      This is one of the best presented cases by a district attorneys office. They took their time, presenting all the facts in what you may think is a redundant manner, but it was brilliant in its construction. They presented facts in a way that built their case while covering every aspect of every argument the defense was going to present, they tore down all the defense arguments before the defense had the chance to present them. That is why the jury took such a very short time to deliberate and come to a unanimous decision. And by making sure in every way Chauvin wanted to remain silent, they also closed the book on any appeal his silence may have warranted.
      Of course in North Korea where you are guilty until you prove you are innocent the trials take less time, which system would you rather be in if you were ever charged with a crime? A swift trial and conviction where you get sentenced to 15 years imprisonment with hard labor for stealing a poster in a hotel? Or one that has to prove you guilty on a presumption of innocence with all evidence presented?

      You will very rarely have the defendant testify. Any defense attorney will tell you that. Its better to remain silent as they can control that aspect of the trial.

    Reminded me -
    Once a credit agency made a mistake and wrote that i am disputing my loan account (I was not!). I called the credit bureau and said i am not disputing anything. The rep said i need to submit a dispute that i am not disputing. Similarly, he is speaking that he isnt going to speak.

One discrepancy from what the defendant, a prosecution witness or witnesses may have said under oath can easily be turned into a possible perjury charge against the defendant and the other way around. The jury could see it as a discrepancy as a lie, & it could instead help one side or the other. Most defense lawyers advice against it. Many high profile acquitted defendants did not testify. OJ Simpson, George Zimmerman, Michael Jackson(2005 trial), Casey Anthony, & Robert Blake. Even though they were all acquitted, some are still considered guilty in the court of public opinion. Wayne Williams testified in his own trial and came across as very angry on the stand. The jury saw that as someone prone to violence. Even if he was losing his cool on the stand just from being falsely accused of killing those kids, it most likely helped led to his conviction.

      @@margaretthomason7824 that's a flat out lie. The problem with testifying is that you have no idea what is coming from the prosecution during cross examination. Trials themselves have very little to do with guilt or innocence and are more about which side is more convincing and can sell their argument better. There was absolutely no benefit to Chauvin testifying.

      Why should he have testified? What part of "anything you say can and WLL be used against you" do you not understand? There is nothing you can say that will help you in ANY court case. No attorney in their right mind would advise their client to testify, especially in a sensational case such as this one.
      For starters, It opens the client up to broad and unpredictable cross-examination, of which little if any can be objected to by the defense. Plus, anything you say can and will be used AGAINST you, not in your favor. The prosecutor will use anything that comes out of your mouth against you, even if there is one silly inconsistency. You will be branded a liar if you misspeak even a little, and open yourself up to perjury charges.
      Anything you tell the police, the court, etc. is always used against you. Even in the rare case that you say something that can help you, unless it's during direct examination, the prosecutor can object to it on grounds that it is hearsay. People need to make their top lips touch their bottom lips when in court or dealing with the police, innocent or not!

    I think this was a mistake that he may later regret. Yes, there's a good possibility of reasonable doubt from some of the defense witnesses. However, I am sure that everyone on that jury really just wanted to hear from Chauvin over any other expert witness. They wanted to know his training, his personality, how much he valued serving his city for the past 19 years. What was in his mind for that 20 minutes (as well as the last 9) and whether at the very least he feels bad over what ultimately happened. I am sure some of that would require some level of admission of guilt...But it wouldn't have necessarily hurt him at the end. I don't think he was worried about taking the stand and speaking his side...I believe he was worried that this side would fall apart under cross. I still think he should have taken that chance because the evidence is more against him than not. Only time will tell now...

      I’m a law student. It’s semantics. The 5th Amendment can be called either a right or privilege. The underlying right protected by the 5th amendment is the right to not testify against oneself/be silent in a criminal action. It is both a US citizen’s right and therefore his/her privilege (as the Constitution is not available in many places of the world) to invoke the Constitution and its amendments to secure the aforementioned rights. So there are semantical differences between saying “my fifth amendment right” vs “fifth amendment privilege” but neither is incorrect to say.

    Fifth Amendment is protection against self incrimination, in other words you don't testify because you know you are guilty and protecting yourself from giving answers in cross examination that would confirm your guilt from your own words. ( I paraphrased a bit) 😁
