Why would it be preferable to mediate before an EEOC investigation instead of later?

    After coming up with a number and you agree but then the next day decide it’s not a fair amount can you change your mind and tell them you do not want to settle at this amount?
    No paperwork has been signed and it was a long call for almost 3 hours

    Does reinstatement have momentary value ?

      In the eyes of the IRS no, in the eyes of good firms, also no. In the yes of most firms and their retainer agreements, yes they will often attempt to ascribe a monetary value to reinstatement so they can take a percentage.

    Apologies, but I am still unclear why it's preferable. If a Plaintiff is pro se, wouldn't it be helpful that the EEOC is investigating because they could possibly get access to certain information a Defendant may not be as forthcoming to share with Plaintiff?

      Pro se is always a tough road, but I would never count on the EEOC to do its job.

    What if the outcome you, the victim of discrimination desire that the discriminating person be removed from their position -- or at the very least, overseen by an accountable process -- so that it doesn't recur?

    I am working for a staffing agency dba a major company. There's actually a string if DBAs involved and the EEOC filed charges but told me that I was required to inform of all the OSHA violations to the other companies. I personally think they are aware but I sent them messages. I did not hear back. Is it a good idea or a bad idea to take this to corporate now???? I'm confused as to why I was required to mention it, as the staffing division has threatened me with both legal action and the police stating that I am slandering them. But, I did was I was told to do. Though, I'm not sure if I HAVE to inform corporate/franchised (the DBAs manage the advertising budget in our region) or if that's even a good idea. I'm also really scared. Thank you for your channel, btw. It's great content.

    So I’m eligible for ADR and mediation program.But now I’m not that confident to do a mediation by myself to sign and agree to one without being represented.I contact a big shot law firm in my state that will work off contingency fee.I had a awkward consultation and he telling me I should have file with The state instead of EEOC..And I should file my complaint with the state so they can do the investigation quickly. I’m loss?? yes the time is slow with eeoc but now I’m at the step of possible getting a settlement and listening to what everyone has to say with the employer if they do agree to mediation.And with all my timeline,videos, audio record the medical document to back up my proof of my complaint.He never agree to help basically I did it wrong because I didn’t file my complaint with da state😮

      Your case isn't valueless just because you did not follow that one lawyer's playbook. I always say schedule 3 to 5 consults and pick the one you work with the best, who you also think will get you the best results.

    Quick question? because I made a mistake. I worked at amazon delivery station and I committed time fraud without knowing it bc in the app a to z you can clock in from ur phone. So i noticed a schedule shift marked red and this means I was at work or didn't not clock in. I used miss punch and clock in for the shift.what happen I got bc I add overtime shift a didn't not come so I filp that shift.monday I had went intill work as usual but then hr calls me over to the desk to talk about time theft I told them the truth about Sunday but for tesuday they check and I was their that day . I made a mistake and thought I work tesuday but I didn't. So what can I do

    Hi,
    Thank you the informative video! Currently, I'm engaged in the EEOC process through my state's EEOC (blue) against a local private employer, and I'm doing so without legal representation. My complaint encompasses gender, nationality, and race-based discrimination, retaliation, concerns about a toxic workplace environment, and a violation of the ADA during my tenure with my previous employer.
    I have completed the submission and investigative phases of the process. In the latest update, the respondent asked for conciliation again. The first time it was a 15-minute meeting and I gave them my terms that included an amount. They rejected that amount but 3 months later requested another conciliation for all my cases. If my first conciliation-for-one case was rejected and counteroffer. And then to ask for another one for all my combined cases and then to reject it again without a counteroffer just blows my mind. Can you explain why they are doing this?

    Hey if my lawyer don’t file my lawsuit in federal court by next week I’m gonna get me another lawyer, I’m going to see him this Friday he wanted to talk to me about my complaint. Give me your email or number just case I need a different lawyer. I’m gonna make sure I’m prepared.. I only got two more months left of the 90 days and I’m not playing games..

      I always recommend local counsel for Federal litigation, it is much cheaper if you can obtain good representation locally.
