      that's true, she can divorce her husband even without a big reason in islam. She just doesn't want him anymore , why would she stay ? please dont listen to those who tell you a woman cannot ask for divorce in islam without a big reason like abuse or whatever, she has the right to divorce herself "khulaa" and give him back the dowry anytime by the order of the judge, even without husband's agreement. please read the hadith of the wife of "thabet ibn Al qays"

      There are personal problems. Sometimes the woman may not be able to fulfill her obligations and might fear being sinful like being unable to have sexual relationships. Because some women don't want to complain to her husband or talk about it in a counseling session,she might be adamant on getting a divorce. The reason is between her and Allah. Even if she has a valid reason but her intention is to marry someone else while she's married and planning on marrying someone who she's currently seeing after she's divorced and finishing her Iddah, using the reason to get married to a potential person while she's already married is also under a Haram act.

    My wife has been staying with parents for last 6 months. I tried arbitrators & Ulama to reconcile. But her only demand is to make a seperate house for her. Not rented or seperate room at my house, but all together a new contructed house. Im incapable of constructing house and she knows it very well. She says either construct a house or divorce her. We have a 2 yr old daughter. Now she doesnt allow me to meet my daughter unless the problem is solved. They are forcing me to divorce so that they can get maintenance etc. But I dont want divorce and I cant love without daughter. And all of this is because of silly argument with my parents.And that is Wallahi the only time an argument happened in 3 yrs of marriage, as if she was waiting for a reason to leave. Please, suggest me what should I do.

      Women have rights to separate from spouse parents but if you can’t afford then give her separate room and kitchen but if she still don’t want to live with you and want divorce then do it

      No, sexual attraction is something important but after marrying there's no excuse related to sexual relationships. You have 2 choices. Marrying another woman to protect yourself but IF you're capable of being just or getting a slave girl. So in your situation, either accept her and tell her to beauty herself or marry another who's in need to get married but if you can be just. If that's the case,a woman can divorce her husband if she's not attracted to him. sexual attraction is a mutual thing. Not exclusive to the husband that the woman should be attractive.

      The evidence for that from the Sunnah is that the wife of Thaabit ibn Qays ibn Shammaas (may Allaah be pleased with him) came to the Prophet (peace and blessings of Allaah be upon him) and said, “O Messenger of Allaah, I do not find any fault with Thaabit ibn Qays in his character or his religious commitment, but I do not want to commit any act of kufr after becoming a Muslim.” The Prophet (peace and blessings of Allaah be upon him) said to her, “Will you give back his garden?” Because he had given her a garden as her mahr. She said, “Yes.” The Prophet (peace and blessings of Allaah be upon him) said to Thaabit: “Take back your garden, and divorce her.”
      (Narrated by al-Bukhaari, 5273).

      You can not force a person to love you. If the person really wants to leave the marriage you should not force her to stay. But both of you should seek advice from a good sheikh who will listen fairly to both of you. I say this respectfully - in a marriage no human is perfect thus both will make mistakes. But sometimes it simply that one person does not love the other - it is sad but it happens. May Allah help you solve your marital issues or otherwise allow you both to divorce in peace -- whichever is the best solution , May Allah guide both you and your spouse.

    If a women seeks khula by false allegations, does she have to prove her allegations are true? And also if the women is not in the right state of mind such as sufferring depression and medication is it right for the man to give her talak or accept her khula???

      No woman wants to leave a loving husband and a fulfilling role in marriage. false allegations are often proven in court but she can divorce because she can't stand her husband which is subjective and cannot scientifically be proven but she feels it. Feelings are not false. Often the husband will deny. The teachings of Islam is "be mindful when you marry women as they must be taken care of" The woman has intuition and she senses how much her husband admires, adores, and loves her. Just on this basis she will decide.

      emotional abuse is the same as physical abuse but hidden and is more dangerous because its hidden and you start believing that you are going crazy when you are normal but the other person is making you believe wrong things. Decide and stay firm with the guidance of Allah.

      No, because in islam divorce is a loss to the man, not the woman. And it takes something big for a man to willingly cause a loss to himself. The only reason women suffer a loss in this day and age is because women made themselves worthless by preventing four wives. In return no married man is prepared to marry them.

      this is something that you should talk about and try get counseling. Men and women have desires and a spouse should have interest in their partner. Seek help and i dont know you or your husband and the condition of your marriage but may allah make it easy on u and if u arent happy and cannit move forward, then look into divorce if he's able to fufill ur desires but isnt making an effort.

