      Emily. I was wondering if could check the Joe Budden podcast case. Where he "fired" he is co hosts who had a profit split o the business on the podcast. And he has moved. From tildal. To Spotify. To cash app. To a lot of places..
      Is something that blew over on Black UA-cam . Maybe your audience is too white for that. But I would love to see a real lawyer commenting it shading tactics by business partners and where the pettynesse becomes a misdemeanor.... Like keeping the books from his partners and stuff like that.

    There is a channel called God is Grey that did a video with a survivor of the quiverfull cult, (i.e. Duggarish families). God is Grey then got hit around November 2020 with a defamation claim from one of the families featured in the video. I'd be really interested to hear your assessment, especially with the Duggars being back in the news. It's a Los Angeles case I believe.

    I just want to say thank you for always giving us facts not fuckery. So many channels just give some information with their opinions feelings. Plus they seem to leave out key facts which you never do! Thank you!

      If I had light hair I would color it a bright color on the regular lol. My hair is super dark and it would take so much bleach to be able to do that though 🤦🏻‍♀️

      @@laurac86 you can still get a nice dark purple colour even if you have dark hair. I used to have really dark hair too before I started bleaching it and I would dye it purple regardless of how dark my hair was. I guess it just depends on your hair and what you're using. I'm only bleaching my hair because last year I decided to go silver and lavender :p
      You can find large bottles of developer and cream/powder lightener for decent prices if you know where to look. Honestly if you ever decide to bleach your hair get someone to help you because trying to bleach long, thick hair on your own is a huge pain in the ass 😂

      I really want to dye my hair purple but I always chicken out😂 growing up, my mom would let my little sister dye her hair but I wasn't allowed to. Then I started dating my husband when I was 14 and he always told me not to dye my hair. He passed away when I was 28 lol so now I'm like.....nobody can tell me not to but now I'm too scared I won't like it and will have to spend eternity growing it back out
      Edit to add, my husband didn't say it in a controlling "I forbid you" way. He just said he loved my natural hair color and that combined with hearing the same thing from my mom growing up, just made me not do it

    Could you do an interview with Ethan and Hila to discuss what it was like with this lawsuit and their difficulties with finding an appropriate lawyer etc (only if they are comfortable of course!) I think it would be really cool and informative to hear what the other side is like with the discussion directed by an actual lawyer.

    I can’t believe that this cost H3H3 $100,000’s of thousands of $$$’s. That would destroy most anyone.

      A lot of people donated to cover the cost of the lawsuit, but most of it was paid out of pocket. They felt it was important enough to protect fair use for everyone.

      Phillip DeFranco made a GoFundMe for their legal fees, and if I'm not mistaken the UA-cam community paid almost all of their legal fees with money left over. The left over money was said, at the time, to be used to help other creators in fair uses cases but I haven't heard any updates about it...and this might be the first (in the UA-cam community) fair use case to come about since their last one I'm not sure.
      I think that was a super kind thing the whole community band together and helped them, because they were not rolling in money back then like they are now.

    Gosh Emily, I truly appreciate all you do. I find your videos so enjoyable and informative. I know far more about American law than I did previously and I love knowing the facts of the stories going on, it means I can confidently say “well they are currently out on bond, on house arrest”, “you can get a law suit thrown out due to jurisdiction” etc. It’s helped build my confidence in my own opinions and when having conversations with other people, I feel more empowered to say what I think.

    So wait -- did they get back the ton of money they had to pay out in lawyer fees??
    I'm always worried about this for my channel. I truly feel everything I do falls within Fair Use of the CPT code manual (I'm using small chunks to demonstrate use, providing educational information etc) but the American Medical Association (who owns CPT) sure as heck has deeper pockets than I do to go to court if they think otherwise.

      remember Ethan set up the FUPA fund and people donated? They used the money to fight the court case and won. Then Ethan said the FUPA fund would be for others to use if they had the same problem. To date , it's unfunded and well......... not active.

    An interesting contrast is Akilah Hughes vs Carl Benjamin where Benjamin (Sargon of Akkad) used Hughes’ entire video, without addition or commentary, only changing the title. He was found to NOT have violated copyright because the title was changed to one that indicated scorn and criticism of Hughes, and the audience (his subscribers) would reasonably understand it as criticism.

    Dancers are constantly blocked from using music to showcase our talent. We are in an industry where we can NOT train, grow, promote, or work without other people's music. Now that video and showcasing our moves is a big part of promoting our skill and art... How can we do this without feeling like we are breaking the law?

