We have a cameraman who wants me to say “I will arrest you if you do not stop recording in this public building” should I give him the video he wants? He says he’s a activist and wants to litigate this order in court?
They'll follow the orders that don't affect themselves. There have been many higher court decisions that cops routinely ignore because they take away some of their power.
I’m really confused about their contempt claim. How can you be in contempt of court without standing in front of a judge? Seems like nothing more than a scare tactic.
Unfortunately "contempt of court" is not following, disregarding, or being disrespectful of "an order of the court". An "order of the court" could come from the judges mouth in a courtroom or merely a piece of paper with the judges signature on it (as in this case). However IMO a judge should not be allowed to make a blanket order for anything out side of his or her courtroom because that would be called a LAW and we all know judges don't make law. Fkuc that judge and his orders.
I work with the courts and the county have to have confidentiality rooms for clients and attorneys. As a caseworker, we cannot discuss any cases outside a secure area. We dont have qualified immunity and citizens have a right to sue if necessary. I wouldnt havr it any other way though, qualified immunity needs to go away for everyone.
Going after qualified immunity is one of the worst tactics activists have come up with. Why go after an individual cop with their extremely limited resources when you can go after an institution with millions of dollars of resources?

Good Grief - the sheriff actually said "attorneys have private conversations with their clients in the hallway". How is a conversation private if it's in a common area/public hallway that anyone can walk through. The court also issued a new order for a very specific event at one point - the Prince court cases - due to extra public interest in that case - not for everything thereafter - ugh. Great work again - love seeing the vids from Minnesota.
As a lawyer who has had conversations with clients outside courtrooms on many occasions, there is no expectation of privacy, which is why you speak quietly, stay aware of who may overhear you, and watch your words carefully. For truly private matters, most courts have witness rooms or other areas where you can close the door and have much greater privacy than the literal hallway.

I watched one, a district judge, explode at a bar because someone made a joke, a harmless one, at his expense. I've also seen him scowling at people dealing at the clerk's windows. Another, I could easily see was a pill head and neurotic emotional mess in deep depression and she's well known as a drunk. Plus I've had friends tell me they've delivered drugs to her front door. Our entire systems of government are disgusting cesspools that have long attracted and been a breeding ground for the truly biggest criminals among us.

I'm on Sean's side but I kind of disagree with his stance on court recordings. It seems reasonable to me to protect jurors so that defendents have their due process rights protected. Right? Doesn't that make sense?
@@dougr8646 I disagree how does recording a juror affect whether or not a defendant is given their due process. I have never heard of a juror going so far as to tank a trail over being recorded. Secondly, I believe that juror names are not included in trail records or at least the public version, I could be wrong. Finally this rule seems just as a excuse to stop transparency only worded in a way to express protection and consideration, rather than government overstep.
@@dougr8646 I had jury duty last year. It was recorded live via zoom. The camera was on the judge, defendant, and who was testifying. The jury was not on camera at any point. By the way all of those recordings in that courtroom from security cameras can be gained through a freedom of information act request.
@slayer5able Just look at a few recent high profile trials. Chauvin, however you feel about him, had antifa and blm screaming outside the courtroom and some admitted to being intimidated. Look at the shit antifa has done to those they deem "fascists". Or rittenhouse, jurors were followed home and almost caused an accident. If the hallways were really considered administrative areas designated for, in any way, lawyers to speak with their clients, then the security cameras in the hallways wouldn't be allowed because it would violate the attorney client privilege.

I should add, I do think the deputies acted professionally compared to many of your videos. I will be asking the County what constitutional training the deputies at both the court house and out in public are going through. Of course they do. They do it ALL OF THE TIME and phones are typically required to be turned off, along with no cameras. Most court hallways have an officer and a second metal detector before entering the hallways.

Worked in courtrooms about 11 years and never heard of contempt outside the courtroom,unless people are fighting or yelling and a court proceeding is in session and a warning is given before the contempt order. Edit: why do officials believe a policy or order trumps the law?
You can be held in contempt for not following a court order in something like a family case for instance, so I assume it would be the same here. Of course, it’s still unconstitutional. 🙃
SCOTUS has said that those orders are only enforceable in the court room and "areas immediately adjacent". Not the entire court house. I went to our local court house to specifically photograph the interior of the dome. I did I years ago on large format and wanted to replicate it digitally. They gave me the same bs. I had printed out to ruling and just handed it to them. They started to get belligerent and I did say that I was going to do it anyway so back off or lose everything. I think they talked to the lead judge who must have told them to back off. I was allowed to do as I wanted.

