      U got it wrong, they aren't patent for color, they trademark (TM)
      U still can use it, but not in same category.
      Ie. U can make a insolation in Tiffany teal.
      But u can't make shoes with red insoles

    Trademarking doesn’t mean they can sue you for using a colour, it means it can be part of a larger case of brand infringement.

    Trademarks can only be filed for non-generic IPs.
    Many colours have specific RGB codes, hence they can be trademarked. Colours like black are common, so they cannot be.

    Just in case people don’t realise this doesn’t mean you can’t use the colour in any context, brands will most likely have specific trademarks. Like you can’t use macdonald’s red for a fast food logo ect.

      @@ysbrandd from what I heard its to stop competitors from trying to copy them and steal their sales. It's only trademarked in their specific field. It kind of makes sense because we do associate specific colors to specific brands. The was a case a while back where a very successful company had used brown as their color and a competitor came in with that exact same color, which ended up fooling alot of people into thinking it was the original company. This caused a massive decrease in sales for the original company.

    Most of these companies have only trademarked these colors if another company is in the same field. Like a fast food chain can probably use these luxury colors since they are not in competition with them.

      U can trademark colour, Mattel pink in kids toy's. T-Mobile magenta in cellular service, UPS in hauling and package transport.

    I own a pot of laboutin sole paint 10 years back, still fresh and usable. They also sell stickable red rubber soles to stick over the paint to give the shoe more purchase and grip. Unfortunately i can only wear heals to dance in and no fancy shoes to walk for a night out just worth the Knowledge for anyone wishing to purchase a pair or upcycle a collectible.

    Fashion brands are less likely to have trademarked colours as fashion is based on trend cycles.
    Whereas for the other companies mentioned, their trademarks strongly connect to their branding. If they did not use their colour, they would not be recognisable. Also offers protection from copy cat competitors within their own industry.

    I think it's important to point out that these are very specificly defined colors. You can use red for instance, just not the exact (or too close to the exact) shade of Coca-cola. It's not red in general. There has to be a specific and narrow definition for a trade mark to be placed.

Just because coke has rights over red it doesn’t really mean that no other drink company can use red. They just can’t use the exact same red in a significant way

    The color trademark is not for a plain color but the color combination. It is a thing in the us with American companies, louboutin actually lost a lawsuit in Europe against YSL for the use of red soles. However the color trademark in the US is only for same industry. For example I can start a fashion house and have my logos and colors to be the ups brown yellow combo start a parcels company and use the red and white Coca Cola colors but I can’t have a parcels business with the brown yellow UPS colors and can’t have a soft drink with red and white colors because they are recognizable in their respective industries by their colors. Since the color plays a role in brand recognition, a competitor no matter how small cannot use their colors.

    There's a lot more to it than just using the color. You have to be gaining a profit of sorts and marketing predominantly off of that color and it also depends on what you're selling. If you're selling bags, don't use a bag company color, etc.

    The color has to be very specific and used in a specific way.
    Louboutin's have a Shiny Red bottom and a contrasting top.
    So anyone can make an all over shiny red shoe..
    But only Louboutin can do a matte red top with a shiny red bottom.
    You have to establish brand recognition and that confusion will arise if another brand does the same colors or iconography.

    A heap of companies in australia were in a legal standoff with Cadbury over the colour purple in general, for anything chocolate based. This was back in the 00's. I worked for one of the companies. Sadly Cadbury got their way. So not always one trademarked shade.

    You dont get sued for using a colour, it's not enforceable. Not currently. Sueing is only on the cards if you're trying to mimic the product incl ith their colour, and even then they have to prove you are.

