    Half the temp agencies you sign up with never call you. The other half give you ONE assignment, usually "white collar scut work" (i.e. writing envelope addresses, shelving insurance files, medical loan collection phone work) and then NEVER CALL YOU AGAIN. And if that isn't bad enough, their clients treat you with an arrogant disdain WORSE than any traditional employer that treats their regular employees like dirt.

    I don't understand temp agencies. They don't direct hire you at ALL. Those days are gone. You interview for the agency and still have to interview with the company. You may or may not get the job.
    Temp agencies place fake job ads all the time.

    I believe this lady totally. Most are more concerned with keeping their contracts with companies,even questionable than addressing concerns of a temp worker. An agency once,lied about why my assignment which was supposed to be temp to perm ended after 6 months..I was a very good worker and there,were no complaints,while I worked there. To add insult to injury they lied to attempt avoid paying my unemployment claim. The Depf of Labor investigated and ruled on my behalf...

    as a young adult I think these temp agencies are good for us young people, knock the sense of slavery into us early.

    Here in NYC, temps are being used to replace long term secretaries, receptionists, clerks, etc. This way they work in the company for years, but have no rights to benefits or promotions. A two tier system of employment. Actually, I think it backfires for companies more than it helps. Thanks for sharing about Indiana.

    I used to work for a temp agency. I made it known in my mind that hustling on the streets is better than working for people who will fire you in the blink of an eye! They will fire you for a 40 dollar profit! I was sent to so many assignments. I spent more in gas than I did on my bills and food! Temp is a waste of time!

    In Massachusetts, temp agencies are required by law to have an operating license from the Commonwealth. Also, the law states that temp agencies are not permitted to collect any fees from job seekers. Instead, all fees are paid by the client companies.

    companies use these temp agencies to offload HR. Electrolux in Springfield TN hires constantly at $14.05 per hour, through Randstad. Randstad pays the folks $7.25 per hour. Randstad makes about $260.00 per week off of every employee.

    I know. I applied for a job through one. They called me, and I thought, "Oh, they'll hire me for this job." I fill out all the papers, including tests (I've got a Bachelors degree, so that's kind of redundant for me), and talk with the woman...only for her to say, "Oh, we have nothing for you at this time." Well thanks for wasting my time! What was the point of all that?

    We've experienced it too. My husband worked 25 years at one job and got laid off. He went to work for a temp agency promised a job would be full time, but at his 90 day mark, they called and said no more work for you - told him to file unemployment. He did. They fought it tooth and nail. This even though he called them, and went and unloaded trucks for $8/hr for 30 hours. They said he quit and the agency didn't know where he was.

    Temp agencies are sales-oriented. They're on commission and if you know a sales job - you have to met targets/quotas. Those recruiters will do anything to lure anyone to take jobs just so they can save their behind to meet their quota.
    Corporate recruiters (not agency recruiting) is totally different.

    She won her case in front of the judge because the agency was wrong for withholding her pay and instigated the dispute.

    I worked 2nd shift almost 3 years without a raise.I was NEVER late,or out.They cut it to make 1 shift and I couldnt stay.They tried to fight me for my benefits.WTF?!!!!!I hate temp services.

    Your point is to the practical and it is a good one. But either you fight for your rights or you lose them anyway. This company was refusing to pay her.

    I work 2 jobs. Back in July 2013, at one of my security jobs I got out of my car to get my phone in my left pocket to call 911 on a girl being raped right in front of me. My employer thought I got out of my car to start a fight with the guy. And that was why I called 911. He fired ne. I told him the truth will cone out in court. I had a copy of the 911 call. It was played. The first judge told my employer to Fuck off. My employer had the nerve to appeal to a 3 judge panel. Once again the 911 call was played. All the judges ruled in my favor and told my employer to go to hell. If anyone cares to listen to the 911 call I have it posted on my channel. There is also a 911 call from a bystander who heard me screaming help. She confirmed that it was the guy attacking the girl. 3-10-15

    And in some towns the temp agencies take over most of the jobs so you have no choice. Also, in Canada normally after 90 days an employer has to either give you the job or tell you that they don't want you. Temp agencies take that law away.

