One day i parked my car on society's open space and generally those dont have their own car parking, they parked their vehicle there.That one day when i parked my car on open space society took objection and told me to park on my own space,But my question is ,The open space is not anyones private space,if people who dont have their car parking and they can park their vehicle on open space then why it is restricted for other? Madam pls comment 1) our soc has furnished information to the authorites (Registrar office) while applying for deemed conveyance as 43 members, the list provided is duly stamped by the society with his signature, and forms a part of conveyance deed, now elections are to be conducted, the sec has made a provisional list of 39 members, he states that they have not contributed to the share capital so they are not members 2) Does this act of providing false information while obtaning conveyance amounts to breach of trust, can MC committee be prosecuted under crpc misrepresentation of facts.

You have forgotten the main topic if the builder has sold the parking there is not parking left for new owners and the owners whos paid for the parking thinks its their own space then what one can do?
मॅडम बहोत अच्छी जानकारी दि आपने... धन्यवाद मेरा सवाल ये है की अगर सोसायटी फॉर्म होनेसे पहले बिल्डरने पार्किंग alot की हो और सोसायटी बिल्डरके alot किये हुए पार्किंगके हिसाबसे चले तो क्या करना चाहीये. इसमे बिल्डरके आदमीने पैसे खाके उसके हिसाबसे नंबरींग करवाके ली है. अब जिनको पार्किंग मिली है वो छोडनेको तयार नही और सोसायटी byelaws के हिसाबसे चलनेवाली नही. सोसायटीके सब मॅनेजिंग कमिटी मेंबर्स के पार्किंग अपने-अपने फ्लॅट के नीचे और बाकी मेंबर्स कोई किधर तो कोई किधर....ये कैसा न्याय और कैसा सहकार....ये तो self-operative सोसायटी हुई ना। मैने उन्हे सब Byelaws AGM मे पढके सुनाये पर वो मानने को तयार नही। उनका ये केहना हे की तुम्हे हमारे नियम फॉलो करने है...सरकार के नही, अगर नही करोगे तो फ्लॅट बेचके चले जाओ। सोसायटीमे पार्किंग से वंचित बहोत सारे लोग हे पर कोई आगे आता नही जो आता हे उसे धमकी दि जाती हे। आप कृपा करके कुछ मार्गदर्शन करे.... ऐसी सोसायटी और बिल्डरके खिलाप मेंबर्स को क्या ACTION लेना चाहीये। धन्यवाद।

Can society charge guest parking charges to my married daughter who visits once in a month and stays for three days with me and right from childhood days she was staying in the same society .
in bye laws it is clearly mention that daughter son in law comes under family definition and hence they have to right to visit us and park their vehicle in guest parking for overnight stay and for which the society can't charge any parking charges...As the committee was not aware of this clause, they agreed and reversed the charges.

Hello Maam , I am in Pune . I purchased flat from Builder In PMRDA. I got possession and car parking . Our Building got completion certificate . Now builder formed working comittee, handover process is going on and Builder selling some extra space in society area as Parking. Every flat owner already alloted one parking . So Builder selling extra parking to some flat owner in cash. We observed that he erasing visitor car parking sign and alloting to someone. As majority of Commitee member having double parking so They are not raising concern and giving answer like society does not have authority until it is handover . My question is that total 150 flat are their and number visitor parking is 3, so their any law in Maharashtra State stating this is minimum number of visitor parking should be in society? and How we can stop this activity of selling open space marking as parking ? Please include rule number because we raised concern to society member and they are asking for laws and rule number ... Waiting for your response
Some parkings are allotted by builder and owner claim their ownership. Committee also agrees .Committee is charging amt. from only those members. to whom bulder has not allotted by builder.

Possession without OC is illegal and u may land up paying commercial rate water charges and electricity charges

In our apartment there are total 8 residential flats,3 commercial shop.shop owners using toilet inside society they are say it is in our agreement our property.not ready to pay any maintenance charges.the light connection,water connection,are from our society meter.we are charging only 100rs to each shop.they are saying to clean our toilet to us with extra 20rs means 360Rs total.also they enclosed space infront of shop by shed.they are saying it is our property.still society not formed 5 flat sold 3 vacant.what can we do for this to get maintenance from shop owners.they are saying to cut water supply and electricity for toilet.can we lock the society gate by cutting water supply and electricity.drainage line belong to whom society ?what is correct provision for this under laws as we cannot lock the toilet.can builders do such thing to give ownership of toilet to shop owners which are inside promises of gate.kindly guide properly.still no society is formed.

You have forgotten the main topic if the builder has sold the parking there is not parking left for new owners and the owners whos paid for the parking thinks its their own space then what one can do?
This rules are applicable for paid parking space.

मेरा सवाल ये है की अगर सोसायटी फॉर्म होनेसे पहले बिल्डरने पार्किंग alot की हो और सोसायटी बिल्डरके alot किये हुए पार्किंगके हिसाबसे चले तो क्या करना चाहीये. इसमे बिल्डरके आदमीने पैसे खाके उसके हिसाबसे नंबरींग करवाके ली है. अब जिनको पार्किंग मिली है वो छोडनेको तयार नही और सोसायटी byelaws के हिसाबसे चलनेवाली नही.
सोसायटीके सब मॅनेजिंग कमिटी मेंबर्स के पार्किंग अपने-अपने फ्लॅट के नीचे और बाकी मेंबर्स कोई किधर तो कोई किधर....ये कैसा न्याय और कैसा सहकार....ये तो self-operative सोसायटी हुई ना।
मैने उन्हे सब Byelaws AGM मे पढके सुनाये पर वो मानने को तयार नही। उनका ये केहना हे की तुम्हे हमारे नियम फॉलो करने है...सरकार के नही, अगर नही करोगे तो फ्लॅट बेचके चले जाओ।
सोसायटीमे पार्किंग से वंचित बहोत सारे लोग हे पर कोई आगे आता नही जो आता हे उसे धमकी दि जाती हे।
आप कृपा करके कुछ मार्गदर्शन करे.... ऐसी सोसायटी और बिल्डरके खिलाप मेंबर्स को क्या ACTION लेना चाहीये।

in bye laws it is clearly mention that daughter son in law comes under family definition and hence they have to right to visit us and park their vehicle in guest parking for overnight stay and for which the society can't charge any parking charges...As the committee was not aware of this clause, they agreed and reversed the charges.

Hello Maam , I am in Pune . I purchased flat from Builder In PMRDA. I got possession and car parking . Our Building got completion certificate . Now builder formed working comittee, handover process is going on and Builder selling some extra space in society area as Parking. Every flat owner already alloted one parking . So Builder selling extra parking to some flat owner in cash. We observed that he erasing visitor car parking sign and alloting to someone. As majority of Commitee member having double parking so They are not raising concern and giving answer like society does not have authority until it is handover . My question is that total 150 flat are their and number visitor parking is 3, so their any law in Maharashtra State stating this is minimum number of visitor parking should be in society? and How we can stop this activity of selling open space marking as parking ? Please include rule number because we raised concern to society member and they are asking for laws and rule number ... Waiting for your response
Some parkings are allotted by builder and owner claim their ownership. Committee also agrees .Committee is charging amt. from only those members. to whom bulder has not allotted by builder.
