    I've been on SSI for 7yrs. I've since then been diagnosed with austioathritis and I have had 2 surgeries and need to go in now again for the 3rd on my spine. I also had a total hip replacement because of the austioathritis. My doctor and surgeon said I won't get better and to learn to try and live with it. I also have gotten worse on the reasons I was approved for SSI in the 1st place. My question is, can I get SSDI and do I qualify for it?

    If I have 40 credits but my history work is part time Iam eligible for SSDI

    I have enough work yrs and credits for ssdi but will I be able to win my claim with severe sleep apnea(43 times/hr stop breathn or wake up) with degenerative disc disease and spondolitis along with diagnosed severe depression currently treatn with meds and counseling? Thanks you👍🤷🏻‍♂️

      You don't say how old you are (better if age 55+) but you will likely have an uphill battle. For whatever reason, sleep apnea does not seem to move the meter at SSA. In my experience depression has to be extremely severe (i.e., in patient hospitalizations, suicide attempts, multiple failed medication trials are what I look for) and back pain needs to be associated with disc herniations or nerve issues.

      Age does play a factor,but again,if your attorney doesn't do their part and bring the age part up to a judge as a credibility to your case,you can still get denied,I'm 56 with a severe desease and so far I've been denied twice.

    Question: why social security ask me if i take non-prescription medication? Its on the SSA-454-BK

      Presumably you take meds to treat a symptom of some medical condition. For example if you have chronic migraines but can't afford prescription meds, evidence that you take Excedrin Migraine would be relevant as opposed to taking no meds at all. Or you may have a condition for which you use non-prescription meds to control. It is all part of the big picture.

    Please do a video explaining that once you begin receiving social security retirement check you are disqualified from SSDI.

    Great video Jonathan.
    Here's a question. "Can one's appearance negatively affect one's disability hearing? For instance, if your client has the outward appearance of being muscular and strong. Would the judge take his/her muscular appearance into account?

      Judges are not supposed to use a claimant's appearance in making a decision. Currently most hearings are held by phone so if you think you look to healthy, choose the phone option as opposed to video or in person.

      I believe you can get Social Security retirement if you have enough credits.

      What do you mean when you say you "signed up." If you applied 3+ years ago and have not heard anything, I am guessing that your claim was denied and you did not get the notice. You need to call SSA to find out what is going on.

    What if: you worked 30 years, then were found disabled. You were on SSDI for 6 years, then found no longer disabled. You worked for 2 years then got much worse and applied for disability again. Now, you don't have enough credits, right? Because you were disabled 6 of the last 10 years.

      Download your "MySocialSecurity" statement to see what it says. You may be in the "extended period of disability" and thus still qualify.
