For 10 years I worked with intellectually delayed individuals and they were even treated with more freedom, regardless of their incapacity to understand. Many of these people were given either court appointed guardians or their parents remain guardians, however forced sterilization, birth control, or anything of the like would gain a huge finding with APS and DDA and all parties involved with lose their licensing and their ability to be involved in that client's life as well as any vulnerable adults life. I'm wondering how this case is so brutal, or so special, as I've seen more freedom with someone who is nonverbal, in a wheelchair, with cerebral palsy, severe autism, severe down syndrome, or severe brain damage. The developmentally/intellectually individuals that I supported had complete and full freedom of what they wanted to do with their money, their life, and their medical decisions to the best of their personal abilities. If we had a client that was verbal and could speak up we were not allowed to do any medical procedure on them if they said that they did not want it even if their guardian said that they wanted to do it to the client. Even something as simple as a tooth extraction, the dentist would not extract a tooth if the client emphatically said no, and if they refuse to take their medications it was a simple as documenting their refusal. It was never anything forced on these individuals. I'm wondering how much of this is legal in Britney spears's case as far as forcing her to take medication and coursing her. If she is so incapacitated that she needs an executor and a conservator, then she would technically be considered a vulnerable adult am I correct? If that's the case then they are complacent and culpable and abuse of a vulnerable adult which would see jail time, heavy fines, and inability to work with people within the populace ever again

I simply can't comprehend how any of this was even legal, I used to be heavily involved with my mom's treatment at 16 because SHE didn't trust anyone else and she was right to do so, if it were up to my father, she'd still be in the hospital because he was angry at her schizophrenic outbursts. The doctors didnt listen to him even though ~legally~ my dad was the one to be calling the shots, because my mom could advocate for herself. The treatment >worked< because the doctors respected HER.
I cant imagine how traumatizing it must be to live at the mercy of a person that doesnt care what you want and not even what you need.

Oh yes he does, he just can’t anymore. He’s trying to hang on to the estate and avoid a financial investigation and blame it all on the current conservator of the person. Ethically, I don’t know how he was awarded both to begin with as they both form a conflict of interest to fulfill those duties. His relationship with her from her speech should be enough to dismiss him for conflicts of interest. He shouldn’t be involved in any way at this point. This investigation hopefully opens the door to more in the future into his. The state of California is insane. The fact that this has been going on this long and she can’t chose her own attorney or know her rights to petition is so insane! The system failed her, she was their responsibility to look after. Her court appointed lawyer is a tool at best and more than likely a co conspirator of dad spears. Frankly, I wouldn’t be surprised if judges and lawyers made shady back room deals to begin with. I’m revolted by all of their abuse of power and trust.

This all needs to be scrapped and looked into by new lawyers, new financial managers, she needs to have all drugs withdrawn under oversight by new medical doctors and a reassessment by those new doctors, that IUD needs to be removed, forced sterilization is grotesque. Any one pulling "wages" from her estate should have said wages based on a regular 40 hr work week hourly rate or yearly salary depending on how said employment would be paid, no more, no less. Anyone getting money from her estate should not have a say in her conservatorship as they are not objective. And no one in her family except her children should be getting a dime otherwise.

  • @EMunaBee

Years ago Britney said she wants a baby girl because she wants a friend, which I found so sad (& not the best reason for having a child though she'd definitely love a baby & be a very caring, well intentioned mom, probably with help), to which my older cousin, a lawyer, immediately said "She's not allowed." It seems through the conservatorship or keeping Britney from knowing the facts, she was stopped for years from conceiving. There are many who weren't at all surprised by her comments about forced birth control.
She was also getting less custody of her boys.
My question is if she's allowed to visit her children when it's not her time to have them or if her ex-husband is allowed to bring them over to her when it's his time. I think it would have been nice for her.
What's the reason she has so little custody? I understand from former years, but does that keep going? Is she assessed? Has she tried for more? Is she allowed? Does she know she's allowed to try?

I don't think the federal government should be telling states how to manage themselves," (I'm paraphrasing, it's in the Friday night live stream) and my top about popped at the slight defense of them not being federally regulated. No ma'am, stripping a person of their constitutional rights should 100% be _critically_ regulated by a federal authority for consistency and oversight. If this Britney conservatorship has made one thing abundantly clear, it's that states cannot be trusted to administer conservatorships (or similarly called things, depending on the state) in a fair, equal, and well monitored manner. I'm all for states rights; handle your taxes, legalize gambling or don't, legalize weed or don't etc, but when the most basic intrinsic personal freedoms are on the line, you don't leave that shit up to whatever the state thinks is a good way to do it. This whole shitshow brought an ignored, rotting, festering problem right into the spotlight, and it needs to change. I'm just sad that it took someone as big as Britney for anyone to listen, and that she's had to endure this, because nobody listened before.

Come on, Your Honor, I'm sure the Court sees through such a child-like plan." (Manipulating the Ct to respond saying "yes" or be saying, "I don't see anything childish.")

Emily, I have a question - in the case of James Spears death, because he has the control of the estate/finances, what would happen to Britney’s money? Is Britney allowed to see her own finances? Would she know how much money is, say in her primary bank account? Also, because Britney has shown her ability to work, put on a Vegas residency and have the ability to memorize choreography, execute many intricate moves, give hundreds of performances, record music, being on tv shows, and arguably make millions of dollars - would those circumstances add to her argument to show she’s a capable person? I’m not sure who would use those circumstances in her favor.
    - I’m curious as You can replace James with any other conservator and Britney with any other conservatee.

