Hey y’all - the video was posted with a title I didn’t approve of but I didn’t notice until now.
TLDR; this was a settlement and not a lawsuit, and Yuzu paid Nintendo $2.4M as a result. While not a “win” legally, it’s a massive financial blow to their organization.
The legality of emulators still remains a very contested topic especially when compared to ROMs.

yeah, I checked by recording the output into audacity and there seems to be a phase issue, the right channel is out of sync slightly because Hbox didn't use a mono audio track for his mic in the first place

@@REvoLverj98 In the case, there were multiple instances where Yuzu devs were sharing roms of games in between each other before the game itself released. It wasn't just TOTK.

A brief reminder that a settlement does not create a binding legal precedent, and even if this case went to litigation, district court decisions don't either. tl;dr, this ordeal does not force courts to follow a similar decision regarding emulation in the future. This sucks, for sure, but it's not the death of emulation. Also, the Sony v. Connectix case only applies to the 9th Circuit (West Coast states, generally).
Summit the story:
Is emluator legal? Should be.
Is Yuzu right? No, they shouldn't involve money into this in the first place.
Is Nintendo right? Legally, yes. Morally, no.
Not even legally. Sony tried to sue a commercial emulator called Bleem many years ago during the PS1 era. And lost. It was ruled that it was fine for customers to use emulators. I think it was was dumb for Yuzu to open a Patreon. That's also probably part of what gave Nintendo a supposed edge. Suggest a kind "donation" from users on the backend. Don't open up clear avenues to make money from it. Even then, Yuzu probably could have won the case as this has been tried by Sony before in the past. But its expensive for the little guy sadly.

@@M64bros Man, its such a facepalm situation. It reminds me of a similar story about a former app for android called UA-cam Vanced. It was an alternative UA-cam app that was better than the official google UA-cam app in every way. It was around for years, totally out in the open. And google never made so much as a peep of caring about it. One day, the Vanced dev team decided that it would be a stellar idea to use their app icon (which was very close in similarity to the official UA-cam app icon) and TRY TO MARKET IT AS AN NFT. Within less than a week google threw a C&D order and forced them to shutdown the app and wipe the whole project from the map. You DON'T try to make money off this stuff. Basic rules being broken from flying too close to the sun.

@@TubeOfLaughes The difference is that Bleem didn't had a guide how to bypass and decrypt Sony's security like the yuzu devs put in their page, the really fucked up because of the money for the patreon they left citra on the dust without updates and it was caught in the crossfire

I think that piracy/emulation is not illegal yet, from what I understand of this case... and even if I do NOT like piracy, it is not going to disappear, other emulators and pirates are simply going to appear that will try to take advantage of the people's nostalgia... and with that they get money.

Although Yuzu is a Launcher, it **allows** the piracy of new products especially new games like ToK and Super Mario Wonder.
I tried Yuzu before, but my computer wasn't good enough to just download the xci file, so I didn't really use Yuzu.
I preordered Sonic Frontiers from a website and the game came to me like 3 or 4 days earlier, than its release. What did I do? I played it in silence and didn't spoil anything to anyone. This is what you do. Making ToTK work early and behind a paywall is way too much. This is definetly what got them into trouble and this qould not have happened, had they kept the "paywall" features to the emulator features, instead of actual game features. All in all it is a shame to see the best switch and 3ds emulators go, but can't say I am surprised when they fucked up this badly.
Yuzu not only willing to help leak the full release of a game, but also PUTTING IT BEHIND A PAYWALL!? I'd go after the ones leaking my games early too, especially if they were trying to make money off of it.
Granted, I likely wouldn't go so far as to completely shut down everything, but I still (kinda) understand Nintendo's side of this. It's one thing to emulate already released games, but leaking an ENTIRE GAME to play early just doesn't feel right. This is just a case of an emulator team going too far by helping release potentially unfinished (at least, more unfinished than it already is) content early. Stick to what's already out there and you'll be fine. This ISN'T the death of emulation, just the death of an emulation team trying to get more money by doing illegal things. It's kinda funny that they said they didn't like illegal ROMs and stuff like that and proceed to do the very same thing
TL;DR Yuzu did an illegal thing (helping leak illegal ROM before release date) and is suffering the consequences of doing it. As long as no other emulators follow suit, we're fine

They, to be clear, played no part in leaking the ROM. They did develop code for the leaked ROM so it worked, though. That being said, it could be argued that they were "just patching bugs" and not explicitly developing code for TotK, which is true.
That being said, it would be a tough and high stakes court battle.
@@AltinaXIV Thanks for the information. It could be argued that even though they were trying to fix bugs, they still possessed a leaked ROM and were therefore in the wrong. Still, not the end of emulation, and I'm glad Hungrybox made a comment about the title.

