If you are a U.S. citizen wishing to sponsor your foreign-born husband or wife for a U.S. green card (lawful permanent residence), you will need to start the application process by filing a visa petition on Form I-130 (Petition for Alien Relative). You will mail this form (with accompanying documents and fee) to U.S. Citizenship and Immigration Services (USCIS).
If your spouse is currently overseas, then only after the I-130 is approved will your spouse be able to move forward with the green card application, using a procedure called "consular processing".

This is the best set of instructions I have come across. I think you forgot to mention for every last page extra information entered the person has to sign the page? I came across that on the USCIS website. where you enter the extra addresses, husband and wives, jobs 😁

Thanks for the video! Q for part 5 other information, 1-5. The previous I-130 was filed to the Texas service center, and was then transferred to local uscis field office in NYC which is where the decision was issued for the petition. Do I put Texas or NYC? Thank you!

For form I130: petitioner is petitioning for parents and parents have a dependent child under 21 years old. Must the dependent child under 21 have a separate i130 application form OR should the child be listed as a dependent under the parent’s application without filling a separate application for the child? Q46c. Would this be the very first day of first arrival?
Q48. Is travel document number the same thing as passport number or the number on the O1?

Great Video! If the beneficiary is currently on an H1b, but ORIGINALLY arrived 8 years ago on an F-1 as a student, What I-94 number and status is recorded on the I-130? The most recent? or the very first one? (The first I-94 would be difficult to find).
My thoughts were to put the most recent, then in additional information mention that initial arrival was F-1.

When I get to the question regarding immigration proceedings, I don’t know how to answer it. He was previously deported from Germany back to Morocco but was never in the US. Hi, I'm following through with the video and you say that on number 11 if you have a physical address that's DIFFERENT from your mailing address you should click YES.
But the question there is the opposite. It says "Is your current mailing address the SAME as your physical address?".
So, I believe there was some confusion when you were explaining there, correct?
It means if you want USCIS to contact you ( by traditional mail) in a different address.

Good morning, on form I-130, Part 4, on the statement before 62.a, where it says “The beneficiary will not apply for adjustment of status in the United States, but he or she will apply for an immigrant visa abroad at the US Embassy or US consulate” does that mean applying for a different visa or it’s just how they call it to the green card or permanent residence?

FYI if you file for your spouse and they have overstayed their visa. And you divorce and cancel paperwork before your interview. Your immigrate spouse will automatically be entered into deportation proceedings within 30 days. This just happened to my husband while we are divorcing. We filed August 2018.

I am a US citizen, and I would like to file a petition for my mother who is currently in the US since 03/01/2020. She overstayed in the USA for several months since last year. What is my first step? Should I complete the I-130 along with the I-485? And should I send in an affidavit? I'm not sure where to start.
I have a question. Is there a form other than an I-130 that you can use to have parents be able to come and go into the USA to visit? Which visa would it be? My spouse is a citizen however his parents are over 60 and would have no intentions of moving or living in the USA. That is why we are exploring other options besides the i130 for the whole 6 month rule that they have for green card holders. Thank you!
Hi. I submited the form I-130 on May this year for my mom, I am a US citizen and she is here on her B1/B2 visa.I am wondering if it will be a good idea for her to go bak before I submit the form I-485 since she has to take care of her pension and her mocular degeneration treatment. I know she won't be able to go back once I submit the AOS and processing times are taking very long these days. I haven't receive anything about the petition just the receipt notice and that's it. What do you recomend? Do you do phone consultations?

thank you so much! this is an amazing video. it definitely gets you going in the right direction. do you or would you proof check these forms for a fee? do you have a video for the 130a? also i was told that my wife should file for a temporary work visa with the department of state wail we do this process to keep her from showing that she has overstayed her visitor visa. is there any truth to that or once we file the paperwork should that cover and protect her because she rides with my on my truck and we go through border check stations often?

Part 5 - what if you applied for a K1 visa over 15 years ago. It asks for the filing place and date. Is it where you were living and therefore mailed it from? And as for the date, what if you can't remember?

Question 47, Beneficiary has never been to U.S. and doesn’t yet have an issued passport. Does he need to have one before I (Petitioner) submit I-130?Or does the passport # apply only if spouse has entered the U.S.?
You completely missed the part of where they ask at which office will the beneficiary apply if they are applying for adjustment of status. This doesn't make sense to me as you have to apply though mail at one particular office. Please add these instructions...

The last time my wife was in the U.S she was 6 years old. Her and her family had "BORDER CROSSING" cards. Their cards expired and never came back to the U.S. Luckily her mom still has that card. Would that go anywhere in section PART 4. 45-52? Im confused wether any info an her crossing card would go in this section.

Hi: I'm in the process to apply for my Mother with form i-130 and i-485 concurrent filing. She currently has B1/B2 Visit visa and she came to visit me here now in the USA. So I just applied for her i-130 online last week and I'm preparing her i-485 documents to mail this week. But for some personal reason my Mother needs to go back to her home country for a few months.
So my question is:
1. What will happen to her i-130 application I just did online and what other consequences will happen if she goes back now and comes back after a few months?
2. Will she have any issue re-enter in the USA after a few months since I have applied for her i-130?
3. Should I wait to file i-485 until she comes back to the USA?

Hi, I am filing my I 765 form with my adjustment of status. I am on a K1 visa. My Question is I got my EAD card in 2015 as an F1 student visa for my OPT. I'm asking this because the I-130 instruction I downloaded from the official website says I need to answer those questions but everyone on UA-cam is leaving them empty.