Being disabled when you have a controlling, abusive family member is a constant battle for autonomy. I’m not even mentally vulnerable, my disability is entirely physical but the system makes it so easy for me to lose all my rights. I’m so sorry and angry for Britney, this shouldn’t ever have happened to her, but I’m glad it’s bringing attention to these laws. I am noticing that people seem to be seeing this as a one off, but it’s not - this is what it is to be disabled. The law should protect us but it does the opposite.

@Lexie I met a girl who was paralized in early 20s. So I researched what is life like. Omg I never had a clue about daily elimination issues. What a hell. Noone talks publicly what its like to depend on family and/or paid care helpers to deal everyday with these private, intimate needs. One must need great internal emotional strength to maintain dignity and self respect to accept this dependence on others. I dunno what your personal situation requires..but whatever it is..wishing you lots of good days and happiness. Hugs.

I’ve got a hundred and one elimination and personal hygiene stories that could make your hair curl! I try to see the comedy in these things publicly, but tbh inside I’m screaming. To not be able to care for yourself and do simple, private tasks at the age of 37 and to have to employ people to help and just to go from one useless person to another who takes advantage, to another who walks out and leaves you in danger, to another who steals your oxycodone…. I could go on. It’s mortifying. Dignity is the first thing to go, the very hardest thing to retain. All while having a family member filing false police reports and trying to legally take control of your care and act as your representative against your wishes so they can force everything you wish to avoid and refuse to happen… it’s just relentless. I don’t know what happened to the woman I was, I don’t recognise anything about the person who is left behind. I wish their was a way of guaranteeing people in my situation some proper legal representation, medical advocacy and support. A lot of us desperately need it.

I would suggest, that evidents of Britney's bad being become reach the court soon, so the Dad's lawyer might be aware. Then Dad can try to act hard attracting everybody's attention, asking for investigation, involving other specialists - do everything in his power to make it seems like it isn't his fault.

Her ex has full custody of her other children and that decision seems to have been based off, in part, the conservatorship. Would the father automatically have the sole decision making power over the child, or would the conservatorship also have to be involved in the care decisions for the child?

His relationship with her from her speech should be enough to dismiss him for conflicts of interest. He shouldn’t be involved in any way at this point. This investigation hopefully opens the door to more in the future into his. The state of California is insane. The fact that this has been going on this long and she can’t chose her own attorney or know her rights to petition is so insane! The system failed her, she was their responsibility to look after. Her court appointed lawyer is a tool at best and more than likely a co conspirator of dad spears. Frankly, I wouldn’t be surprised if judges and lawyers made shady back room deals to begin with. It really seems this all started because her babies were taken - when she was still nursing one - and it caused such suffering and pain, to which she then wanted control, was put in a 5150 and a judge put her under the conservatorship and appointed Sam as the lawyer, over a small incident when she was understandably struggling in her mid twenties...it set he off, she kept being controlled, she kept trying different types of freedom, all used against her, and now she's almost forty years old, furious, angry, traumatized, a prisoner. She's going to get out of this. It's going to help people.

There is no minimum dollar amount for a conservatorship over finances. The conservatorship just recognizes that someone needs to help the person financially and/or to make medical decisions because they have proven they are unable to do those things for themselves. Most conservatorships are for the elderly, disabled or minors and the only income involved is social security, disability, or small support payments. This case gives conservators a bad name. Most of the time, conservators have a lot of responsibility and make nothing. I am inclined to believe there is more to this case than we will ever know. Judges require a lot of documentation to support a conservatorship. I find it hard to believe that a judge would approve of a conservatorship without any cause. Also, Britney’s dad has no authority over her reproductive decisions. That really is Montgomery’s responsibility and not his. The fact that Montgomery is trying to blame him makes me VERY suspicious of her. I have been a conservator and we were instructed to let the individual make as many decisions for themselves that they can reasonably make. Nobody really knows Britney’s medical diagnosis, nor what financial decisions she has made in the past that support the conservatorship. I think her dad is trying to preserve her wealth so she doesn’t sign contracts that aren’t in her best interest and could possibly cause legal problems for her. He doesn’t want people to take advantage of her and leave her without anything. Court oversight with a conservatorship is a very safe way for her to be protected. If anyone is trying to take advantage of her financially, that would be seen in the annual financial accounting and a judge could order that any questionable disbursement of funds would have to be returned to her.

Someone had questioned why Brittney was not allowed to remove her IUD to get pregnant and as a Certified Pharmacy Technician Lithium is dangerous to take while pregnant for the baby and it is difficult to manage Bi Polar Diagnosis while pregnant because of the fluctuations of hormones. Women diagnosed with Bi Polar do however get pregnant and manage off medication or find other safer meds to help manage their symptoms while pregnant and even sometimes their symptoms can stabilize while pregnant. I just thought I’d throw that out there since we now know she was pulled off her medications she’d been stable on for 5 years and put on lithium pretty much overnight. Also you can’t stop any Psych meds cold turkey without a slow taper off while tapering up on a new medication. I worked in a pharmacy that saw many psych patients be treated and I saw this taper down and taper up often and in fact some psych meds actually have packets that are sold in the taper up regimine so the physician did not have to figure out how to do the taper up themselves. Lamictal for example you start with a low dose once a day for a week, then take the low dose twice a day for a week and then up to the full dose after that.

She should have a new judge. I think this court is afraid of having their pants sued off for doing this in the first place. This is so way overboard it just insane! You can fix this Emily!! Lol!!

I'm so happy people really know about this now. Britney fans have wanted her free from this for years. I hope she can:/

IUD's can last from 3-7years. Some even make you gain some weight. She would have at least 2 by now since her last pregnancy. You can take it out anytime. Her dad should be held accountable no doubt.
