Tapos, sa preference and concurrence of credits of movable property na nasa civil code, wala nang order of preferred creditors, at ang sinusunod yung date of registration ng personal property. Ang Pledge at Chattel Mortgage mula sa civil code ay tinanggal ng RA 11057. Tapos binago ang duty ng Register of Deeds at inamend ang PD 1529. Hula ko lang siguro.

I submit that the stipulation is not valid. In any mortgage, the mortgagor is still the absolute owner of the property, and as such, retains all the rights & attributes of ownership (such as the right to enjoy, dispose, destroy, etc). Being such owner, he should be able to encumber the property as he sees fit. (See Litonjua v L&R Corp, GR No 130722, 9 Dec 1999, citing Tambunting V Rehabilitation Finance). If this is for an online quiz/homework, this is not cool. Please do your study on your own. Google is your friend. Codals and Commentaries should be your BFFs. Hi atty! I'd like to clarify something po sana the effect of PPSA on the Rules on concurrence and preference of credit under the NCC. As how i understand it, the priority of security interests under the NCC does not in any way affect the RCPC under the NCC because the latter will only come into play when there has already been an insolvency proceeding, liquidation, or bankruptcy while the former (PPSA) specially the rules on priority of security interest will apply in determining who among the secured creditors of the same collateral has priority during the enforement proceedings? Is my understanding correct po? Or that PPSA really repealed Art. 2241 such that it is the priority provided by PPSA that will govern in case of liquidation proceedings and as regards the movavle properties of the debtor?