Excellent video! Judges do overstep their authority routinely. When they do they need to be called out for it and be put in check. Citizens have been intimidated and bullied in the judicial system but don't forget it is the citizens in this country who have the real power to effect change!

No one is above the law of God and the laws we have today come from God. He sees and hears all things, and He will remove those who abuse their authority because authority comes from Him.

Should be the judge can recommend a law to be written and he judges if it constitutional written. I can understand a judge might had in good faith making a fair court, but he must provide a private place away from the public if the goal is to protect victims and not go against others people's rights.

They WANT to enforce the judges order but deep down in their bones they know that the judge`s order is UNCONSTITUTIONAL. So they will not ENFORCE the judge`s order because they know they will be sued! The eternal fight within them of knowing what is Constitutionally right and what the judge`s order is will probably loose them a couple of years off their lifespan....lol
This is why when pressed about possible arrest, they said it was POTENTIALLY contempt of court. It was a bluff, an attempt at intimidation to evoke compliance by threat, or actually through issuance of warning.
@@YooToobHandle No. The officer would not be issuing an arrest warrant. judges issue contempt Mittimus to take someone into custody. Mittimus contempts aren’t criminal charges that can be defended; they are considered as “post trial” sentences as odd as that sounds. Mittimus are lawful directives of arrest. A good example would be the paperwork for a civil child support arrest. These do not require a bail/bond or fingerprinting upon booking. It’s a strange and archaic power that transferred over from British magistrates. My take is that it would be a legal seizure if the judge issued a Mittimus, but the Sheriffs do not agree with it. I didn’t take it as a threat, but more as a warning that a judge may arbitrarily issue a contempt writ.

Wow, LIA, you actually made an appearance in my home town of Chaska, MN. Wish I would have known you were in town, because I would have loved to shook your hand and welcomed you. Now the audit. As you mentioned at the end, judges have to much authority and make transparency a huge issue. The two Carver County officers were ok. At least they did not go nutso on you. I have communicated with the Chief of Police in Chaska, and he has instructed our police force about the right to film in public. You are making a huge difference LIA and keep up the good work.

I agree completely..yet if an auditor gets a bit irate because the officers are irate, as long as the auditor is within his rights, they should not be arrested for having a bad attitude or even being nasty. I think after approaching the situation respectfully, if an auditor is then treated with malice or disrespect, then you should have every right to return the favor. While its my opinion that it's in a person's best interest to rise above such childish behavior I understand that we're all human and we all have our limitations. However, that doesn't mean to say that I think you or I or anyone who is exercising their constitutional rights should then give in to bullying if they're treated in such a manner. @@taipan2345 Not always. A judge recently made an order than no recording was allowed in the entire Courthouse or of people entering or leaving the Courthouse. Auditors made a stand & neither the order nor the judge are in force any longer. Asking questions & ensuring that Judges rules are Legal & Constitutional is always appropriate, because sometimes they’re not.

The courts are one of the biggest problems affecting this country today. I have even heard that over the last few years certain members of congress are questioning judges orders on filming and are considering drafting legislation to limit their orders on filming.
They know the legislation and judges think they are above the law they allegedly uphold and note the word UPHOLD as they are not there to make new laws, merely enforce esisting laws.

@@dougr8646 I had jury duty last year. It was recorded live via zoom. The camera was on the judge, defendant, and who was testifying. The jury was not on camera at any point.
By the way all of those recordings in that courtroom from security cameras can be gained through a freedom of information act request.

Just look at a few recent high profile trials. Chauvin, however you feel about him, had antifa and blm screaming outside the courtroom and some admitted to being intimidated. Look at the shit antifa has done to those they deem "fascists".

If the hallways were really considered administrative areas designated for, in any way, lawyers to speak with their clients, then the security cameras in the hallways wouldn't be allowed because it would violate the attorney client privilege.

