      yeah but when the samples are going to cost more than record is going to make in the long it's not worth it. I think the companies lending or leasing the samples should take this into consideration cause if anything it would be exposure for the artist of the sample being used but because of greed from the record companies, this will never happen and this is why samples will always be stolen.

      chuck Core There have been ways to get around the cost of samples, and it's mainly convincing the artist to allow the sample to be used. The problem with that solution, in today's music industry it's already hard enough to make money so when it comes to giving stuff away that's hard unless they get some sort of guarantee to something.

      Correct, sampling is taking a small seconds-long section of a song, possibly changing the speed, looping it, and making it your own. That’s exactly what Vanilla Ice did.

    I feel sorry for John deacon, the bass player of queen. The riff was his original idea and not enough people are giving him credit for creating that bass line the vanilla stole.
    Update: it has been several years since this post. I have since changed my mind. I understand artists sample and that he is not a thief. I actually like that artist cover other people’s songs or use pieces of it because I get more than one version of a song I like. That’s what art is. I wasn’t thinking this way at the time of this post four years ago.

      +Syntax Sampling is still a thing in hip hop, it is nothing new. Sampling is when you get a part of someone else's song and modify it so that you can dodge copyright issues. You don't need permission for sampling. As much as I like Queen too, I also love Hip Hop, and this really isn't anything to get mad over lol.

Go to his Vevo youtube and you will find out real fast that most people don't know that the beat was taken without permission.     I fact-checked him. He's lying. It went platinum 4 times (not 5); it was settled out of court, and Queen got royalties for the sample. Most artists don't sue rappers because rappers give credit to the the artists that they sample from. He acts like rappers steal from other artists. They don't. They ask permission to use it or buy it from them.

      Back in the day, in the 90's and before, rappers didn't credit much for their samples. As rap grew in popularity, they began to credit their samples more and more, because as Vanilla Ice explains, if you make a lot of money and you don't credit/pay for your samples, you're going to get sued. In the early days of rap, rap artists didn't really make enough to justify suing them.

    1. The bass was not sampled and it is slightly different.
    2. Van Winkle sampled the 2 piano notes in that intro...thats why he lost in court.
    3. Van Winkle bought the publishing rights for Ice baby, not Under Pressure.
    4. Queen& Bowie still get royalties out of "Ice baby" as they are co-writers.

      it's not stealing, especially if it's a snippet. they don't own the rights to the sound the instrument makes. that's exactly what the this whole spiel is about. that's what a sample is. they own the rights to a full song, not a sound from the song. if I use a bass sound from a U2 song how is that stealing ? it's a bass sound , I can play the bass too, doesn't mean I own the rights to the sound it makes. if I took this argument to court, I would win.

      Vanilla Ice became a household word for a while, not because of his talent, but because of the copyright infringement that occured in 1990 when it came to light that he had sampled Queen and David Bowie’s “Under Pressure” without consent or license. Ice Ice Baby hit number one on the charts in the United States and Vanilla Ice became the one ‘under pressure’. Vanilla Ice altered the rhythm of the baseline thinking he would thereby avoid any question of credit, royalties, license or even permission. This case never went to court as it was clear that Vanilla Ice had stolen the sample without permission. He settled out of court with Queen and David Bowie for an undisclosed but very likely very high amount. Ice Ice Baby has been released in many different versions, since then, with all of the legal procedures followed.

      Lesson: If you want to use other people's work, you must ask permission first. I was a fan of vanilla ice when I'm 11. But when the time came I heard the song Under Pressure and I searched that he never first asked for permission to use the sample, I'm dissapointed. I think Vanilla Ice's parents didn't teach him the good values.

    He didn't lie on any of this. Sampling was a term, because it was rampant in the 80's, particularly in rap. Only when Vanilla Ice did it was it now a "massive crime". And its like like ten seconds of intro before he starts rapping. Big deal. I mean Queen got both paid from his song, and then it cemented Under Pressure in rock history, because I am old enough to tell you that going into 1990, no one cared about "under pressure" until he used it. That song had came and went years ago.
    Here's a great example. Run DMC only knew the beginning of "Walk This Way", before they did the song with Aerosmith, because that is all any rap artist played in the clubs. It was super common to use "Walk This Way" on peoples underground raps, but only the intro. But Ice is right. If you didn't sell millions of albums, not one cared.