    Well, that's the difference. If you are pissed off because they won't pay you it's ok to be pissed off. The lower judge agreed with your view. On appeal the panel unanimously disagreed and ordered her benefits because she wasn't paid for two weeks. Employers cannot use dirty tricks to keep you from your benefits. You have to be careful not to overly coddle their egos because then you can lose benefits for failing to assert your rights!!!

    I have a lot of story almost similar with this. I scared if I put on youtube it will look back on me. Company will not hire me if they find out I put on youtube.. I am amazed you are so brave.

    I did a construction temp job and it was brutal I mean long days working out in below zero building solar fields and the job was paying 21 bucks and hour but we got paid 11 and the office made the rest out of every worker then had the nerve to say at the end of the job you get a bonus if you finish the job 25 cents of every hour we worked basically our own money back treated like shit while the Forman ride around in a truck with heat we were freezing our asses off I know temps suck I think everyone that works them go through hell I know what you went through

    I definitely agree claimants should keep their cool. But all hope is not lost if the employer pisses them off. That's why she won her case.

    What state are you in? Here in NYC it is the opposite. Lots of temps, few positions... But if the conditions are right I can see agencies doing what you are saying in another city or state. Every state is different, but in NY a drug dealer could only be barred from working at a pharmacy because the conviction is relevant to the job. This is good public policy- if you don't give them a job you guarantee a 4th conviction and taxpayer funded housing ($98000/year prison cell- guards aren't free)

    I live in the state of GA and was receiving my unemployment benefits and my prior employer appealed it and they won. They lied and told the hearing offier that I was fired for insurbordination," I used abusive language toward my senior supervisor," this is a lie. When they had sides officials they told they examiner that I quit, I didn't give them a reason and on-going work was availible. These people told the DOL two reasons for my separation

    California isn't one of the states that we currently help people in yet, but there are lots of places with Cali information out there.

    This is good advice to a point. Actually, just don't volunteer this information, but here in NY the state will notify the employer anyway. Just make sure not to lie on any applications because they can try to use that as a reason to deny you benefits. If you run into an application that mentions unemployment status see a lawyer. Certain states have provisions to punish employers for doing that.

    Well you can count on them to sell labor jobs they wouldn't ever do themselves. And you can count on them to try to prevent you from getting unemployment. Remember they don't need smart, special, talented people, they need ones willing to take a dead end job and low pay.

    now that is a different topic about those whose ancestors suffered the horrors of slavery. I have different views on that, but really we should try not to offend people no matter if they personally have a good reason to be offended. Just don't forget that "black people" are not the only ones who suffered from slavery. Cultures considered black like the ancient Egyptians also had slaves. It is good to be afraid of letting our culture allow slavery so we can prevent it in the future if possible.

    well i understood the story well. as you have proved there's no problem with taking it higher and higher. as high as you have to go, even over the judge's head. there's always someone out there to help, you just gotta find them. to everyone: continue to fight the good fight for justice!

    I have a question about temporary services, when your hired at a place of employment after 90 days does that place have to hire you on permantly or can they continue to keep you on under the temporary service. I had a argument with a certain party telling me that it was a law that after 90 days the place of employment has to hire you or let you go. I argued that the place of employment can keep you on thru temporary service for as long as they want, this way they don't have to pay you any benefits.

    This is actually a common tactic. You have to point out that they lied as best you can. Get the transcript and file your appeal if you lose.

    Some are really bad but I dont agree that all of them are bad. Each temp agency has its own rules. Some of the smaller ones have even been rumored to treat their employees well! I also think that filing "Thieft" charges with the police on the basis that 'employment is slavery' is pointless. It is also very insulting equate temp agencies to slave traders to people whose ancestors really suffered slavery's horrors.

    You may be thinking of FUTA (or Federal Unemployment Tax Act) deductions from your paycheck which employers used to take (and some might illegally still take). Or sometimes it just says "unemployment" (which may vary by state).

    Maybe. It would depend on various factors- most importantly, what state are you in? Every state is different. First ask your state unemployment agency.

    Again I say: Your point is to the practical and it is a good one. But either you fight for your rights or you lose them anyway. This company was refusing to pay her for her work. Once they are refusing to pay you all bets are off. I personally think she could have grovelled and begged and still gotten the same treatment. This was an attempt by the agency to trick an employee into quitting so they wouldn't have to pay their unemployment expenses.