      Its the ONLY religion that allows women to divorce and to allow divorce in the first place tells us it is progressive. The catholics and jews are forbidden divorce even the man. Hindus are not allowed to divorce at all.

      If divorce (talaaq) occurs before consummating the marriage and being alone together, then it is an irrevocable divorce, in which the husband cannot take the wife back, so after such a divorce her husband does not have the right to go back to his wife except with a new marriage contract and a new mahr, in which all the conditions of the marriage contract must be met, such as the consent of the wife and her guardian, and the presence of two witnesses.
      But if the divorce occurred after being alone with her, and before consummation of the marriage, then this is a matter concerning which the fuqaha’ differed. The majority are of the view that it is an irrevocable divorce, like the first type of divorce mentioned above.
      The view of the Hanbalis is that it is a revocable divorce, so the husband has the right to take his wife back during the ‘iddah.
      It says in al-Mawsoo‘ah al-Fiqhiyyah (22/107), regarding the conditions of taking the wife back:
      … The second condition (that allows a man to take back his wife after divorcing her) is that the divorce has taken place after consummation of the marriage. If he divorces her before consummation and he wants to take her back, he does not have the right to do that. This is according to scholarly consensus, because Allah, may He be exalted, says (interpretation of the meaning): “O You who have believed, when you marry believing women and then divorce them before you have touched them, then there is not for you any waiting period to count concerning them. So provide for them and give them a gracious release” [al-Ahzaab 33:49]
      But the Hanbalis regard truly being alone together as coming under the same ruling as consummation with regard to the validity of taking the wife back, because the rulings that result from being alone together are like the rulings that result from consummation of the marriage. As for the Hanafis, Maalikis and Shaafa‘is, they are of the view that consummation must have taken place for it to be valid for the husband to be allowed to take his wife back (following divorce), and having been alone together is not sufficient.
      Shaykh Ibn ‘Uthaymeen (may Allah have mercy on him) said in ash-Sharh al-Mumti‘, regarding the conditions of taking back the wife: The marriage should have been consummated with the wife; i.e., her husband should have had intercourse with her - because Allah, may He be exalted, says (interpretation of the meaning): “O You who have believed, when you marry believing women and then divorce them before you have touched them, then there is not for you any waiting period to count concerning them” [al-Ahzaab 33:49]. If there is no waiting period (‘iddah) to count concerning the wife, then there can be no taking her back, because from the time the husband says to the wife with whom the marriage was not consummated, “You are divorced,” then she is divorced and permanently separated from him, and there is no waiting period that he has to count concerning her.
      Or he - meaning the husband - should have been alone with her. What we mean is that for the husband to be able to take his wife back (after divorcing her), he should have consummated the marriage with her or been alone with her, because the Sahaabah (may Allah be pleased with them) ruled that being alone with the wife is like consummation of the marriage, so if a man divorces his wife before consummating the marriage or being alone with her, he has no right to take her back, because there is no ‘iddah or waiting period to be counted. So she becomes separated from him as soon as the word of divorce is uttered.
      Ash-Sharh al-Mumti‘ (13/182).
      Undoubtedly the more prudent option is to adopt the view of the majority, and to do a new marriage contract, and you may agree upon a small mahr.

      most definitely it's abuse. Islam gives a higher status to women. Next time he will use something else, as abuse gets uglier because you become a victim. You verified that he can get away with it. Crying out your eyes or making yourself think he will change. He never will. It takes years for men to rehabilitate and you will need proof that in the future he won't do it.

      @@emma647 Depends on how old your children are. Girls especially with stepfathers are problematic. The dynamics change and feelings change with children during split up. They sometimes decide who they want to live with. If there are babies that may be a simpler case as the child under 2 years easily integrates into a new family.

      @@aliay2743 That isn't true, infants are affected considerably by any changes in their routine and most certainly if they are being removed from the care of their own mothers, who they have established a bond with prior to even being born,
      which is why courts seldom rarely give custody to anyone other then the biological mother of an infant, a mother is always considered the 'best' person to parent her own infant, unless she is unfit to parent or remarries, Islamically also a mother takes custody of her infant children, she has the right to breastfeed her child and her child the right to be breastfed by his/her own mother.
      There is also no difference between girls and boys in regards to stepfathers, since a stepfather becomes a permanent mahram of a girl upon marrying her mother and consummating the marriage, so I am not sure on what basis you consider the relationship between a step daughter and father more problematic then a step son and father?

