Also, supreme court may, in its discretion, grant special leave to appeal from any judgment, decree, determination, sentence or order in any cause or matter passed or made by any court or tribunal in the territory of India hear cases through special leave, and following this clause (article 136) it heard the case related to Cauvery River Watersharing in recent years. Original jurisdiction of a court can be defined as the power to hear the case at the first instance by the respective court. Ex. Criminal case- session court Parliamentary or legislature related Elections- High court Fundamental rights- both HC/SC etc.
Please correct me if I am wrong... River disputes do not come under the original jurisdiction of the supreme court. States cannot approach the SC in the first instance however they can appeal in SC. Article 262 (1) - “Parliament may, by law, provide for the adjudication of any dispute or complaint with respect to the use, distribution or control of the waters of, or in, any inter-State river or river valley.”
