    Well done video that offers hope. Sad that a mark for life is just that. I know of repentant decent people who decades later still have to confess to the past. It is shameful, non-productive and almost evil in a sense. Who among us has not sinned? Those that didn't get caught? Thank you

    Apparently you can’t use Airbnb with a misdemeanor either 🤦🏾‍♀️

      It will depend on what the misdemeanor was for. A person who has a misdemeanor for something like a DUI would not be prevented from using AirBNB

    The is from the California Supreme Court Stephens v. Toomey 51 Cal 2d 864
    “The word conviction, used in this connection, must mean a final judgment of conviction. A judgment is not final if there still remains some legal means of setting it aside.”....
    “ [12] (C) Those where the court withholds the imposition of judgment, suspends further proceedings on the plea or verdict and places the defendant on probation on such conditions as are reasonable and for such time as is authorized by law. In this class of cases there is no judgment pending against the probationer. He may go about his usual activities, uninhibited by any court order, except the terms and conditions of the order of probation (Pearson v. County of Los Angeles, 49 Cal.2d 523 [319 P.2d 624]). In that analogous case it was properly said at pages 543 and 544 that "... inasmuch as no judgment of conviction or 'sentence of imprisonment in a State prison' was ever entered against plaintiff, his civil rights have been at no time suspended. (Pen. Code, 2600.)" But from the time that the order of probation is made until the case is dismissed the probationer is not a free man. Although there is no judgment pending against him, he is still subject to the restraints of the order of probation and for the duration thereof.”
    So if you are found guilty and granted probation and imposition of sentence is suspended, you are not convicted. The California DAs, the Courts, and the Department of Justice have a financial interest in claiming that a finding of guilt without a sentence imposed is a conviction. Criminal attorneys have a financial interest the same way.

    Can a purged record be expunged? Is the process the same?
    What to do if that case comes up in a live scan fingerprinting but there's no record of it?

    What about if I got my dui expunged will I still have to disclose it for government law enforcement jobs or police or sheriff jobs they have thorough background checks . I don't want to get disqualified .

    • @Recordgone
      @Recordgone  7 років тому +5

      The law only requires that you disclose it when apply for a job that requires a state license, when running/apply for public office or when contracting with the state lottery commission. The jobs you listed do not fall into any of those categories. That being said, the law enforcement agencies will have some information about the case and an expunged record may still may disqualify you.
