When asked why I was told that my two GCSEs meant I was over-qualified as well as the fact that I did not have a shaven head and was not heavily tattooed meant I was not suitable for frightening innocent members of the public. Until it is clarified by a solicitor or in court, I would be uneasy in staying there. Right of access can be withdrawn at any time if they lease the property. “Public place” includes any highway and any other premises or place to which at the material time the public have or are permitted to have access, whether on payment or otherwise ”.

If a police officer first asked you for your name and address but then refused to provide his identity, he may be guilty of an offence and receive a fine. Although this looks ugly, it is possible the officers were correct on this occasion (which is not to say they were right in the detailed reasons given to you verbally). Although you do have an implied right of access to anywhere open to the public, it all depends on the purpose that you have for accessing whatever area is of interest to you. If I go on police property to photograph a police station, arguably that's a purpose within the reasonable expectation of the landowner because the police would expect that people might want to photograph or video a public building. On the other hand, if I start loitering around the rear yard of a police station with a camera without any clear purpose, is that within reasonable expectation? You could argue that it is a trespass and I think if the police then forcibly removed the deemed trespasser, any civil action then brought against the police by the cameraman/auditor for civil wrongs such as trespass to person would probably fall on stony ground. The fact that the gate was open and there was no clear signage, or no signage at all, would not necessarily avail you. That the building is paid for by taxpayers is irrelevant, with respect. On another point, when the police removed you, they were not acting strictly within their police powers, instead they were acting as agents of the private landowner - which will normally be whatever body is the police authority in that local area (though they may, in turn, lease the premises from a commercial landlord). In that capacity, they have the same rights as any other landowner or agent: to use reasonable force to remove a trespasser.

In your example, the rentor has the rent contract. That means they are the lease holder, and have control over the property, and they can prove it.

Nice to see the officers giving there number and identifying themelves when asked lol. I always thought it was in their policy to have to identify themselves ? If a police officer first asked you for your name and address but then refused to provide his identity, he may be guilty of an offence and receive a fine. You would need to make a formal complaint about the officer who would then be investigated by the appropriate authorities.

Implied right of access can be removed at any time - which the officer did at the start - and you should have left at that point. I appreciate the work of auditors and have no love for the police (the strong arm of our tyrannical overlords) but I'm afraid your insistence on implied right of access is wrong. That said, trespass is only a civil matter.

I agree it can be removed or revoked and I also agree with you that this auditor is misunderstanding the law (see my latest comment to this thread), but it is not a simple matter of just unilaterally removing an implied right of access. It all depends on the situation and circumstances and why a right of access is being exercised. Remember that if a right is considered implied, this will often (I accept not always) imply a deeper basis for the right in law, or some degree of exigency or necessity, or both. If, let's say, I make a nuisance of myself at the local police station, can the police say to me: "This is private property, we now withdraw your implied right of access, so leave"? They can say it, but I would suggest that when it is put like that, it is of no legal effect, since the police station is a public amenity and there is an expectation that I will have to access it. Overall I would suggest that this is complex and rests on the facts and context of each case, but one important point is that if an implied right of access is being exercised already, it will normally be very difficult to then revoke that implied right with any legal force in anything other than an obviously private context, such as access to a back garden for footballs, etc. Another way of putting this would be that the law will follow reality and the facts have to lend themselves to revocation. It has to be a right that can be revoked in reality. As a rule of thumb guide: if nobody would take a revocation seriously, then it's not revocation.

Although this looks ugly, it is possible the officers were correct on this occasion (which is not to say they were right in the detailed reasons given to you verbally). Although you do have an implied right of access to anywhere open to the public, it all depends on the purpose that you have for accessing whatever area is of interest to you. If I go on police property to photograph a police station, arguably that's a purpose within the reasonable expectation of the landowner because the police would expect that people might want to photograph or video a public building. On the other hand, if I start loitering around the rear yard of a police station with a camera without any clear purpose, is that within reasonable expectation? You could argue that it is a trespass and I think if the police then forcibly removed the deemed trespasser, any civil action then brought against the police by the cameraman/auditor for civil wrongs such as trespass to person would probably fall on stony ground. The fact that the gate was open and there was no clear signage, or no signage at all, would not necessarily avail you. That the building is paid for by taxpayers is irrelevant, with respect.
On another point, when the police removed you, they were not acting strictly within their police powers, instead they were acting as agents of the private landowner - which will normally be whatever body is the police authority in that local area (though they may, in turn, lease the premises from a commercial landlord). In that capacity, they have the same rights as any other landowner or agent: to use reasonable force to remove a trespasser.
You need a second phone. Then when Mr Violence assaults you, you can carry on filming and call the police.
