- According to Chevron deference, which was overturned by the Supreme Court yesterday, the ATF and all government bureaucratic agencies were the actual experts and whatever field they operated in.
The ATF are NOT subject matter experts. They are not the Authority.

It can legitimately be argued that if this ruling had come out earlier, and the effects of the ruling then had enough time to filter through the ATF, Bryan Malinowski would very likely be alive today.

Lots of people seem to be forgetting about the rule of lenity. With the Chevron deference gone, rule of lenity should be coming into play in these scenarios.
Chevron deference eliminated what was supposed to be the defining characteristic of the Judiciary: Its independence. Thank God it is now gone, so that the Court, and not the Agency, can correct Agency errors.
