      Not to mention legally the picture ( adding your own cartridge) has the person downloading another's copy of the game ( not backing up their own ) which is illegal. Learned that when studying about backing up cd's.

      Just looked at the kickstarter and noticed this line "Our support is unrivaled, we can even remotely connect to your machine and fix it over the internet." Also they say they are not affiliated with companies such as Netflix and such but have the apps on their system (sounds like a licensing issue that many companies will take notice of if the machine does become a reality).
      Netflix operator: what seems to be the problem
      Customer: My video keeps freezing
      Netflix operator: What system are you using?
      Customer: Dreamcade Replay.
      Netflix operator: I don't seem to have that system in my database
      Then many angry customers later and a lawsuit if filed with many angry companies lol.

    I miss the good old days when consoles were sold off shelves without the need to fund them first out of your own pocket, or having to pay double the retail value from scalpers.

    This is baffling, also, hi lawyer here, "working with" Atari does not mean you have an agreement (read contract with) or permission (licensing) from Atari to even have the games on your system, much less to use their name and games to promote your product. His response that this must be a "mistake" is hilarious.

    Yet another shady emulator product done wrong. People get all up in arms over illegal rom selling but no one ever talks about the sale of emulators, just because an emulator is open source it doesn't mean it is legal to sell it. Some emulators allow it but not all do.

      It depends on the actual license the emulator itself is released under. Like I said, some emulators allow it such as Mame while others do not such as the Genesis emulator Genesis GX. It is a case by case thing.

      I thought I remember reading somewhere that the Retron 5 may be getting into problems due to using SNES 9x code without permission or something of that sort.. would this not be a similar situation?

      Snes9x is another emulator that does not allow its use in commercial products. Now of course there is always the possibility of a licensing deal between the devs and someone selling it. I know the recently announced Retron 77 is going to use a version of Stella under license but it is not the latest version of the emulator.

    These guys STILL don't get it. They are down in these comments insulting people. Hey guys if you got a 100 grand from that TV show maybe you should use some of it to hire a lawyer before going ahead with attempting to sell a product that MAY land you in some deep shit legally.
    I get that you've googled around and decided to use some mental jujitsu to pretend you are totally in the clear legally but that's not the same as ACTUALLY being in clear in the eyes of the law. Just sit down for 5 minutes with a copyright lawyer for a consultation, it shouldn't take much longer then that.
    Also not a smart business move to attack people on a youtube channel who's core audience are probably the same people who might be interested in your product. So maybe use a chunk of that 100 grand to hire a PR person as well.

    This reminds me of the first Rifftrax Kickstarter which was supposed to be for a live riff of Twilight. I think I might have tweeted at them how unless they had a deal in place to start with it's a bit dishonest to run a campaign like this. I don't even recall their FAQ, at least initially, addressing such concerns. They ultimately used the funds to licence a live riff of Starship Troopers but yeah, that whole thing stunk of counting chickens before they hatched. I'll cut them a bit of slack since it was their first time doing something like that and I assume they've learned from it. The way I see it you obviously need to be in contact with the rights-holder beforehand, negotiate a price and build the Kickstarter around that. Better yet, have a contract lined up to guarantee that if and when the necessary funds are obtained you will be able to buy the rights at the agreed upon price.

    The aesthetic is kind of weird... why give it an NES-inspired controller if it looks like a 2600? I know that the 2600 controller only has one button and no d-pad, so maybe the question is: why does it look like a 2600? They should have at least matched the color schemes or given the controller a different faceplate.

    So it seems that the new search they advertise on the kickstarter is just a Google search. They will also include streaming from the internet arcade archive site. In other words they are selling people the ability to search Google and use an archival site..For some reason I can just see these being website links of some sort...

    I'm gonnah flat out say this right now for the record :" The ONLY "emulation" system that's worth waiting for ( which isn't emulation it's FPGA) is going to be Kevtris' upcoming Zimba 3000 and the only reason why is because Kevtris already HAS a PROVEN FPGA device on the market : The Analogue NT Mini.
    Unlike all the scumbags we've seen in the past few years trying to sell us snake oil , Kevtris is actually honest and has been a BIG help to the retrogame community with his creation of the CopyNES.

