Family plot doesn't mean sell to stranger
_"...With no one currently offering to pay,"_ Really? I'd get the most vicious bloodthirsty lawyer to make the cemetery itself pay up for the mistake. Someone's paperwork screwup ended up screwing 2 families, so a court order telling the cemetery to make the swap at their own cost should work. Resistance? Expect a further lawsuit for severe emotional distress, then.
Even if you have a court willing to issue an order, I believe you still need the other person family to approve it. So basically the other family could say no and you might not be able to do anything.
Either they never came to visit. Or they need to dig up that person if she has bill of sale
Legally, the Cemetery might not be allowed to dig the person up without approval from their family and possibly legal paperwork issued by a court that gives the cemetery the ability to do so. Not saying it's fair but there is a lot of red tape that needs to be handled before they consider digging the person up. Same would also go with moving the family member to the plot.
Someone got a free burial.
Otherwise, whoever buried this person would not have buried their loved one there.

The main issue is religious cemeteries in New York State aren't regulated by the Division of Cemeteries so, Jewish, Catholic, Muslim cemeteries can do as they please, although the cemetery did act reckless and caused mental anguish so with a really good lawyer you could get the cemetery to pay for the relocation of your mother.
Sounds like the society scammed this family, utterly disgusting and the county officials should make a law that these private societies have to give the cemeteries all records of burials and deeded proof.
They did not notice because they never visited in last year
