My EEOC case is skipping mediation and going straight to the investigation. What does this mean?

    I just saw this, thank you! They did not read my rebuttal, lied about speaking to my witnesses, and are refusing to investigate further. Looking for a lawyer now.

    Mediation is a joke with the eeoc anyway. Waste of time.

    Thank you Vince, so much for your time in doing these videos - was so very helpful. I definitely endlessly rack my brain about things like why wont the company mediate! We are nearing my 1 year into our employment case and the company is refusing to mediate. An EEOC trial attorney met with me and my attorney. What does this mean? My employment attorney said the meeting went very well and its both rare and positive an EEOC trial attorney gets involved. My attorney says my case is pretty good as far as solid cases go. Thank you again for your time and care in creating this content with free & such useful information.

    So a charge was filed, no response to the charge and an investigation date was assigned. The process doesn’t make sense

    Hey Vince - Your comment about "this is a problem for the person who comes after me" brought up a question. Say a key person involved in the discrimination leaves the employer before the case is over. How does that tend to affect the case?

    My employer has currently ignored the offer for mediation. The EEOC just sent an email saying they are going to ask the Employer for a position statement for my charge of sexual discrimination. Can you elaborate on what this means?

    What if a federal court orders mediation and I do not want to go. Reason being I am paying my attorney hourly and I do not believe it lead to settlement so I will be out $4-5k for nothing. I am not opposed to settling, I just don't believe mediation will result in a realistic offer.

    Hi Mr. White. Thank you for all you do. I filed a claim with the eeoc. I never was asked if I wanted to mediate. The case went right to investigation?
    Also, I have been transferred to three different investigators. My new investigator said I did not upload any documents to the eeoc portal and that they will close the case. I uploaded a large amount of documents. I can go on eeoc site and open and download all the documents. I followed the deadlines very strictly. I also was very careful and formatted each document correctly. The previous investigator told me they were there.
    The new investigator is adamant that I never uploaded any documents and that they are not on the eeoc portal.
    Do you have any idea what is going on?

    I'm currently in a case where all of the documents and statements of witnesses i submitted during the investigation has been not included in the ROI and I'm in the hearing process not knowing what to do because there has been no discovery or any opportunity for me to resubmit anything on my behalf

    I told the EEOC I was a contracted (1099) employee who had proof I was treated as a regular employee . Are they likely to side with me? Even In my employers position statement they said I missed a mandatory meetings.
