- Matthew Wright hears from guests after the ICF said Israel’s presence in Palestinian territory is 'unlawful' and should be 'ended as rapidly as possible'.
First, Matthew and Human Rights Watch's Yasmine Ahmed discuss the future of UK-Israeli relations after this ruling.
Ahmed says: "The UK needs to be using every leverage that it has against Israel to stop this.
"This will make it harder for David Lammy and Keir Starmer not to do anything, and it makes it even more hollow in their words of a two-state solution, and a peaceful settlement of the dispute, if they do nothing now."
Matthew also speaks to former spokesman for NATO, Mark Laity, who doesn't expect to see much change 'immediately' following this. However, he predicts it will be much harder now to 'ignore the importance of a two-state solution'.

One way or another the UK is in a position to decide whether we are going to respect the laws we created or not. If we do not we as a nation will become increasingly isolated in the world.
It's not about the land. Look at the name of the person who delivers the verdict. You will have the answer 😢
If after this ruling you still support the ocupation you don't have the facts and international law on your side. Makes it much easier to approach the subject in political discussions going forward. It puts a lot of political pressure on Israel because other UN Member States will not necessarily ignore this ruling and this might hence lead also to economic pressure as some of those States might decide to no longer trade with Israel and to have economic relations with other countries instead. This kind of pressure will most likely yield results in the long term.
Just a point about what 'Advisory Opinions' are, and them being 'non-binding'. I see lots of apologists/news anchors emphasizing and leading with that, as if the ICJ ruling is just a suggestion and legal vibing. That is a mischaracterization. Like all international law, 'advisory' and 'non-binding' have specific meanings. There are two kinds of cases the ICJ can hear, 'Contentious' cases (e.g. [South Africa] v. [Israel]) and 'Advisory' cases (with the long descriptive names). Contentious cases are submitted by the states in dispute, with higher thresholds for jurisdiction and generally require consent of the parties. They are to do with circumscribed disputes that exist between those parties, and the ruling is said to be 'binding' on them because of Article 94 of the UN Charter. Art 94(1) of the UN Charter requires States "to comply with the decision of the ICJ in any case to which it is a party," and 94(2) directly allows for Security Council resolutions to ensure compliance (but keep in mind they can still be vetoed anyway). Advisory cases are submitted by the UN Security Council or General Assembly, in order to generally clarify the international law/status of broader issues to do with the law itself, but because there are technically no parties to the case, Art 94 is not engaged and so it could be said they are non-binding by default.
But that does not make Advisory Opinions mere suggestions or optional. The law that comes out of ICJ Advisory Opinions is the globally authoritative precedent/interpretation of international law for all UN Member States and international legal bodies. For instance if the ICJ interprets something comes under a 'preemptory norm'/'jus cogens' (mandatory legal principles that can have no exceptions), what follows can be considered 'binding' on all states, like in this case where they found self-determination is a preemptory norm and its fulfillment cannot be subject to conditions of the occupier (i.e. Oslo). Or that facts of Gaza after 2007 amount to occupation, that is a binding interpretation which puts it under the Law of Occupation/Geneva Convention. And given the ICJ found a violation of Article 3 of the CERD Convention (i.e. apartheid), that becomes the official interpretation of Art 3 for all ratifiers of CERD, which then engages all the obligations (and any enforcement mechanisms) that flow from that legal instrument. The same goes for the Rome Statute and ICC, the ICC has to follow the ICJ's interpretation of the legal (ir)relevance of Oslo, and so totally negates the UK's wacky objection that Oslo precludes jurisdiction because 'Palestine already delegated its criminal jurisdiction to Israel' (there can be no exceptions to the preemptory norm of self-determination).
It also affects all domestic regimes and their incorporation/use of international law. Keir Starmer made releasing legal advice of the UK gov about arms sales to Israel and compliance with International Law a major election issue (licensing compliance with IL is also a part of domestic UK law). It’s hard to overstate how much he has staked his whole personal/government brand on following/'respecting' International Law. Starmer/the gov has constantly dodged questions by saying “these are legal issues for a court to decide” and exploiting vague aspects of International Law. Now that the ICJ has provided authoritative clarity, Starmer has painted himself into a corner of indisputable hypocrisy. He technically could say the gov is not directly required to comply with the ruling via Art 94 of the Charter, but he cannot deny any of the ICJ interpretations themselves (e.g. that there is a system of apartheid), which are no longer up for debate, and which may give rise to binding obligations through other means. Whether that is in the bodies/treaties that a State is party to that are impacted, leverage for negotiations, areas of domestic law that incorporate international law, and any political weight/mechanisms that are tied to compliance with international law, all of which are irrelevant to Art 94 per se. The EU (itself a creature of international law) also heavily/procedurally incorporates International Law, with major implications.
Ultimately all International Law is a game of battling sources, instruments, and interpretations amongst states, but the ICJ interpretation trumps them all. The particular obligations and enforcement will come down to the specific reasoning/arguments relied on in the Advisory Opinion, and the ancillary treaties/norms/bodies of law that are brought into play. But just saying a case is 'advisory' and 'non-binding' as a whole in the colloquial sense, is not a valid argument. At best it's not the full picture, at worst it's utterly misleading.
Thank you for remarkable and irrefutable detailed analysis of legal consequences for world nations.
Most sincerely

