuumed and nothing else needs to be cleaned or dusted but that's just me
She's starting to lose it as she gets older. There was one recent case where she thought the an IT security company was price gouging a client because her idea of the service was just someone rebooting a computer by flicking a switch.

So that means anyone moving out during covid has to pay for the place to be sanitized? She was paid for the carpet cleaning and for the paint and walls. She also gets paid by the owner of the property to take care of the place.
@@Klw2010 yes I think you should. Carpet cleaning and painting is completely different from surface cleaning and per the pictures they didn't clean well. And yes she got paid to manage the property but that has nothing to do with repairs and cleaning.
she's supposed to deep clean in between tenants ANYWAY. They're supposed to paint the walls & lay new carpet in between tenants. I've seen actual "damage", this place didn't have it. The prop manager was trying to scam them by claiming funds for supposed cleaning of which they didn't do, hence why they had no rundown or bill. A lot of them are doing that right now.

I just moved out of a property and the landlord tried to stick me with a 2400 bill for damages and repairs. I had taken videos when I moved in and a video when I moved out.
I wrote them a 14 page manifesto equipped with pics and video upon request of that jacked up apartment.
I have not heard back from them.
So, TAKE PICS and/or a VIDEO folks.

When a tenant leaves, the friendship that they had is over, and the new tenant becomes the new friend of the landlord. If the friendship is over, why would the landlord give the deposit back to an ex-friend ? Rather try to keep as much as they can.
The plaintiff getting mad is a good play for a litigant in a court case. It makes it seem like they’ve been wronged .

I would do a walk-through with the landlord, detail a 2-3 page description of imperfections, normal wear and tear and have the landlord review and sign the findings.
I've gotten my full deposit back every time since I did that.