      @@emma647 I know of a friend who remarried and her daughter was 16, she was groomed by the stepfather and later put into prison. But the mother and daughter relationship and the whole family is very traumatic as a result.

    A woman can spare her self all of this drama and marry a religious committed man ,this kind fear Allah and knows the rules he will treat her right due to that .most healthy/ happy and emotionally satisfied couples i seen are the religious type ,they rarely marry another and if they do they pick good religiously committed women, the healthy type , The happiness that peoples imagin and lives life looking for it is God giving only who he grants to his loyal people anything diapprove with Allah laws is mystery decorated with fake happiness .

      At the end of day all what humans needs and dream about is God property but most seek other means there fore lose the joy of relationships, life ...etc till it get a life draining to sick bonds/matters , satan gifts are temporary joy to eternal suffering but most dont see that .

    Divorce is not allowed in islam for women if they have not suffered physical or emothional abuse. Most imams will not agree to divorce without these types of conditions for women, whereas men dont need any excuses. So situations like mentioned here about not being in Love with her husband, under islam law, you dont have the right to divorce.
    I have heard so many imams talk about this, and everytime it comes to this. But i believe men and women, doesnt matter what religion or culture, arent fully educated on marriage. Although it seems islamic stay away from sin for sisters, please think about yourself and the double standards you might face if you end up in a divorce.
    If anyone has more info about this please share. So we can talk about these very serious issue that surround women in islam.
    There is more discussion on youtube about what to do on wedding night then these issues, and we need to change that together.

      Jennifer Engames Quran doesn’t say women will go to hell because of that. That’s for Allah to decide.
      But these issues just aren’t discussed within the community. Because we always want to keep the hope that we won’t be the ones in these situations. How wrong is it to put your future freedom and happiness in the hands of someone else, especially being told by some imams on UA-cam to allow your children to marry young, before falling into any fitna.
      But if you marry young, and your husband can divorce you for literally no reason, how is that fair in any relationship?
      I have met so many sisters so are amazing human beings, but at the same time so naive! They live in a dream world where marriage means love forever, and family and community appreciation is valued more than themselves.
      I believe, when you are signing those nikanamah papers, you should have a mental understanding that there are two out comes, both 50/50, either you’ll be married forever, or you will get divorced, and imagine your life not only of being happily married, but also divorced.
      What will the divorced you do, are you ready for it? I will not even talk about the life of a divorced women around the world, it’s another topic.
      I’m saying this to my fellow sisters, whoever is thinking of marriage. People don’t tell you this, they only tell you to stay away from whatever is haram. Stop pleasing the elders around you. Once your married you are on your own, not even your family can help you. Unfortunately, because you were born a woman, it is expected of you to have more patience. And it is expected of you in Islam to not have equal rights over certain things. Before getting married let’s learn about our religion first. Without the law of the country, what right do you have. Can you ACTUALLY stop your husband from marrying someone else, does the agreement on your nika actually hold up islamically, or is that just a new trend that everyone is going with. This matters, because we are muslims, and ultimately no law is above the law of Allah.
      We have serious flaws in understanding Islam, that is because as women we avoid these topics and talk more about other minute issues, like how to pray more to gain extra rewards. Whereas there are women suffering in countries like India because of these sharia laws people have made up.
      In my opinion, no one can live without believing in something. We believe in Islam, and we love God. None of us are willing to give up our religion just because Quran wasn’t translated correctly with women’s advantage in mind. So we can start discussions to talk about these things, at least we would have fought before giving up.

      Im from the philippines.. I was a naive revert sister who thought ive married the right one for ..ive been contemplating in divorce for so many years but my wali only said..SABR it is ur qadr... So i stopped thnking about it.. But alhamdulillah i met a couple who i open up my case and theyve told me i have valid grounds..first i am not attracted to him evr since.. I waa given wrong information about him.. I didnt know him.. I just married him afyer 4 days being introduced.. Bcoz inthought he is a scholar.. I ddnt pursue khula bcoz theres hadith telling usbwomen tat we wll nvr smell paraidae if we asked divorce withou valid reasons... and people think my reason is not valid....right now im wiht a man i dont love.. Im becoming disobedient bcoz evryday i blame myself for beinf so naive i was new to islam when i got married.. 19 yold.. Now im alrdy 32 ..we dont have a child.. I dont love him 😔... Im always sad