The Palestinians were and are entitled to the cake that is outlined by International Law, not what Israel and the USA were willing to give them. Ridiculous analysis by the ex-Nato spokesperson.
Not how war works bud.
@@palerider955 No doubt, bud, you will be voting for Trump.
@@palerider955 This isn't a war, bud. And wars are bound by international law anyway, so it IS actually how they work.
He won't be voting for Trump, he's israeli. @MV-sh9gy
It wont change anything on the ground unfortunately
International law does not apply to Israel and it can be regarded as anti sematic.
Yet Britain has decided to disagree with the ICC and ICJ!
What is the UK Going to do about it ???
Britain is a major player . It allowed this situation in the first place
The UK should have nothing to do with it!
oh..but they have all to do with it
@@deehazsnow3178yer because 100 years ago Britain gave some land to the Jews so now we have to be involved! Make that make sense?? Britain needs to mind it's own business, they have enough problems as is,
Wrong.
The uk gave a piece of land from Israel to Palestinians. Because their king was landless.
@@evgeniynagornyak1150 it's still not a reason for us to get involved tho,...
@@annemoorhousewhen Britain is half the reason this problem exists in the first place then yes we absolutely should get involved but to rectify the problem we caused not to back Israel in their continued occupation of stolen land
Surely the more important question is do people whose land is being taken, have the legal right to defend it?
Yes, under international law.
Save Palestine 🇵🇸 shame on USA, ISRAEL, UK
Wow...we didn't know all this and more already?!?! U needed a piece of paper or sound bite to acknowledge what the eyes of the world has been seeing g and ears have been hearing for over 75yrs?!!?
It seems ludicrous that sangeeta was disposed of because of pressure from usrael. Lbc is also complicit in this. Shame on you lbc.

Its been going on for years
Immediately after Israel's victory in the Six Day War in 1967, Moshe Dayan, who was then the Minister of Defense, said he was waiting for a phone call from Arab countries. No one called...
Lammy said he would continue arming Israel.

You can smell the bias when you hear one
The ICJ could rule that water is wet and people would still laugh at them.
Yes, it will lead to meaningful change. Rulings like give a legal basis for supporting BDS by those wanting to, but reluctant (for whatever reason) to so so now.
There are strong parallels between what happened with the fall of Apartheid in SA and what's happening now.
I wonder what kind of political cover western governments would give now that this ruling came out.
Israel has made it law that there will be no two state solution.
ICJ: Youre breaking the law!!
Israel: 🥱
America:🤐
Britain: 🤐

So you missed the UK Foreign Secretary's speech in Parliament on Friday.
ICJ rules.
Justice will prevail for the Palestinians.

What are his obligations in light of blackmail deadlock now?
He should resign.
Why do people read "news" on things they know absolutely nothing about and fail to give both sides of the story.

Is occupation always under military invasion or force?
Not always but it always starts that way
Its all Israeli lands has been for thousands of years so there is no occupation
