      Not just in our society
      It is in fact the default position of the major scholars of the ummah and the pious predecessors

    How about if we are not connected to someone of knowledge, it is hard especially as a woman in the west and there seems to be a lack of scholars to ask questions to 😢

      There are some reputable online seminary now, alhamdulillah
      I'll list them below, there are probably more, but these are the ones I have researched and have experience with.
      Seekersguidance (Shafi, Hanafi)
      Mishkah University (Hanbali)

      @@creativeideas012 yes and I’ve studying Islam for 4 years from when i became Muslim but when I have questions about things or I want to understand something better I have no teacher to help me or local scholars that I know.

    I would love to follow one madhab but I find it hard to learn all the rulings due to lack of resources. Does anyone know reputable teacher or classes I can learn the madhabs or even just the one my family brought me up on? I don’t intentionally go shopping but it’s hard to stick to one when you don’t know the ins and outs of it

    I wanted to ask, I have seen people is south Asia go out fatwa shopping on any topic so the thing is have they researched that this topic exist in Hadith or in Quran. Also, how are the scholars or sheikhs dealing with it are they directly giving verdict based on their opinion happens a lot in south Asian hanafi madhab.
    Surah tawbah
    9:31
    They have taken their rabbis and monks as well as the Messiah, son of Mary, as lords besides Allah,1 even though they were commanded to worship none but One God. There is no god ˹worthy of worship˺ except Him. Glorified is He above what they associate ˹with Him˺!
    Considering this surah aren't we also following the judgement of our imams and sheikhs we approach? I.e. if they are giving their own judgement?

    i am hanafi but i know that there are certain points in which the hanafi medhab is the odd one out of the 4 because all of them agree for example that the wiping of the neck during wudu is not legislated yet the hanafis say it is sunnah so what should i do in such cases as someone who has not really much knowledge. Should i just follow the madhab ?

    When you say “people shopping around in order to do something that they shouldn’t be doing” I don’t quite understand. If every madhab is correct then no matter which one you take from you wouldn’t you be within permissibility? Some clarification would be greatly appreciated JAK

      The problem is that following taking a ruling based on specific set of rules and then taking a ruling that is exactly opposite to the 1st set of rules , by doing this you become a toy in the hands of devil and then you start picking and choosing what you want by applying different standards
      Sticking to one madhab makes it harder for shaitaan to interfere

      There's a difference between being correct and valid. Every madhhab is valid but it's impossible that every madhhab is correct about everything, that would imply that there are more than 1 truth and that's false. However, there is a difference between the Truth in an absolute sense (we could say, the Truth as Allah knows it) vs. the Truth as we are able to access it or approach it. In absolute terms, the Truth is only one. However, there are things in the Shariah where the scholars have made educated guesses and are not 100% sure about. We follow their opinions and it is accepted from us because epistemically we aren't able to have complete certainty about what is correct as Allah sees it. This creates the diversity of acceptable, valid opinions.
      However, occasionally the diversity of these opinions can be combined in disingenuous ways. The famous example is marriage, where the Hanafi's don't require a guardian, the Maliki's don't require an announcement, etc. If you were to manipulate these opinions you could mix and match them until you get a marriage with no dowry, witnesses, guardian, etc which, in total, is a marriage no scholar or madhhab has ever supported. This is why people are concerned about straying from a madhhab or a scholar.
      I typed this in a rush but I hope it has become more clear.

    حَدَّثَنَا عَبْدُ اللَّهِ بْنُ يُوسُفَ أَخْبَرَنَا مَالِكٌ عَنْ ابْنِ شِهَابٍ عَنْ عُرْوَةَ بْنِ الزُّبَيْرِ عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا أَنَّهَا قَالَتْ مَا خُيِّرَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بَيْنَ أَمْرَيْنِ إِلَّا أَخَذَ أَيْسَرَهُمَا مَا لَمْ يَكُنْ إِثْمًا فَإِنْ كَانَ إِثْمًا كَانَ أَبْعَدَ النَّاسِ مِنْهُ وَمَا انْتَقَمَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لِنَفْسِهِ إِلَّا أَنْ تُنْتَهَكَ حُرْمَةُ اللَّهِ فَيَنْتَقِمَ لِلَّهِ بِهَا
    الشرح:
    حديث عائشة: قوله: (بين أمرين) أي من أمور الدنيا، يدل عليه قوله " ما لم يكن إثما " لأن أمور الدين لا إثم فيها، وأبهم فاعل " خير " ليكون أعم من أن يكون من قبل الله أو من قبل المخلوقين، وقوله "إلا أخذ أيسرهما " أي أسهلهما.
    وقوله "ما لم يكن إثما " أي ما لم يكن الأسهل مقتضيا للإثم فإنه حينئذ يختار الأشد.

    Actually all Mudhab are ijthad of scholars and valid, for a layman its permissible to find what he feels the right opinion considering the accountability and the good intention.

      The layman doesn't know the science of hadith or science of fiqh no layman can prove the chain of narrations is authentic because we don't have that ability hence the layman os doing what blind following tue verdict of the scholars

    Sticking to one madhab is like sticking to one scholar and rejecting every other scholar. We should follow all the scholars especially those matters where there is a scholarly consensus. Madhabs are redundant in todays age. They had a purpose in their time when people didnt have access to modern communications but today we should follow all the authentic scholars. Fatwa shopping is a problem for those who dont go directly to the source only.

      That would be correct except that each madhhab has thousands of scholars and is full of living scholarship with chains all the way back to the sahaba. And if you “go back to the source” then you’re going to it (which would take forever to go thru it all also) but you’re going thru it thru the lens of your own understanding as opposed to what we know from the sahaba ra and centuries of scholars who dedicated their lives to studying it all…
