Such type of law must implement for Political Persons. Most of them are criminal but rulling the nation. Most all political persons are crorepati . They have earned crore of rupees without doing any work. Such rules laws are injustice with poor who can not fight for justice.
In this situation, police custody can be taken only after cancellation of his bail. It means at the time of granting police custody accused should be in Judicial custody. This is due to the "after considering that accused has not been released on bail or his bail has been cancelled" words mentioned in su. section 2 of 187 BNSS. (2) The Magistrate to whom an accused person is forwarded under this section may, irrespective of whether he has or has no jurisdiction to try the case, after taking into consideration whether such person has not been released on bail or his bail has been cancelled, authorise, from time to time, the detention of the accused in such custody as such Magistrate thinks fit, for a term not exceeding fifteen days in the whole, or in parts, at any time during the initial forty days or sixty days out of detention period of sixty days or ninety days, as the case may be, as provided in sub-section (3), and if he has no jurisdiction to try the case or commit it for trial, and considers further detention unnecessary, he may order the accused to be forwarded to a Magistrate having such jurisdiction.

Friends , I have heard lecture on Custody or Bail . 1. In first instance 15 days remand .it will be total or in part . 2. Earlier after 15 days , accused was invariably sent to JC . Here Court can keep 60 or 90 days . 60 days punishments less than 10 years and 90 days in more than 10 ,LI and Death cases . This is also known as default bail in case chargesheet not filed within 60 0r 90 days ,accused will get automatic bail . But if chargesheet filed within 60/90 days as case may be and trial started ,it is up to magistrate to continue judicial custody otherwise tempering of evidences will occurs. Thus accused may be more than in JC till disposal of cases ie either acquittal or convicted . Ex. Shishodiya case . Here it is discretion of court to release accused on bail or keep in custody .It means under old law , magistrate can keep unlimited time in JC and Police can only take maxi 15 days either once or in parts . It was found that few serious cases are not getting completed in 15 days like rape , murder ,cheating etc where forensics reports are required . If in 60 days rape case and 90 days murder ,reports are not there , Police will not file CS otherwise cases will be week and accused may be acquitted or even discharged . Thus by default bail is given to accused ,rather than spoiling the case . Thus Police takes more time and make foolproof case and then file CS . Sometimes Police files supplementary CS also as to stop default bail but it is dangerous because further investigation may through different light ,hence case may be disconnected and damaged . Considering this necessety , law has been amended . Now forensic experts and courts habe been made time bound disposal and custody if needed by police ,can be given up to 60 or 90 days . Here let me tell you that accused are already in JC aa earlier but now Police can get into Police custody also either for full 60/ 90 days or in parts as magistrate decides . Thus now in New law Police custody can be up to 60 or 90 days . It means accused will be either in jc or in p c and available for introgation . 180 days is for detention and special cases like UAPA ,MACOCA,NDPS,NSA etc . Thus no major change from earlier one except now Police can ask more custody up to 60 or 90 days only . It is necessary and its magistrate power to give or not . Police has to satisfy to court . Yes , lookups has to be made good because crowd will come now .

I made tgis video after too much deliberations. In my humble opinion, the section 187 BNSS is wrongly drafted. Kindly see effect of removal the phrase "otherwise than in the custody of police" which is mentioned in section 167 CrPC but removed from 187 BNSS.

Info is correct dear view, you need see my interpretation once again. Kindly reqd both sub section 2 and 3 simultaneously. And also read sub section 3 of New Law 187 BNSas along with corresponding proviso of old law 167 CrPC then somewhere you will find, I not wrong. I may not be completely right as I had not discussed complete about it. Finally, if I conclud this section is wrongly drafted in new law. If you follow sub section 2 of 187 BNSS, sub section 3 doesn't have proper meaning and of you follow sub section 3 of 187 BNSS in letter and sprit, the sub section 2 of 187 (specially the words within first 40 or 60 days) are useless. Hope, will see the video again. One more thing I want to say, nothing is wrong in interpreting law in a new way but within logical interpretation. First we interpret and try to convince the court with our view, then other party also interpret in own way and then court too applies it mind and thereafter court decides the issue before it. In my opinion, intention of the legislature has not perfectly been reflected in the language of section 187 BNSS, it requires further consideration. Thanks for comment. Keep watching.
