      "Flying knees to the head"
That's 100% on the player going for the mark. They could go "lightly" or very deliberately ram their knee into the human step ladder in front of them. Absolutely. I can still remember a Melbourne player coping a brutal and obviously deliberate full blown knee to the back of the skull. The opponent responsible is a scumbag. In UFC a Flying knee has ended many a fight. There is a difference between pulling a Gary Ablett or using a UFC move, and it obvious to anyone watching. Even the Wiz, Warwick Capper just sat on shoulders. Never saw him thru a knee. Or Ablett snr but did see Ablett lay blokes out with a hip and shoulder or bump ... but he wasn't kneeing guys in the head, just sitting on their shoulders

Tasteless how much personal animosity was publicly aired this week. Caro talking about flowers and wine- that's soap opera stuff the footy public doesn't need to know about. Melbourne's carry-on reminded me of the Petty-Zorko incident last year- lots of selective moral grandstanding from that club. Hope Brayshaw makes a full recovery.

Obvious (but unwelcome) question: If you have a concussion history like Brayshaw's and given the serious cumulative effect of concussions, should you be playing a collision sport, like AFL, at all? Does Brayshaw have a duty of care towards himself?

    • @MonarchoHoppean

They refuse to have this conversation because it involves the "victim" taking responsibility for his own actions. Fact of the matter is Maynard is not responsible for the health of Angus Brayshaw, and Brayshaw went into that game knowing the risks.

There will come a time in the not too distant future that the AFL (as well as the NRL and other contact sports associations) will intervene and medically retire players who have a bad history of concussions to ensure they can't be accused of negligence. You can't insure against negligence. They can't rely on the players or clubs making sensible decisions.

You can see the leaking/media propositioning on a person like Gerard Whateley. When he calls the the game, he says it’s an accident. Then his position starts to change so it’s more in line with the AFL’s case. He’s doing PR and running their case for them in the media, countering defence arguments and even making comments that look like they came from the Brayshaw camp. Then when the decision comes out he tries to save face and agrees with the decision.

The caller pointed out the truth with how that is way more dangerous and could have potentially ended like a serious car accident would. Fractured sculls ect. Gerard went on to try to gass light and guilt trip the caller saying how could he say such a thing how could it have been worse. A guy was knocked out for 2 minutes basically saying how dare you to the poor guy making a valid point 😂😂. It was embarrassingly bad and obvious. Boxing/MMA is completely different - they receive heaps of blows to the head in a short amount of time, both in training and in competition.
You can still have concussion without being knocked out, not to mention delayed concussion, where it may take days or even weeks before they show symptoms.
So i dont think its a fair comparison. In my opinion, players should already understand that concussion is a risk of playing a contact sport and accidents are going to happen, so i think the AFL just needs to make them sign a liability waiver. Brayshaw contributed greatly to this incident. He chose to bounce the ball while running toward the goals. Maynard had already left his man and was running toward him to pressure him to kick the ball. But Brayshaw tried to get every possible foot forward. Maynard couldn't shirt-front him. He was too late to tackle. The only footy decision he could make was to try to smother the ball even though a lower kick might mean he collected the ball in his head. The AFL in reporting him were saying he should have avoided contact by not jumping. This WOULD change the fabric of the game and make it like basketball where you have to avoid contact. Because it was Brayshaw who was knocked out his major role in causing the contact is being ignored.

I'm a Pies fan and not surprisingly I think they were right to let him off however if the AFL is serious about player welfare they need to start exploring every possible scenario where head high contact can occur and state their position on it. These sorts of incidents occur every year. Carlton fans might want to reflect on Cripps hit last year. He didn't get off because he was found innocent, he got off because they got a QC to argue the AFL procedure wasn't followed correctly at the tribunal. Every club has had incidents like this in the past and will continue to do so. As others have pointed out a knee to the back of the head has caused concussions so if you choose to lift the knee in a marking contest it's only logical that you "chose to do it" therefore you're responsible for the injury. Where it's going to end I don't know.

We should really have a substantial, informed review of how these things are handled and then figure out whether certain actions need to be removed from the game, along appropriate structures, protocols and supports to compliment the 'known and accepted risk' approach. Saying a player should just individually call it quits is very easy when its no your dreams and potentially millions of dollars of income on the line.

AFL has a credibility problem when it comes to player safety. In similar charge down issues Rugby League and Union place an onus on the charge down player not collecting the player in possession after he kicks the ball, especially in the head. Go for an ambitious smother or charge down (ie jump forward and off the ground), but risk a yellow or red card and suspension if you dangerously collect or knock the player out. Without a sin bin or send off function the AFL can only send the safety message via suspension.

The big thing here is the AFL unequivocally needs to come out and outline what is a the duty of care. The consistency of the tribunal this year is an absolute disgrace, if you look at 3 week ban handed down to in think it was Shane MacAdams bump early in the year. Yes forceful front on contact was made it believe the impact was to the chest and it was the actual force of the contact that created the significant whiplash motion that actually led to the concussion as apposed to direct head contact. Now this action is also with in the rules of game yet we see a 3 week ban handed down for rough conduct, on an incident that is with in the rules of the game because of the result of the hit not the actual hit itself, so why is this any different. Both players concussed both players performing a football act and the one who gets off makes contact directly with the head with the shoulder, can we just get some consistency so we can understand what is actually going on because right now it looks like if you belong to the big 4 clubs in Melbourne you are treated 1 way and the rest is another and it gose back as far as Patrick Crips getting off to win a brownlow last year how the AFL got that so wrong is still a mystery to many.

*This is about to get long winded*
I agree with the minor changes that have been made to protect a players head (dangerous tackling, high tackling). A deterent has already been put in place to stop players intentionally going for the head.
The AFL could also follow the likes of the NFL and pay their players enough, that should an unfortunate injury occur that causes a player to retire early or worse, suffer life long consequences, the pay reflects the risks. Buddy set a record being offered a $10 million 10 year contract at Sydney, yet Nick Bosa just received a 5 year $170 million contract extension with the 49ers. I would argue that the risk of buddy suffering a career ending concussion would be much higher than Bosa's yet the pay isn't even marginally close.

They have all completely missed the point. The moment Maynard jumped there was never going to be any other outcome other than he was going to clean up Brayshaw, no doubt at all. Everyone has gone out of their way to make excuses for Maynard from the moment the incident happened. Watch Brayshaw here, it was a text book disposal the way that any coach would teach any player particularly any kid to kick the ball. yet he looks up and before he can defend himself in any way is cleaned up well after the ball has been kicked. The contact is way late, it’s high and yet Maynard is not accountable for any of his actions here simply because he was trying to smother???? What bollocks. You can certainly argue about intent and I agree there was no malice but so what??? That would mitigate any suspension but it should not prevent a suspension. It’s really simple, if head high contacts is made then you are supposed to be held accountable, if it’s late contact then you even more accountable.
