Some of their story changed and didn't make sense. The plaintiff's story is straight forward and makes sense. The fact that they came into the courtroom with smirks on their faces, rolling eyes, laughing at testimony, being disrespectful and blaming everyone else instead of taking responsibility, pretty much sums it up. They even acted horrible on the way out.

The defendant is a big liar. Saying nobody was home so she has no idea what happened but my dogs didn't do nothing. Well then why did she supposedly have the "vet lady" come by that same day to check whether only 1 of their 3 dogs had blood on it? How did the "vet lady" know which dog to check?
The fact the defendants had to pay so little to make amends for letting their dogs out, and they continue to insist after JM’s ruling is appalling. Courts need to consider emotional distress in cases like these, and not only calculate damages based on the idea that pets are simple property.
The problem with considering emotional distress in cases like this is there will be people who take advantage of it "They killed my support fish", "They stole my hamster". Suddenly a case about a gecko that got eaten by a cat becomes a 5k case because they've had that gecko for a decade because they talked about seeing the tail twitching. The sad truth of the matter is pets are considered property and much like if someone crashses into the car you and your deceased dad restored, you can't want an extra 3k because the memories with your dad increased the value and if you accidentally crashed into someones car, you might be okay paying the 1,250 for the damages but cry foul when they tack on that extra 3k for emotional distress.
Its not emotional distress but punative damages is what she should be awarding. Especially for owners in this case, because they are not going to fix the problem and are very negligent.

If he was beating on that dog and trying to get it off of his dog for that long, he got a good look at the Pitbull. He knows exactly which dog it was that attacked his dog. If you have a dog capable of causing serious injury, you need to be vigilant 100 percent of the time. And if God forbid, your Pitbull attacks, TAKE RESPONSIBILITY. Show some remorse and take accountability for your dogs actions. The dog owners make things 100x worse by acting as if they did nothing wrong.

However, when you are in a fight or flight situation with adrenaline It is normal for details to get fuzzy and not remember exactly. His first thought is to save his dog and get her help asap. I agree. At the end of the day they are animals who do animal things. I really feel for the dogs because I know quite a few people with pitbulls or pitbull mixes and they are the sweetest dogs ever. But that’s also because their owners made sure to do proper research, prevent situations that could make them reactive, and do extensive socializing and on/off leash training. Dogs will be dogs, but humans can chose not to act like trash and out others in harms way

I personally know a few responsible pitbull owners. I feel like we only see the irresponsible ones here because it is small claims court, but there are responsible pit bull owners out there.
We have a bull mix. 7 foot fences, muzzle because he got jumped by a loose dog as a puppy (ours was on a lead and tried to run away in fear) and he freaks out every time he sees dogs on a walk so as a measure in case we muzzle him as he is a big dog. But I do have to agree, we didn’t go out looking to get a pit bull yet he was the dog we fell for at the shelter but I do notice a trend in a lot of pit bull owners who go and get one with a big bad attitude and funny enough the dogs end up big and bad. The more damage a dog can do, the more vigilant the owner has to be and there’s a massive correlation between these damage-intensive dogs and denial-egotistical owners. I’ve known other great pit bull owners but most people that are attracted to them don’t do the job they need to do to contain and train them.

The lack of visual blood on the dog that attacked is not evidence that there wasn't an attack. Once when we were playing with our two dogs in the snow, one dog cut its foot on ice. It didn't start bleeding until we got home. The living room carpet was bloody everywhere before we took the injured dog to get stitches. We returned home to perfect looking carpet. The dog we left behind "cleaned " our carpet. In this case the other dogs could have licked the blood off the dog that did the biting.

The defendants second witness started off strong but fell short right away. He not only admitted that the three dogs were kept outside which confirmed the plaintiffs story, he also confirmed the defendant is a liar since she said the dogs are kept in the house.
The law needs to catch up to the reality that companion animals are more than property. We develop an emotional relationship with them -- love -- that makes them irreplaceable. That is their purpose. Of course we feel anguish if they die in such horrible circumstances.
You got to remember this case is old. If the dog was born in 93 and was 19 when she died, that would place the incident in 2012. Had the dog not been attacked, she could have made it if her only health problem was hearing loss.

There was a way to get the dog off of the other dog. You have to look it up. It can be hurtful.