    @Motelcalifornia2 In one way you are right. White collar workers can handle the details better. But I find that the white collar workers are less able to handle the dishonesty of the employers and the judge's insinuations that the claimants are guilty of something. They also are very bad at stretching out their resources when the UI decision goes against them- a lot end up homeless. Even winning their appeals can't get them their homes back once they are evicted.

    I am not defending the agency, I just want to help you understand why you were ruled against. When you hung up & refused the agency's multiple attempts to contact you, it can be legally considered you voluntarily resigned. The agency asking to walk through the steps of the time sheet submittal is a reasonable request. Yes, they could have been more compassionate, but you admitted that you "got up on the wrong side" & it's possible they responded to you in the manner that you spoke to them,

    Imagine if we did not have to spend so much money looking up what are employers use as contractors and subcontractors.We would not go broke determining who are good and bad employers in terms of payment of wages.

    those whose ancestors suffered slavery's horrors-you mean the jews right? 3:) seriously though... Selling the labor of another person is complicated, networking benefits people, but what i would say is more like slavery is the difference between the average CEO's pay and the average employee etc. Where employees making minimum wage don't get enough money to pay rent for more than one person per month, not to mention other living expenses and travel.

    I have been working for a health staffing agency (I'm a resp therapist) for the past 2 years. Work is slow to none existence during the summer and i have never applied for unemployment before. Do I qualify for unemployment? Thanks

    Remember, you are the employee of the employment agency NOT ConEd. To hang up on your employer and further ignore their calls is insubordination and grounds for termination with ANY employer.

      You are right, and that's what the judge said at first. But after an appeal the case was remanded to the judge who then ruled in her favor. The details matter greatly.

    that first lady was 100% wrong with how she handled the paycheck situation. you don't speak that way to any employer- and the temp agency was the employer- unless u have another source of income lined up. they have the power! which is further emphasized by the temp agency's ability to screw her over. yes you can win in the long run but in the mean time your bills go unpaid and you accumulate new bills dealing with the legal side of things. not smart!

    Frankly, if she's have all the evidence (Names dates) she'd make a better report.
    That she;s now starting to blame the rep when she called with an attitude...Not a good result coming I'm guessing
    OK, she hangs up on the rep...Bad idea, Reps don;t like that, they'll sit back and ignore the call.Calls supervisor (In bad mood) starts same stuff, hangs up calls someone else...Geeze...chill hon, chill.
    Then she gets a letter which she doesn't have and they want money back...(Sigh) I quit listening as the cameraman should shut up, she shoudl have kept better records and their whining is annoying.

    i work for a temp... here is the problem... if the company called her directly which is how this sounded.. no glitch.. she got called back but the agency was not notified . the contract with the agency is typically that the worker works for the agency and not the company.. the agency covers all of the comp and taxes for her payroll so yes she works for "winston"" not at "con ed"...... so... thats why she lost... pissy attitudes are never a good thing... no one is entitled for anything. sounds like a staged video to call out a company for doing what they do. she worked for months with no problem... dept of labor? or unemployment... camera man... get it straight.. shes not sure... listen.. she has no clue of times or dates or anything.... this is a joke. thank you camera man for putting it out there..... if she was so great... why didnt the company just hire her? or why wasnt she just hired... every day i hear this same story and they all have ATTITUDES. no employer wants a person with attitude problems... misconduct is part of the application process... hired back.. she went back without authorization.. it wasnt the temp company it was the company.... thats where and why she didnt get hers........ real full or part time jobs will hire you if you meet the requirements... if you dont have them then you go to court. after a short contract with a temp company.. what a joke... sorry.. but if you are as good and not as you are with your employment agency ... hanging up and waking up on the wrong side of the bed as you called it.. you would of been fine...

      You're wrong! If you work you're both morally and legally entitled to be paid what was agreed upon (and or what the law dictates).

      Either way, if that's the case then Con Ed owes her a paycheck, no matter how it goes, she is owed and absolutely entitled for work performed. I seriously doubt, though, that the work place went around their agency to hire her directly. So I'm not really buying that; but if they did, they owe her. She didn't just go there and work everyday without the knowledge of the company's representatives. She didn't go there and start working on her own, and then be like, you owe me some money after the fact.

    If you want a $15 pr hr federal minimum wage. Social security for all generations when you retire and universal healthcare for all Americans. Then vote for Bernie Sanders in 2016!!
