‘Can’t Poke a Bear’: State Delivers Emotional Closing Argument Saying Hannah Payne is Guilty

  • During closing arguments, the state argued Hannah Payne is guilty as charged. Payne is accused of shooting and killing the driver of the car who caused a hit-and-run, Kenneth Herring, after witnessing the crash herself. She claims the shooting was in "self defense" to which the state responded, "You can’t poke a bear, claim a bear attacked you, and then turn around and claim self defense. It doesn’t work that way”.

    Her defense attorney is horrible. If I were a juror in this case, the little faces he keeps making would make me so upset. He's not doing his client any favors by doing that. Her lawyer has a hard enough job as it is, because he's trying to defend the indefendible. She's going to go right where she belongs Behind Bars.

      Well you’d make a bad juror if you’d judge a suspect based off the facial expressions of their representation or let emotions get in the way of your making a decision. That’s why there’s 12 that must agree. Not saying she’s not guilty but we can’t judge a trial like that.

    The prosecutor is speaking to them on their level and I love this. She’s not being too fancy, she laid out facts. Great job to this prosecutor and her team! They did a fantastic job!

      IMO, by going soft on cross, she avoided any possibility of creating a notion of sympathy for Payne through "bullying". She was the opposite of Payne's arrogance. Brilliant and then hammered it all home during this fantastic closing.

    I know this has been said over and over again….but this is truly one of the WORST defense attorneys available in our country. He should be ashamed. We *all* know Hannah Payne is guilty and should be thrown in prison…but her defense attorney did her absolutely NO FAVORS in this case. He is the absolute worst attorney we’ve seen in a while.

    Master Class work from the prosecutor because not only did she lay out her case but she also added within the closing the actual definition of each charge so the jurors wont assume what each charge means. She gets a A++ in my book.

    I know we need to let the jury decide and that’s their job. And the Attorneys have their jobs like we all do. But the one thing I feel that’s weird is the facial commentary the Def Attorney doing is really crazy IMO. He looks juvenile and no need for this to me it seems like he’s either on something or he’s acting as this is a joke. And this is my opinion

    I feel like I just went to school for law just listening to this deliberation. I don’t think you could have broken that takes down any better I don’t think anyone could’ve done a better job. I’m so grateful that our community has people like her fighting for us in the courtroom.
    I pray justice for the family, and I pray also for people like the young ladies, who committed this crime that they find someway somehow to address the issues, they have with self entitlement and the need to police people, and other communities or people in general. The death of this man was so unnecessary.

    I had a friend who had a boyfriend like this. He was insane and thought he was a cop. I’m talking about buying weapons and gear police would use. The last she told me he was “investigating” their neighbors because he thought they sold drugs. I mind my own business but I told her to run and take her baby. This is Hannah. It was only a matter of time and her family, instead of doing something they sit there and cry for HER.

    I’m so happy that her lawyer understood that his defendant was guilty. That has to be the reason why he helped to seal her fate by sitting there making faces and acting immature the entire time the Prosecutor was talking. Hannah deserves to feel the pain by receiving a max sentence.

    What I find I sad is how she said “the law won’t allow us to talk about his past”. Yet we see all the time that when it’s something negative in their past, they don’t hesitate to allow the defense to mention it to prove a point about character and aggression. Like somehow Trayvon Martin smoking weed was relevant to his case, but this man being a good person wasn’t relevant to his?

    Two attorneys on opposite sides of the spectrum. Should be used as a case study in law school…one attorney, had a terrible defendant but he was terrible lol. On the other hand, this prosecutor needs to be a law professor if she isn’t one already! One of the most articulate and well thought out presentations I’ve ever seen of anything. Left nothing uncovered.

    Defendant: Not an ounce of remorse during her testimony. To her, everything she did was right, justified, and she didn't take accountability for anything she did that was provably wrong, even if the evidence was staring at her right in the face. IMHO, she was amped up and feeling brave because she had a weapon, and was enjoying her 15 minutes of fame for the self-perceived power she brandished over the victim.
    Defense Attorney: Cocky, insensitive, can't control his emotions/facial expressions... borderline unprofessional.