Yuzu was brought too early in my opinion. Emulators will inevitably bring piracy, that's a given. My personal views on debating whether or not emulation is a good idea is when the console is discontinued (and for modern consoles, when online has shut down). If they were putting features behind a paywall then yeah of course legal action should be taken, because they're profiting off an IP that isn't theirs and are actively profiting off Nintendo's (and other companies') hard work and labor. Putting money to keep a project going isn't new, but putting essential features like it's a damn mobile game isn't cool.

Insanity what is happening right now. It‘s not only YuZu (Switch), it‘s also Citra (3DS) which is not anymore produced, neither are the games. It sucks so hard. Have 3 3DS Consoles, every game I played physical bought but still used Citra for the purpose of recording or playing it in a higher res than 144p. Now, most of it is gone.

To help those who dont under business law. This case created something known as common law. This means cases that display similar characteristics can site this case and resolution as a point of reference. Heavily favoring the prosecutors aka any big gaming company that wants to.

For me Hbox, i grew up with Project64 and OoT and Mario 64 on school PCs. i did end up legally owning both in some way eventually (especially M64 with Wii VC, Wii U VC, and Mario 3D All Stars) But man, emulators have let people like me experience old games i miss due to being of a later generation of kids and also not having much money growing up.

I truly believe the paid content via patreon is the final straw that broke the Yuzu camel back. They gave Nintendo the ultimate means to win this case. Hands down it was the discovery of their patreon. 😢😢😢😢
The one promp that I'll give to emulators like "my boy" for GBA is that there are some games like mother 3 that we could never experience with out the emulation sistem.

If Nintendo doesn't want people stealing their stuff, they should at least give people the option of purchasing it legally. If piracy is the only available method of getting the games they want, then that's what people will have to resort to.

Well, at least the 2DS/3DS is surprisingly easy to hack.
Nintendo didn't "win" exactly. Yuzu simply agreed to settle out of court. Nothing was actually decided in court so no ruling exists which overturns the Sony vs Connectix ruling. Emulation remains legal because no court has (yet) ruled otherwise.
That said I understand why Yuzu caved. When Nintendo defeated Team Xecutor in court they used the argument that the primary purpose was piracy and used that to hold them liable. If Yuzu tried to fight this in court and lost it really would be the end of emulators.
Note that they didn't only take down Yuzu. They took down all source code files from every site that they manage. Of course, backups exist elsewhere and people are going to make clone projects from them.

I don't think that the yuzu team themselves leaked totk in full, but yeah locking support for it behind a paywall was really, really dumb. Oh well, maybe Ryujinx will catch up with the ridiculously good performance that yuzu had. Rip Citra and the future of 3ds emulation for now. Don't delete your exe files yet until we get something else that's as good.
If people want emulation to stick around, don't use it to steal. I don't know what people expect.
You obviously are a kid or just don't care for older games aside from smash. You have 3 options for playing retro games, have them already, fork over excessive amounts of money to people inflating the market for their own gain, or emulate them.

The only reason Nintendo went after Yuzu was because of the ability to play the game early and without purchase while also locking tech support for the game behind a paywall.

Well with that last piece I kinda see why it happened. Whether or not this was settled in court or out of court, if they were paywalling anything it's kinda a massive nail in the coffin. Let alone releasing any kind of fix/mod/hack to a game if it's not heavily covered under fair use.
It's one thing to release a patch to an existing game to make it a whole new game, look at romhacks for instance. It's not the original game and typically is creative enough to fall under fair use. So long as you are not releasing it with the base game file, and are not selling it you are likely scott-free. But if you release the original file, are not creative in your patch, or try to sell it you might as well shoot yourself in the foot.
Sucks we are losing the best emulator around, but I am sure someone will pick up the slack soon enough, reverse engineer the YUZU code and make some new look-a-like, hopefully they won't try anything that is clearly crossing a line, but this screams not an issue for emulation, just a reiteration of don't be stupid.
If yuzu was leaking stuff as it came out and putting it behind a paywall then yeah this is very valid for nintendo to do. I just hope it doesnt start a precedent for others who are not doing that.

Skyrocketing price is bc of bubbles, and no one knowing what the difference is between a collector's items and a trinket; tchotchke. Not all of these games retain collector's value. Many want to price them as such, despite condition and wear; potential value. Of course, there are exceptions and rare items that still retain value, even after going through the mud of one's childhood. At the end of the day, those single items preserved in pristine condition are the ones with true value. Those trinkets with less value, only gain value when part of a full collection; that collection having invested time and not happenstance.
Emulation isn't the problem. It's the bad eggs behind piracy.
Nintendo should come up with a Nintendo program that allows to play switch games on a PC

Now i see what the main cause is...nintendo will exploit all hole/mistakes the yuzu team made, and wider the impact to all yuzu related things/product...in this case citra...
I think emulator still can develop, the developer just need to strictly close all the hole/part that can potentially exploited/sued by the big guy like nintendo....it's hard and tricky, but still possible to see further devwlopment of emulator in the future...just make sure before some group of people try to make emulator, they need to understand all the legal aspect...