      Chastity is defined as "controlling oneself from forbidden desires due to the love of Allah The Almighty in response to His command, as well as for seeking His reward in return."
      Islam has always been keen to establish chastity in the Muslim community and has thus legislated many laws that reduce the strong impact of these desires and control them; it has also encouraged remaining on the straight path and warned against transgressing the defined boundaries by following these base desires.
      Islam has preserved people’s honor and protected lineages from being mixed. Therefore, fornication and adultery are forbidden and classified as major and destructive sins. Islam has even forbidden everything that could lead to these sins, such as immoral exchange of looks between the two sexes, depraved words, seductive moves, a man and a woman being in seclusion in a room, and anything else which could lead to this awful sin. Allah The Almighty Says (what means): {"And come not near to unlawful sex. Verily, it is a great sin, and an evil way (that leads one to Hell unless Allah forgives him)."} [Quran, 17: 32]
      Islam does not have laws which contradict one another as is the case with man-made legislation which has set penal laws for adultery and fornication but has facilitated every means that lead to it. Moreover, there are some societies that see no harm in allowing fornication and adultery and have set no penal laws for those who commit them. Other societies differentiate between committing this act in the marital home and outside of it; they only consider committing it the marital home as a crime and not if it is committed away from it! Islam, on the other hand, comprehensively forbids fornication and adultery and everything that leads to it.
      Allah The Almighty commanded His Messenger to take a pledge from women who entered Islam to refrain from fornication and adultery. Allah The Almighty Says (what means): {"O Prophet! When believing women come to you to give you the Bai`ah (pledge), that they will not associate anything in worship with Allah, that they will not steal, that they will not commit illegal sexual intercourse, that they will not kill their children… then accept their pledge."} [Quran, 60: 12]
      Allah The Almighty made the punishment for these sins vary from lashing to stoning to death, along with the humiliation which results from informing the community of the perpetrators of this sin. Allah The Almighty Says (what means): {"The fornicatress and the fornicator, flog each of them with a hundred stripes. Let not pity withhold you in their case, in a punishment prescribed by Allah, if you believe in Allah and the Last Day. And let a party of the believers witness their punishment. [This is for unmarried persons, but if married, the punishment is to stone them to death]."} [Quran, 24: 2]
      The Prophet set the penalty for adultery and fornication as follows: "If the parties (committing fornication) are unmarried, they should receive a hundred lashes and be put into exile for a year. If they commit adultery after they are married, they should receive a hundred lashes and then be stoned to death." [Muslim]
      Since Islam has comprehensively forbidden fornication and adultery, it has also blocked all ways that lead to it. It does not have laws which contradict one another as is the case with man-made legislation which has set penal laws for adultery and fornication but has facilitated every means that lead to it. Moreover, there are some societies that see no harm in allowing fornication and adultery and have set no penal laws for those who commit them.       The evil consequences of fornication and adultery
      Imam Ibn Al-Qayyim said,
      "Fornication and adultery combine all evils; weakness in commitment to the religion, lack of piety, corruption of manhood and the decrease of praiseworthy jealousy. You will never find an adulterer or fornicator who is pious, fulfils his promises, is truthful in his speech, maintains friendship or has jealousy over his wife; he will be characterised by lies, deception, betrayal, accepting prohibitions and not being mindful of Allah." All these characteristics are consequences of fornication and adultery.
      There are also other consequences such as:
      • Incurring the wrath of Allah The Almighty.
      • Corruption of one's wife and children.
      • Poverty and gloominess of the face, which will be apparent to people.
      • Darkness of the heart.
      • Becoming insignificant in the eyes of people and in the sight of Allah The Almighty.
      • Loss of the characteristics of chastity and righteousness and becoming known as a sinful, betraying adulterer or fornicator.
      • Not being classified as a believer in general.
      • Being decried as an evil person.

    If 2 individuals, namely 'muslims', loved each other equally at the time of marriage. I.e. liked each others physical appearance etc etc.... then make a claim 5, 10 or 20 years later that they no longer 'love him/her, and for this specific reason want to divorce, then it is a pathetic excuse for separation... so, if......

    Breaking marriages based on the 'fluctuation' of emotions is just ridiculous because this is part of our human nature.... if you were denied a certain emotion at the time of marriage then that's a different story....
    This is just another poor excuse, to do what 'you' want to do. Just conveniently blame the 'love' emotion for your 'unhappy' marriage. This might as well just be the 'new Muslim trend' for 'breakups'.