    I wonder if in small places that get a lot of foot traffic if something like this in a public place like a real arcade could work. Focus on low energy draw and have a digital store with the rights owners on all bits of software getting a cut and of course their blessings.
    I wonder if the trade offs would or would not make them profitable again. I know the arcade machines at one of my local cinemas just left. It was the last place that had any that I knew of.

    I thin k the next peron to be making a video about the Dreamcade Replay will be Stop Drop & Retro!
    They'd have been embarrassed even on Dragon's Den (the UK version of Shark Tank) in fact I'd have imagined the Dragons getting quite heated...
    ...in fact, even if the UK had their own version of Funderdome (which sounds ridiculous, by the way) they'd very likely be embarrassed, especially if the audeince got to answer one simple question...

      To be fair, since this thing runs Windows 10 and has Steam support, they could still say "tens of thousands" and potentially be underselling it. That's just being fair, mind you, I don't support this thing even a little bit, because they're blatantly encouraging their customers to pirate copyrighted software right there on the Kickstarter page.

    Whats is pointless about this device that people who know what they are doing can build a Retro Pi based emulation device and be able to play games from many console generations just like this device can do and they can do it for their friends as well for a fraction of what this thing costs. Granted this think could probably emulate systems that the Raspberry Pi can't do such as PS2. Plus this thing could emulate N64 games better than the Pi could but I have read that some users were able to get the Pi to play N64 games with minimal lag. Or users could just use their gaming Laptop they just purchased and they would have an emulation device all its needed is an HDMI cable and some USB controllers and there you go.

    This stuff should never be for sale. Someone wants to find an emulator online, find roms, that's on them, especially if they are stealing roms they don't own which is theft. It shouldn't be made easier to do for free or sold for money.

    I actually watched this episode and was laughing at how stupid the audience was. Then again if they weren't in the know about roms and hacks and copyright infringement and how many different system and software designers you would have to go through and pay I would be excited for this too. But I am glad you covered this topic, I was wondering what your thoughts were and they were right along with mine.

    I want one, just scared with the price drop that it may be a cash grab. Cause isn't it true that after a project is funded it's up to you and them and you have no back up from Kickstarter?     1:28 Do people just not understand the legality of doing that? Or they "understand," they just *want to do it* and somehow magically make it legit for no other reason than you can *"freely"* download ROMs (the "wishing it so doesn't make it so" line of thought)? Then they go on to sell something commercially that does this. Can people be that thick? I guess so.
    Legally, this is no different than that "Nintendo Classic" USB drive on ebay.

    I'm no expert in emulation or hardware, but why do we need a dedicated emulation box? Can't you emulate any retro system with a set top android box and a bluetooth controller? And why does it need 4 gig of ram and those other specs? Raspberry Pi 3 with 1gb of ram can apparently emulate PS1 fine.
    I can maybe understand getting excited in a handheld emulation system with physical controls, but a TV box?

      Ya I'm really not sure why so many of these exist. So many cheaper and simpler ways to emulate. Most gamers are under 40 and most are internet savvy enough to google how this shit works.

      It can be done very easily, but the thing is most people don't know how to or don''t want to be bothered to do it themselves, so they rather pay for something that brings it all to them without any kind of work on their part. IMO, there's no reason to pay a lot of money on something like this, especially when you can do it yourself for way cheaper and customize it the way you want it. Plus there are a ton of guides and even kits with everything you need included (Well, except for Emulators and Roms...but that's completely understandable and easy enough to get on your own).

      I have been using different emulators on PC for years and also use the RetroPie distribution on a Raspberry Pi 2 for emulation, and in my experience it's not always that easy to do by yourself.
      For example the first image of RetroPie that I used had default settings that slowed down the SNES emulation to the point that games were unplayable. It took me some time to figure out I just had to change the output resolution of the emulator to fix that.
      With a dedicated box you are - at least in theory - paying for testing and configuration as much if not more than for the actual hardware.

    Personally thats the type of consol i want. I am bad with PCs and downloading roms and putting them on retro pies or whatever. I want the simplicity of this machine... And i don't give a shit about the legal aspect, you think they gonna arrest you for that? lol Those are old games, nobody care. They don't even go after peoples that download brand new movies...