    Since you are a lawyer....say hypothetically someone downloaded NORD VPN. Say that someone is living through a pandemic & has a very compromised immune system. This person also has very bad eyesight but for some reason her current state doesn't allow online eye exam for contact renewals...but the state where she also has a address in, but isn't currently in, does. How wrong would it be to use a VPN to look like you are in the state where you can renew your contact lenses online🤷‍♀️🤔 hypothetically of course.😂

    I'm not sure if it's good or not that when getting to the section with the bulk of the accusations I legitimately thought, "Oh! There are facts in this one!" but it is a thing.
    But what I do think is interesting, is how Hoss just side-stepped the whole potential jurisdiction issue and just filed in the Kleins' state to start with. Now that we've gone over a few lawsuits in the same vein, I can start to see the flavor of the strategy involved. It's fascinating to see the choices each lawyer makes when they are paid for the full explanation to that "it depends" answer.

    I just heard about you from simplypodlogical who mentioned (all the way at the end) that they didn't have time to have you on. I just listened to your copyright vs fair use. As one of the reasons why the case was ruled against them was that you don't get all the pieces of the original in order when someone stops it often to critique. Hearing this, I'm wondering why many channels can read (usually childrens books) and create the audiobooks. I'm thinking that if I wasn't able to get a book (or even from the library), I could play this audio book to my child. If I want to, I can turn off the sound and read the book to my child. I've always wondered why this is fair.... in case you get to it and explain, thank you!

    How can a client have “good faith belief” that he is on the correct side of the law once they are represented by an attorney? Isn’t it the job of an attorney to inform a client on what constitutes a breach of the law?

    You mention how Matt Hoss attorney’s complaint has a lot of story telling (literally blood!). Why??? Is it a thing that judges just have sympathy for someone’s injuries? Seems like it’d just be annoying.

    So, can I play clips of music videos with or without sound? How about pictures? My son is gay, and I’m active online commenting about music dealing with LGBTQIA issues. For instance, while I don’t know any trans people personally, I absolutely love “The Village” by Wrabel and use it consistently to help parents and friends understand and identify with trans youth. For me, I mention “The Village” as I’m sure he would see it as an ad for his song/video. I see that video as possibly saving kid’s lives. My commentary on the video concerns parental actions that can cost the lives of kids in real life. I strive get parents to give unconditional love to their kids.

      Actually, commenting on someone's appearance in a professional setting would be entirely inappropriate. It's demeaning to reduce a person to their physical attributes in an environment where it is irrelevant. I also resent the implication that you are allowed to dictate what defines a compliment to another person, it's arrogant.

    I've seen many videos posting their dance performance using music (typically copyrighted). In your opinion (not legal advice) would these be considered fair use of the music? Does it depend on the video being not monetized? Does it depend on how much of the music is used? Could or do the copy right holders go after the poster of the video?

      I know on twitch technically just dance streams aren't allowed due to DMCA laws yet I've seen tons of streams lately.

      Fair use isn't written out clearly as cut and dry. You typically would use previous cases that made case law and reference those in your complaint.

    I'm not sure you willl see this (replaycrew!) but I had a question not so much with the video but about how other youtubers do their vnp sponsorships. A lot of youtubers (pretty much all I've seen, even good and responsible youtubers) always mention how you can use a vpn to see shows on netflix that aren't available in your region. That always struck me as strange because I'm sure Netflix has deals and liscences they have to follow. If they don't have the rights to stream something in your region, would getting it through a vpn not be considered theft? Could youtubers get in trouble if they promote the use of a vpn if they tell their audience to use it on netflix in this way?

      @@yawishable I was thinking maybe youtube? Perhapse it is against terms and services/community guidelines to promote something that is ?illigeal/theft? (pirating tv shows and movies)?
      I don't think Netflix would take action against creators. I know they can sometimes tell if you use a vpn and will ask you to turn it off.
      Maybe Netflix might go after vpn company's? Sponsors usually give a text of what a creator has to say which might include using it on netflix (seems likely to me since almost every creator sponsored by a vpn says the same thing).
      I'm not sure in what capacity netflix could do that or what kind of complaint that might be.

      Well I see it like this. They pay for a service (paying for netflix) so I don't feel like it's theft. More like fooling the system, fraudulent behavior or something like that. Even youtube have videos that you can't see from some countries. With VPN you can see it.

      @@evelyneca7454 using a VPN is not pirating. Netflix and UA-cam going after VPN companies is (no offense) one of the dumbest things I've ever heard. VPNs and pirating should not be conflated. UA-cam won't even do anything about actual illegal activity on their website and you think they're going to go after VPNs? That's a hilariously nonsense idea.

I am asking if accessing shows that weren't payed for through a vpn is pirating (I feel like it is) and wether that could cause problems for those on youtube that promote that in their sponsorships. I was not conflating anything. Perhapse read more carefully next time before commenting and perhapse don't be so condescending when you talk to people. I like to think this channel and its commentsection are a safe space for lawnerds to ask questions and help each other out.

    So why does it take a defendant willing to spend a small fortune to defend themselves for judges to finally tell big money interests that their lawsuits are bullshit? Seems like as long as deep pockets dots their I’s and cross their T’s any judge is willing to let powerful people fleece regular people everyday over anything. Why is the default always to side with plaintiffs when a defendant can’t reasonably defend themselves
