It is a lot to learn in a short amount of time and knowing a large percent of folks that take the exam, fail it on the first try... boy o boy. I am studying for my NMLS License in Oregon, the school I signed up for is great if you enjoy reading, which I don't! I read the material and then whatever I am confused on (most of it haha), I look it up on UA-cam and pray you have a video on it (which you normally do). The way you teach and explain everything makes so much more sense! Thank you! 8-)

Please confirm your assertion that RESPA applies only to "owner occupied" properties. In 21 years in the business (both originating and underwriting) at multiple lenders/banks, I have always been required to follow RESPA on all occupancy types, providing the property is not exempt for some other reason. Also, in reading the actual Regulation, nowhere does it state that rental properties are exempt, or that it only applies to owner occupied dwellings.
You may want to "recheck" where you are getting your info. The guidelines/regulation clearly state that RESPA applies to all 1-4 unit owner-occupied properties. This is not "my" assertion - its the FEDERAL GUIDELINES that have been in place since the SAFE Act was enacted in 2008. If you have something different you want to show me - i'll be happy to look at it.... also, it does CLEARLY state that rental property of more than 4 - that are NOT owner-occupied in atleast 1 of the units - are exempt. I didn't make the rules - just trying to help you guys pass the exam... this is what you need to know to pass the exam - Artricia

I was specifically referring to properties of 1-4 units; I just re-read the regulation a 3rd time, specifically the exemptions section, and again, it does not in any way, even indirectly, indicate that 1-4 unit rental properties are exempt. In fact, in both the section indicating covered loans and in the exemption section, no mention of occupancy is made whatsoever. Please don't take this personally, I only used the phrase "your assertion" because you are the only source I have seen that mentions anything about occupancy being a factor in applying RESPA.

Under seller can not make borrower use their company, typically the seller doesn't care it s the realtor that really wants you to use their title company that they are use to working with.

so lets say I get the book 3 days before the closing and I review all the fees and hidden charges ect / if im not happy or don't agree and or understand lets say can a buyer or seller back out of the deal or is the book just a way of saying here the information that you get good luck hope it helps ?
I have a confusing question about fee splitting...I am a licensed real estate agent and taking my NMLS test tomorrow. I know I cannot be the agent and MLO but I am planning on partnering with another real estate agent to give her my real estate clients/referrals and hanging my license at the brokerage as only a referring agent - for a percentage of the real estate deal (I’m a single mom and can’t always be available to travel to show homes). I plan to actually work in a mortgage office full time where my deals will come from other sources I know or my own generation of leads. So can I legally do the mortgages for the real estate clients that I refer to my partner and she pay me a real estate finders fee? It would be me funneling her real estate leads (and getting a finders fee) and then me doing the mortgage. Is this ok? I need to know if I am breaking the law before I go into this🤦🏽♀️.

My ? is when A real-estate agent take a fee know as Earnest money in some way apply part of Section 8 NO Kit backs, NO upfront fees .Yes or No why I say this I put a down payment of $500.00 To scour my spot for this houses. Realtor did disclose that fee of $500.00 was not refundable to the buyer. it apply to this ? So aptly it would apply to section 6? of Section 8 ? right! realtor can't take Earnest money if not under contract.