      1) I make no money off my use of the logo. I am actually giving the logo
      and movies free publicity. Vanilla Ice made millions from his song.
      2) I took this logo from a website which claimed anyone could use it. Therefore, they are possibly the one's at fault, not me.
      3) This logo is available free everywhere. If a trademark is not actively restricted, in time it passes into generic use. This happened to Aspirin and Kleenex. Coca Cola takes great pains, though, to protect their brand name.
      4) I see no lawsuits or cease and desist orders on the Internet from Colombia Pictures directly restricting the use of the GhostBuster's logo. Colombia Pictures appears to be making no effort to restrict the generic, non-money making use of this logo.
      5) I also see no info to suggest that the GhostBuster's logo is not currently trademarked. If you plan to make money off GhostBusters material, get permission first.

      btw not necessarily. for example the Beatles are a band that at least for the longest time was notorious (because you wouldn't get the sample cleared).
      (also, while you can get the majority of songs cleared, it's often still a question of cost. I remember that DJ Shadown, an artist who is know for creating multilayered songs consisting out of lots of samples once said that for an album of about 20 tracks, he produces about 30 - because there are 10 that will probably be impossible to get clearance for)

      No. What gets me is he tried to pass it off as something original. As for sampling, yes there is a problem if the rules aren't followed. in another comment, you point out that it's not the entire song. however, the baseline was a major part of the song. before VI, if you heard the baseline, you would automatically think of Under Pressure. Because it was a major part, it was required that he either wait until it was in public domain or get permission. You also point out that that's not the role of the artist. however, that doesn't matter. that just means that whoever he had to do that job didn't do it for whatever reason, whether he didn't tell him to get the permissions or they didn't listen. he shouldn't have used the sample until he was sure he had a legal high ground. And that's not just from a moral standpoint, that's from the standpoint of good business.

      Fair points, although the bassline is only used in the hook and interlude. I take issue with people either claiming that this is no music, or that the entire song was stolen. My claim isn't that he doesn't need to ask permission, it is that especially in that time frame numerous artists where sampling in the hiphop (hiphop spawned from a DJ looping classic soul and funk tracks with an MC rapping over it) genre and most of these artsist didn't even know it was illegal. Another problem is that for example a highly classic hiphop album like Public enemy's it takes a nation of millions to hold us back could have never been made in this era, because it would probably cost too much to get all samples cleared. There are sometimes samples from 12 different songs and films in one track. To me it is an art form. Now, i wouldn't call ice ice baby classic material or art per definition, but sampling is, and it's a shame that people seem to think otherwise mostly because they are uninformed about what sampling is or are bias towards rap music to begin with. Almost every musician i know, ranging from Rock & Metal, to jazz players and classical players all respect this music genre. Plus i bet the average replyer here is bitching about theft , but probably hasn't bought an album in years. Btw, excuse the grammar, English is not my native language, i'm Dutch.

      I haven't noticed any glaring grammar issues (but then, I'm not an English major) so don't worry. As I told you elsewhere, I just don't listen to rap all that often because the few examples i'v witnessed have been shallow, self-centered, or profane. the genre has sort of been blocked from me by what everyone else around me listens to. however, I have mad respect for the poetry surrounding it. That's why I view VI as a separate case, because even after he was called out, he tried to deny and sidestep, even claiming it was a separate baseline at one point, which then makes the hiphop genre look bad. I can understand people not understanding the rules surrounding sampling, but at least own up to it once you do. That's my biggest issue here.

The issue back when it came out wasn't exactly the sample nor an issue of permission but the fact that Vanilla Ice didn't provide credit in any form and when pressed on it initially by a journalist who didn't understand sampling, Vanilla Ice lied and claimed it as his own riff rather than explaining to the journalist what a sample was. Even the threatened lawsuit wasn't about 'stealing' nor monetary compensation for the usage of the riff, but rather the failure to provide credit. It was about principles that have been widely recognized in the music industry, an industry where sampling was common across genres. It wasn't about theft.

      It's two tones on a four-beat bar, over and over again. Vanilla Ice added more instrumental context to the song than Bowie and Mercury did.

    He didn't just use the main bass line, he also used the piano, hand claps & finger clicks. When I say used I mean stole. Should have just asked permission and given credit not deny he stole it and then attempting to pass it off as his own work.

    Jokes on him, Mercury and Bowie are remembered as legends who single handily revolutionized not only the rock and roll genre of music, but the entire landscape of music itself, and Vanilla Ice is remembered as that one guy who made one of the worst and most forgettable songs ever while also plagiarizing people who earned their place in the music world and somehow went platinum despite many other people in the 90s deserving more of that achievement than him.

    Correction, the reason why we don't come for other groups sampling is bc
    1. They just don't. They don't.
    2. Its not a literally copy. Analogy: I can take notes from a nonfunctional book for a report, but I credit that book and I ALSO MODIFY IT TO MY OWN WORDS. he just took the whole backtrack and rapped to the song. Its plagerism if I take the karaoke version of, for example, we are the champions and just rapped random lyrics!!!