As a resident of Carver County I'm glad a professional like yourself conducted this audit. I have many questions for the county commissioners.
I should add, I do think the deputies acted professionally compared to many of your videos. I will be asking the County what constitutional training the deputies at both the court house and out in public are going through. The last thing I want is my tax dollars paying for civil rights violations and the public being afraid of exercising those rights.
@@yamakid92 I understand why they would restrict audio and video recording in areas of the building immediately outside of the courtroom where court proceedings are often discussed such as clients and attorneys meeting and attorneys and prosecutors interacting, but these areas need to be obviously delineated, separated and heavily posted with highly visible warnings and rules that apply to those clearly delineated areas. These nebulous orders are not only unConstitutional, they're just lazy and embarrassing.

Of course they do. They do it ALL OF THE TIME and phones are typically required to be turned off, along with no cameras. Most court hallways have an officer and a second metal detector before entering the hallways.

To be fair, the deputy was awesome. He was very professional, respectful and calm.
Worked in courtrooms about 11 years and never heard of contempt outside the courtroom,unless people are fighting or yelling and a court proceeding is in session and a warning is given before the contempt order.

You can be held in contempt for not following a court order in something like a family case for instance, so I assume it would be the same here. Of course, it’s still unconstitutional. 🙃

SCOTUS has said that those orders are only enforceable in the court room and "areas immediately adjacent". Not the entire court house.
I went to our local court house to specifically photograph the interior of the dome. I did I years ago on large format and wanted to replicate it digitally.
They gave me the same bs. I had printed out to ruling and just handed it to them. They started to get belligerent and I did say that I was going to do it anyway so back off or lose everything.
I think they talked to the lead judge who must have told them to back off. I was allowed to do as I wanted.

Excellent video! Judges do overstep their authority routinely. When they do they need to be called out for it and be put in check. Citizens have been intimidated and bullied in the judicial system but don't forget it is the citizens in this country who have the real power to effect change!

No one is above the law of God and the laws we have today come from God. He sees and hears all things, and He will remove those who abuse their authority because authority comes from Him.

Now here is the interesting point. They WANT to enforce the judges order but deep down in their bones they know that the judge`s order is UNCONSTITUTIONAL. So they will not ENFORCE the judge`s order because they know they will be sued! The eternal fight within them of knowing what is Constitutionally right and what the judge`s order is will probably loose them a couple of years off their lifespan....lol

This is why when pressed about possible arrest, they said it was POTENTIALLY contempt of court. It was a bluff, an attempt at intimidation to evoke compliance by threat, or actually through issuance of warning.

judges issue contempt Mittimus to take someone into custody. Mittimus contempts aren’t criminal charges that can be defended; they are considered as “post trial” sentences as odd as that sounds.
Mittimus are lawful directives of arrest.
A good example would be the paperwork for a civil child support arrest. These do not require a bail/bond or fingerprinting upon booking.
It’s a strange and archaic power that transferred over from British magistrates.
My take is that it would be a legal seizure if the judge issued a Mittimus, but the Sheriffs do not agree with it.
I didn’t take it as a threat, but more as a warning that a judge may arbitrarily issue a contempt writ.

Wow, LIA, you actually made an appearance in my home town of Chaska, MN. Wish I would have known you were in town, because I would have loved to shook your hand and welcomed you. Now the audit. As you mentioned at the end, judges have to much authority and make transparency a huge issue. The two Carver County officers were ok. At least they did not go nutso on you. I have communicated with the Chief of Police in Chaska, and he has instructed our police force about the right to film in public. You are making a huge difference LIA and keep up the good work.

I think after approaching the situation respectfully, if an auditor is then treated with malice or disrespect, then you should have every right to return the favor. While its my opinion that it's in a person's best interest to rise above such childish behavior I understand that we're all human and we all have our limitations. However, that doesn't mean to say that I think you or I or anyone who is exercising their constitutional rights should then give in to bullying if they're treated in such a manner. Auditors made a stand & neither the order nor the judge are in force any longer. Asking questions & ensuring that Judges rules are Legal & Constitutional is always appropriate, because sometimes they’re not.

The courts are one of the biggest problems affecting this country today. I have even heard that over the last few years certain members of congress are questioning judges orders on filming and are considering drafting legislation to limit their orders on filming.
They know the legislation and judges think they are above the law they allegedly uphold and note the word UPHOLD as they are not there to make new laws, merely enforce esisting laws.
Do you have examples of members of congress bringing this up or is this just blowing smoke? I'm leading towards the latter.
