Hello po. Medyo nalito lang po ako sa differences ng holistic and dominancy test kasi po sa libro na nabasa ko po ang dominancy test only relies on the visual comparisons between the two marks while sa holistic daw po it relies not only on the visual but also on the aural and connotative comparisons and overall impressions. And kabaliktaran po yung nabasa niyo. Thank you!
Easiest nalang is holistic = whole, dominancy = dominant (most obvious/standout/recognizable) features.

Hi attorney, medyo nakakalito yung first of use and first to register. As per IPOPHL po kasi, first to register daw po ang sinusunod pero may explanation kayo na may talo pa din yung unang nagregister if di naman ginamit. what if po, nauna ako to use in commerce pero di pa nkaregister? for example po, nagstart ako mgbenta ng product with my created logo/name (trademark) today, then, may magbenta din ng similar product with same logo/name january next year and register a trademark next month february. ako po ba ang talo sa ganung sitwasyon kahit mas nauna ako gumamit nung supposedly trademark? or may laban din ako if makaprovide ako ng proof of prior use of the trademark?
Hello, depende kasi yan, case to case basis, meaning it depends on the facts of the situation. While as a general rule, it is the first to register that has the better right, there have been instances where the first to use was given the right because they were able to prove that they were the true and actual inventor. But in order to avoid confusion, it is best to follow the first to register rule.

Hi atty., may nauna pong magregister ng trademark kaysa sa amin, but the actual use in trade and commerce is nauna po kami. Yung classifications na inapply sa IPO is different din. Considered as infringement po ba yun?

I don't know what you're referring to either. There is no Philippine law which specifically deals with unfair competition in relation to pornography only. So Either you will have to provide more context or the most I can say is just apply the principles of unfair competition under the intellectual property code.

mr Lee and Lee not confusing because people buying are knowledgable about brands they are after. thats kinda sad, people buy jeans as gifts too without knowledge of what brands are similarly deceptive to which. also its sad that their study showed that buyers are most likely knowledgable of the brands. means if your business is clothing that are within the price range of those jeans then you really arent protected at all. feel bad for Lee, people probably can just put up "the Lee" as their brandname
That was the ruling at the time. If a similar case is filed in the future, depending on the skill of argumentation of the lawyer, the ruling may change.