    Please stop buying these re-packaged RaspberryPi/RetroPie consoles. Just do yourself a favor and buy a Pi kit on Amazon, and follow any of the NUMEROUS well done FAQ's that are found online on how to set it up. It will be cheaper, work better, and you don't have to worry about getting ripped off on some shoddy ass product that will never deliver.

    To me unless you are buying it from Nintendos eshop or on steam etc. it CAN be ok lest say I am interested in an expensive game I could emulate it on my pc and see if I like it or not. If I do I get rid of the rom and buy the game either physically or digitally

      He has some kind of condition (illness) that stems from the nerves in his stomach region. The heating-pad, which you said looks like a blanket, relieves a lot of the pain. From what I understand it's a painful condition.

      He seems to be doing a lot better than he was. Ian had missed months worth of the CUPodcast, and when he was able to show up he looked pretty rough and didn't stay for the entire podcast. I, too, hope he is fully recovered soon.

    Looks like this vid led to a pretty ugly comment section in response to Dreamarcade's post. I don't know if it was appropriate for them to call pats/ians integrity into question, but it's kind of silly to bust out the pitchforks when neither of them are legal experts. All they know are the basics of what aspects of emulation are illegal, and they know little to nothing about how this machine actually works. For all we know, this could just be a glorified Google in a box searching for roms from other hosts. If that's the case, it really makes it no different from any other computer. Is it advertised in a manner that basically promotes an illegal activity? That part is where things get dubious at best. But there's no gray area when it comes to the law. Until we know firmly how the machine works and someone qualified can comment, there should be a healthy amount of skepticism at best, and both pat and ian tend to go overboard when it comes to almost bashing people in these types of situations. It doesn't even matter if this gets shutdown later. Being able to say "we told you so" when you were just rattling off concerns without much legal basis or knowledge of the inner workings of the machine is just a practice of guesswork that may turn out justified.

    I understand the ethics behind this. I understand the purists who thrive to collect physical media. Then you have another segment of gamers who support and enjoy emulation. I think this segment of gamers isn't apposed to using ROM sets they do not own. I'd suspect many people who purchase this know where or how to obtain ROM sets. They probably aren't all too concerned with the ethics. Just my two cents

      Hylian Mario it's a raspberry pi 3, some games have some bad lag, and some lag every time in one place (smash 64 especially, during the intro only) but it's a pi3 with the heatsinks and the cabinet it's in with my modern systems has fans so everything stays cool.

    i actually wish atgames ripped off an emulator from any where but inhouse. the sound is jacked. could they not hire someone that used to work at digital eclipse? crap crap crap. the dreamcade might actually play well,maybe, but at least you can say it will probably be 100% better than the atgames crap. of course the dreamcade will have some shady elements. i would bet money it will. im not buying it becaus of the price.

      Yeah because the difference between the two is Denny's is actually a large profitable company which owns a chain of 24 hour diners thus it's it's "free advertisement" ( which Atari got paid for!) for Atari whom had their Atari Classics collection on console and steam as well as the @tGames Flashback consoles being licensed from Atari.
      It was all around profit and Denny's paid for the creation of mobile apps, for even more brand awareness.
      This crappy emulator project ISN'T in fact they are unethically cutting into Atari's ( really Infogrammes) market.
      I am no massive fan of "Modern day Atari" and I am actually a proponent for emulation as it's important game data archival.
      But from a business ethics and legal point of view I kinda HAVE to defend "Atari" as the Dreamcade Replay team is acting REALLY scummy and doing all sorts of Illegal actions.
      They aren't just threatening Atari and other companies , they are SERIOUSLY jeopardizing the Emulation scene.

    Who gives a shit. First and foremost, I purchase EVERY form of media I own. Every song and album on my phone is purchased from I tunes and every game I own is legit and played on legit consoles, I've never played any emulated anything, however, I could give a rats ass where these folks are downloading their games from.

