    My daughter had her juvenile misdemeanor record expunged 11 years ago, back when she was only 14. The crime does not show up, but the fact that there is an expunged record does show up, causing employers to question her past.
    What is the point of sealing juvenile records, if the fact that there is a sealed record, makes employers question your past?

    I have a question. My husband and I are in the process of fostering, but a hit comes us on his record from 2003. He was arrested but released the same day and no charges were ever filed. Is there a way to still file for Penal code 851.8? Even after so many years? If is it possible to still get a copy of those records? P

    I was charged for a felony in FL in 2012. My record was sealed by the state of FL in 2013. Fast forward to 2016, I was just denied on a housing application after failing a criminal background check in TN. I submitted my sealed record and letter clearing my name from my attorney to the landlord and it is now being reviewed. Can they legally do that? If I can prove my record was sealed, they should have no right to know about it in the first place, correct?

      What you experienced is probably a violation of federal law. It may also be a violation of TN law, I would consult with an attorney in TN.

    Does Pa destroy records or change the disposition of the chargers after an expungement? I had a case where all charges were withdrawn/Nolle processed which after some time i got an expungement because i wanted to enlist in the military.

    So the regulated companies that due background check, how due they become regulated is there a law that protects them?

      +Wake Up !!! Great question! They become regulated as soon as they start providing background checks for specified purposes, most commonly employment or tenant screening. Once they do that, they need to comply with federal and state law and regulations. The main federal law is the Fair Credit Reporting Act. There are also lots of regulations coming out of agencies such as the Equal Employment Opportunity Commission (EEOC) and the Fair Trade Commission (FTC).
      The companies that we call unrelated background check companies claim to be exempt from the laws and regulations mentioned above because they have fine print that says do not use the background checks for regulated purposes (such as employment or tenant screening). But, as the video says, plenty of employers and landlords do use these inexpensive, unregulated background check companies when choosing who to hire or rent to.

    I just received a felony reduction to a misdemeanor from your firm. Thank you for your service. Then I found out by reading federal law. That the state acknowledges my gun restoration writes. But my question is does federal law acknowledge my gun rights being restored. According to penal code 1203.4 and 1203.4a line 7 says I'm not permitted to purchase a firearm. And I'm confused your firm told me I can purchase a fire arm in August. Please I need advice about willfederal law allow my gun rights being restored. Thanks.

      The language you are reading about 1203.4 and 1203.4a only applies to relief provided by those sections. Your relief from the firearm prohibition came from Penal Code 17b. Yes, your firearm rights should be restored.

    How do you prevent it from coming up when applying for a nursing license?

      I have the same problem. I'm working on a nursing degree and have a misdemeanor conviction. Expunged won't cut it. I need it COMPLETELY done. Anyone know how????

    When I was 15 I was charged with felony breaking and entering then possession of marijuana apparently my record has been cleared. A couple days ago I got charged with drug paraphernalia will court be able to tell that this is my third offense?

      Rambo anything under the age 18 is sealed so ...I would say no unless it’s the fbi looking at your record no ....but anything you convicted of as an adult I heard stays on your record even if you have it expunged ..it just shows you had it expunged ...still might use it against you if your looking for a certain kind f job ...

    Expunged and sealed are different. Sealing means you have a record that exist but is covered. Expungement means your record is destroyed and none existent. Know your facts

      I just spoke with the United states navy and they said expunged records still come up in federal background checks...

      +Teresa Hunt I am sorry to hear that your sealed record is still showing up on background checks. Can you tell me what background check company is reporting the case? Have you checked to see if the court or DPS ever actually followed the judge's order to seal the record?

      If that is the only offense on your record that would prevent ownership of a firearm, you should be fine if the judge reduced the felony to a misdemeanor pursuant to Penal Code section 17(b), which is the only way a judge can restore firearm rights in California. There is a difference between the right to possess a firearm and the right to carry a concealed weapon in CA, the latter requires a specific permit for civilians not in law enforcement.

    I had my record expunged in January of 2016. Now I am applying for a government job requiring a level 2 FBI background clearance. Will my expunged record show up on a level 2 FBI background check? I know you said Government background checks automatically update but this is a level 2 background check and is more in depth. Any thoughts?

      +Phara Chery Good question. Expungement in CA does not destroy a record, it changes the disposition to dismissed. So, when it comes to government background checks, the records of the case will still appear, however, the conviction is expunged, leaving records of the arrest and the court case, with the ultimate disposition being dismissed and the finding of guilt replaced with a not-guilty plea..       +Phara Chery Thank you for clarifying the state. Our ERCU service does not impact reports provided by government agencies, such as the FBI. Our law firm does not do expungement in TN. I would speak to the attorney who handled your expungement in TN and ask him or her about how it will impact the FBI report.

      No that did not answer my question. I had the expungement in the state of TN. Do you know what the policy is for that state as it relates to level to background checks?

      I want to help, but I am very confused by your question. Are you saying that a potential new employer turned you down for a new job because they found out about you being fired from a previous job or because of a criminal record?

      There is no such thing as expunging a "employer termination" because there is no such database that exists. If you don't want your potential new employer to know about the termination you have to remove the company that terminated you off of your resume and or job applications when you fill them out.