    Some have tried but color they wanted to trade mark was far to generic to actually trademark or their request to trademark a specific color was so broad/over reaching that they denied it.
    If they come up with and named a color after them, and then trademarked/patented that, I can see it but I dont think they can simply sue you for using a shade of a color unless its the specific one that they trade marked.
    No one can "own" a color as a whole, maybe a specific shade but a company can't just own "Purple" it has to be a subset of said color that is unique identifiable because if it is one that is too frequently used or too broad they can't obtain it.
    Its just a way for people to get the express ticket to greed and fortune, its rather disgusting and depressing.

    They on is in specific segments, u made is sound general as if they owned that colour but that's not the case, for coke they own that share of red but only for drinks, if u used it for a shoes brand logo they can do anything same goes for the rest.

    So you only get a trademark if your brand is recognised by the general public, Tiffany blue was already known but it’s not the colour, it’s the likeness to the colour and brand, no one will recognise the orange or grey, Also big company’s could only do this because it’s not really possible to trade mark a colour you can’t own colour, you can trade mark the likeness to that colour, “it’s more like Tiffany blue” or Louie red “ that’s trademark

    It’s important to know that these trademarks usually only apply to competing products, and only specific shades. Like target has a trademark on their specific shade of red, meaning Walmart can’t use that red color in their branding or products, as an example. And that usually applies to similar red shades. It’s why Coke and target can’t and don’t sue each other for both using bright, high saturation red colors in their branding, or staples and target, or Walmart and Facebook, twitter, or any of the myriad internet and tech companies using blue. You also typically can’t file for a trademark if everyone in the industry commonly uses that color or a similar one (internet/ tech companies all using various blues, for example). Trademark and copyright laws are fucking complicated and often a nightmare to navigate. And that’s why these corporate lawyers make fucking _baaaaank._ Shit like this gets hyper specialized.

    It's funny how people in comment sections always seem to be taking things out of context and are severely uneducated in the field.
    To clarify, no they do not "own" that color, you can still use red, you can still use purple etc. They just own the color in their specific field. For example, Tiffany and Co. owns the shade "Tiffany Blue", but only in jewelry boxes. Coca Cola also only owns that specific shade of red in softdrinks/pop cans.
    They do this to prevent people copying their brand and making fakes. And no, you will likely not get sued if you use a trademarked color for that product too. Them trademarking those colors are largely for INFRINGEMENT SCHEMES.

    This is a very normal thing. As you have classifications for services and goods with the registration at EUIPO (European Intellectual Property Office) So for example for Christian Louboutians, there are no other shoe designer who can make heels and use a similiar color red under the sole.
    Read similiar as the judge looks at "confusion for the normal public"

    And you cannot just simply trademark a colour, there are over 1,867 solid pantone colours; if brands all claim a colour, we’ll eventually run out. You can only trademark colours within a design, like Louboutins red under heals.

    There are caveats to the trademarking of a color, typically if the color is too broad or basic it can't be trademarked, you can't really be sued for using the color but let's say if you made a candy just like resses and used that shade of orange for your candy then yeah you'd probably get sued. It's so a brand is recognizable in their industry by that color specifically

    They don't completely own their colour. Although I can't make a fizzy drink with coca cola red, I can make anything else with that colour, and you can't trade mark colours which are functional, so colours that are used for an actual purpose. That means you can't, for example make hi viz jackets and trade mark the bright yellow, because it has the function of making the wearer visible

    LV, Tiffany and Hermes don’t need to waste their money trademarking those colors because guess what.. the marketing association with those colors with their brands is powerful enough. When you look at that shade of aqua/orange colors you already associate them with luxury because of LV, Hermes and Tiffany & Co.

    To legally trademark a color you need to prove thst your brand is strongly associated with that colour and that product only. Do Cadbury has trademarked *purple chocolate wrapper* not purple as a whole

    I thought you could only trademark a colour if it was combined with something. Like the red colour base of high heels is a trademark. But the colour itself isn’t. So I could use that same colour red as a colour for my car, just not with the base of high heels.

    Trademarking color is stupid tbh especially if the colors are not even unique. These brand who trademarked their color did not even have unique color at all. It is ridiculous.