    I'm so glad I got the Retro Freak Where you actually have to own an actual copy of a Sega or Nintendo Game. Cyber Gadget does not encourage people to download Roms on a random website what the f? They need to do what AtGames does with the Sega Games thats the only way it will work or they should sell this thing in an underground shady market where only people who aren't snitches will buy it from them

    Pat tbf whats the difference between this and a pc that you can play emulated games on?
    Tbf they aren't selling the console with the roms already on... I for one would like the opportunity to play emulated games on something other than a PC

      Daxel101 I completely agree. I hate the ease of messing up shit when I start installing and trying to run new programs. Then trying to add roms and there's always random ones that won't run for some reason! Such a pain! I see this product as an "idea". No they most likely didn't create the emulators, but they did put them into a platform that makes it easier for the technically "not so" proficient. I own a GPD android based portable. It comes with some emulators preinstalled, but I had to download/install a majority of the emulators I wanted on it. And I had one issue after another getting them to run properly! Then to top it all off, another application auto updated one day and all of a sudden half of my emulators quit functioning right!!! Very frustrating for a guy like me who hasn't really kept up with general computing (for lack of a better term) since the iPad came out! So, if someone can simplify the process and offer me a console that's already set up and all I have to do is get roms and drop them in, it sounds like a item I'd like.
      Now the company advertising that this console helps to seek illegal copies of roms is a very bad idea- I agree. I could see how that's asking for legal problems! But I love the idea of a console that is set up and with a nice themed menu. I have a raspberry pi and I've seen all the great themes and front end set ups, but I'm too paranoid to try to install one. I've messed up other set ups trying to add/install stuff that should be simple and wouldn't know how to fix it if I did screw it up! So until I have the time to watch quite a bit of UA-cam tutorials until I feel confident I have a grip on what and how to do these things, I'm dealing with what came preinstalled from the place from where I bought it! That too is kind of a bummer! Because I really want to add more than the NES, SNES, GENESIS, MASTER SYSTEM, PC and 2600!

      The only thing I can think of is the difference is that a PC's primary use is not emulation, but can be if the user decides to make it so. It becomes another story when you start selling a machine that's primary purpose is emulation.

      Exactly. Plus, even if you sell a machine designed specifically for emulation, it can still be considered a grey area if you're not promoting it as such. Look at all those Chinese emulation handhelds: you can even find some of those in reputable retailers (I see them in Walgreens all the time), and they get away with it because they don't load them up with roms or tell people where they can find them. They might hint that you can use them for emulation, but they never explicitly say it.

    Not to defend these rom pirates, but I would assume that their picture rom app is just an extension of their search, like searching a picture on Google. I think it would work the same way, and instead of searching by text by photo, and just stealing the roms in the same sleezy less than legal way.

    I am gonna take sides with Dreamcade with this. Any idiot can easily download full rom sets for any retro system from a number of webpages, torrents, ftp servers, newsgroups, facebook groups, drop box accounts, and more... If it's so illegal, then why are those sources still up? So what if they made an interface that makes it easy to do so? They aren't supplying the roms on the system, you still need to download them. I think you guys just like talking shit and need to chill out.
    Don't like it, don't buy it. I am cool with a Pi setup myself.

      Gotta agree with you 100% I love you pat but this is stupid you are virtue signaling to the point of being quite silly. Also why would you be against dreamcade coming onto the show and sharing their point of view? If they are so wrong they will expose themselves and their product. I have been using emulators for years and have roms that there is NO WAY I could afford at this time. I have a large library of games and an even larger library of roms no one is going to be arrested or get into trouble for using this system. If dreamcade messes up it's on them, not the consumer.

    I dont have a problem with this, search engines arnt illegal and people are going to get roms anyway, probably via google.
    Using emulators you dont have the rights for on a commercial product is poor form, but as a consumer I couldnt care less if it means one less step to install said emulator, which i was going to do anyway.
    This machine isnt for me, i would rather cobble together my own box, but for people who dont want to faff about on rom sites etc it fills a market niche.
    As for downloading roms rather than buying original carts, fucked if im going to buy carts whose prices have gone through the roof thanks to `collectors`, some of which dont even open the fucking package and play them.

It's rare when a person or a company being the topic of negative discussion wants to come on the show to dispute those negative assertions. I would like Pat to defend his position. I think it's the fair thing to do. This is a great opportunity to see another point of view.

      Pat and Ian can't be the only people skeptical of this so why don't they post any of this stuff on their kickstarter or website? All they have to do is make a post saying they actually acquired the licenses to the games, reveal which emulators they are using and if they got the rights to use those emulators. Why is the podcast the only place they are willing to address these issues?