Pit bull owners always feel like their dogs are so sweet. Being vicious is in their DNA. It only takes one moment for them to turn.
This is utterly heartbreaking and absolutely disgusting. These people are horrendous. This elderly dog suffered so immensely and would have been so terrified and in unimaginable pain. The defendants are such awful people.
After watching dozens of Pitbull cases I have never seen an intelligent Pitbull owner. Maybe everyone disappeared that day because they had warrants, lol.
I personally know a few responsible pitbull owners. I feel like we only see the irresponsible ones here because it is small claims court, but there are responsible pit bull owners out there.
That's because pitbulls are vicious, killer dogs that no one should own.

We have a bull mix. 7 foot fences, muzzle because he got jumped by a loose dog as a puppy (ours was on a lead and tried to run away in fear) and he freaks out every time he sees dogs on a walk so as a measure in case we muzzle him as he is a big dog. But I do have to agree, we didn’t go out looking to get a pit bull yet he was the dog we fell for at the shelter but I do notice a trend in a lot of pit bull owners who go and get one with a big bad attitude and funny enough the dogs end up big and bad. The more damage a dog can do, the more vigilant the owner has to be and there’s a massive correlation between these damage-intensive dogs and denial-egotistical owners. I’ve known other great pit bull owners but most people that are attracted to them don’t do the job they need to do to contain and train them.
The way the defendant acts, so uncaring, totally did not care... she just makes me sick. The plaintiff is not lying, the only liar is you.
Next time it could be someone’s child!! Fix the damn fence!!
Problem is, if the drive in the dog is strong enough, they will go through the fence.
The defendant stands there rolling her eyes, and making faces the whole time the plaintiff was talking.

The judge missed that the defendant said the plaintiff was yelling at his children. Sounds like the kid was home and probably let the dogs out.
I am horrified listening to his story. That woman is lying and her witnesses are lying, also. The only reason someone needs dogs that violent is because they are doing something illegal.
The lack of visual blood on the dog that attacked is not evidence that there wasn't an attack. Once when we were playing with our two dogs in the snow, one dog cut its foot on ice. It didn't start bleeding until we got home. The living room carpet was bloody everywhere before we took the injured dog to get stitches. We returned home to perfect looking carpet. The dog we left behind "cleaned " our carpet. In this case the other dogs could have licked the blood off the dog that did the biting.

I am glad plaintiff won but if I had a little dog I wont walk it anywhere near where Pitbulls live
I would move if I still had my little baby and pitbull owners moved in. Dead serious. If this happened to her I wouldn’t ever be able to forgive myself or unsee/hear it.

This guy definitely has PTSD from this. The way he held it together telling his side you can totally tell he was fighting through his emotions re-living this traumatic event. The way the defendant doesn’t show any compassion or remorse speaks value on her credibility and selfishness.
Can I just say that not once did anyone of the defendants apologize at all or offer any kind of apology for what happened !?! People like that shouldn’t own any dog!! And not properly securing your pets in your yard? That goes for any breed of dog, not just pitbulls. Those defendants were just so rachet and no remorse at all.

The defendants second witness started off strong but fell short right away. He not only admitted that the three dogs were kept outside which confirmed the plaintiffs story, he also confirmed the defendant is a liar since she said the dogs are kept in the house.
The trauma that he witnessed and went through to me is pain and suffering. What he described was horrible.
I agree. Even though the dog is property the incident itself caused pain and suffering.
The law needs to catch up to the reality that companion animals are more than property. We develop an emotional relationship with them -- love -- that makes them irreplaceable. That is their purpose. Of course we feel anguish if they die in such horrible circumstances.
Oldest dog alive is 33 years old actually. Still alive too. My poor pup died of old age at 21 years old. What a shame

I had to look it up too. He sold his story to the judge to have her tugging at her heart in the beginning
You got to remember this case is old. If the dog was born in 93 and was 19 when she died, that would place the incident in 2012. Had the dog not been attacked, she could have made it if her only health problem was hearing loss.

From what the lady said about keeping their pitbulls in the house most of the day, that in itself is a huge problem! They need to be out getting some kind of exercise at least 3 - 4 times a day! This would take care of some of their aggressiveness. But, they must be trained to an extent! If the young son can come out & give the dog a command & the dog stops what it's doing, then they could have done it before the man's little dog got torn apart!

People from different regions with different cultures pronounce words differently. I hope that helps.
@Cubanflowers Some of my ancestors were Britons, and I don't say "axe" unless I'm planning to chop down a tree. Perhaps in the 1700s, people could only hear how the people around them mispronounced a word, but this is the 21st century, and we can hear the proper pronunciation by flipping on the TV.
If you decide to own (and continue to feed) a “vicious” dog make sure you have a decent fence at least. Smh.