      This topic is interesting because it covers many areas of legality and the best way I can explain how I think about this topic is by linking 3 websites. Below I linked Nintendo’s sites covering Intellectual property, Retron5 Software licensing and the University of Delaware intellectual property in the digital age. The Dreamcade Replay emulation console is a Kickstarter project, not a commercial product which is a contract between a backer and creator. Take a look at another project such as the Retro Engine Sigma funded on Indiegogo is similar to what it offers and it's successful as it has already started pushing out its units to their backers. Both of these systems use open source front -ends and emulators with possible modifications to fit the specs of the system. A lot of what I hear is the illegal sale of open source non-commercial licensed emulators and front end like Retro-arch. While true it is illegal to sell emulators that fall under non-commercial licenses, but when the company openly states that they are only building and selling the product and providing the front end and emulators for free then that is different. Just visit the Retro Engine and Retron5 websites which provide or will provide the source codes to their projects. In most cases, in legal terms, this is a non-issue. This is why we have to look at Nintendo. Nintendo is one of the few companies that continually brings back their IPs to new systems, for example, Mario and the series that follows the name. Nintendo has put forward legal arguments in the past and to this day that emulation and ROMs hurt their potential profits and security of their intellectual property. With that said it becomes hard for companies that leave their IPs dormant or dead to fight copy right infringement if no profit loss are proven. In contrast to this “EMULATORS DO NOT VIOLATE LAWS, ROMs VIOLATE COPY RIGHT LAWS”. As I see it people getting flustered over what front-end, emulator or what ROMs are being backed in is a waste of time. The creator just has to make his stuff open source and problem solved people will either like it or not. As for the games, the same can be said because the creator will just purchase anything they can get for a reasonable price. As for the app that looks for ROMs many parallel arguments can be made to make this a useless argument. Just use Guns. People purchase and use guns to protect themselves and their property, but the argument can be made that there are others that use guns to kill, murder and steal; so what’s the point? Anyway, I like Pat and Ian and I would like them to invite the creators of the DreamCade and have each other’s views challenged.

      How many games did you actually have licensed, with a contract, already signed, upon which the ink was already dry, when you appeared on Funderdome?
      I'll assume that from the legal issue over your list of games that the answer is "none" meaning that your list was misleading.
      How can I trust you when you already misled your backers?

      That's how you get invited onto a podcast. Insult the hosts' integrity. And make no mistake, you need to be invited. You don't just get to announce that you're willing to be on someone else's show and then they have to give you a platform. That's not how it works. And posting this video isn't disingenuous in any way, shape or form. They mentioned that you offered to come on the show last time, and they said no. Then they went on to report the facts as they saw them.
      I don't know all of the facts, so I can't speak to every point raised by Pat and Ian in the video, but the most important one (to me, anyway) is definitely valid: you're promoting software piracy.
      In your Kickstarter intro video, you encourage people to play games on what is essentially a Windows PC for which there is currently no legal route to do so. It's a legal grey area if you dump a ROM yourself from a physical cartridge that you own, and then use an emulator to play that. It's flat-out illegal to download a ROM of a copyrighted game from the Internet, even if you own the original cartridge. You mention on the Kickstarter that your safe search feature allows people to download games from the Internet Archive... and there's a lot of copyrighted games on the Internet Archive. You even go so far as to say outright that people can play Pokémon on their Replay. Which they can... just not legally. You are using the potential to perform an illegal activity as a selling point for your product. That's like someone selling bolt cutters by saying, "Our bolt cutters will easily snip through those pesky lock chains that prevent you from stealing your neighbors' bikes!" Of course it's true, and of course everybody knows you could do that, but it still wouldn't fly in court.
      Take a look at some of the other ROM sites on the Internet. You might notice that Nintendo's games are conspicuously absent all of a sudden. You can't get Super Mario World or Donkey Kong Country on Emuparadise anymore. Guess why. Nintendo finally got around to telling them to stop distributing their copyrighted software or face legal action. You can still get Super Mario World and Donkey Kong Country on the Internet Archive, though. Whoops.
      Even if you believe that you're in the right to tell people to go ahead and download Pokémon ROMs from the Internet, do you have the resources to put up a legal battle against Nintendo?
