So just like you understand a religious person not wanting to make a gay wedding cake, you should understand people not wanting to get physical and intimate with doing the hair of a trans person. My barber shop in mishawaka, IN is a safe space for lgbtq. I have a Transcolor barberpole on my window at the shop. Any and everyone is welcome. I also work with people regarding how their hair plays a role in femine or masculine feeling they may have regarding how to help make them feel more comfortable in their own body

👨⚖️ ~ They did a TERRIBLE job explaining the situation. I’m watching this episode on Hulu right now to catch up on last weeks episodes. They skipped back-and-forth between the hair salon woman and the previous Supreme Court case multiple times, anybody who is not familiar with the situation probably walked away extremely confused.
And Whoopi, like she often has in the past, is extremely confident in her incorrect opinion. She saying people should not be allowed to discriminate but doesn’t actually know what the law is, and she saying they can discriminate by just lying and saying they’re booked up, etc.
Today is my 10th wedding anniversary to my husband. We are gay. I was 19 when we met, and 21 when we got married. I sit here looking at him and feel the love we have for each other. Our marriage wasn’t recognized until 2015 when SCOTUS allowed it to be legal. The frustration we all feel from these unfortunate discriminatory recent rulings is real. One thing he and I know, is that our love is real, powerful and beautiful. 🔻

The supreme court ruling was a mistake in my opinion, but it's very narrow and doesn't cover this lady refusing to cut trans people's hair. Joy's example is a good one:
You can't refuse to cut Donald Trump's hair because you disagree with his views. That's illegal as there's no free speech involved in cutting Donald Trump's hair. If however Trump wanted you to write "The election was stolen." in his hair, you could refuse him, because you are engaging in a free speech activity at that point and the Supreme court has ruled it's legal if you disagree with the message he wants cut in his hair.

Does this ruling also extend to Nazis? Can a nazi be compelled (if they're an artists) to conduct artistic work on behalf of BLM if they work in an artistic business? Because, if they are compelled, then this law really is just discrimination towards g*ys, if they aren't compelled either then it's more fair.
I would suggest both of your scenarios are legal. Businesses have the right to refuse service to anyone, but their reason for doing so cannot be based on their status as a federally protected class. Remember that a restaurant refused to let Obama hold a rally in his restaurant because the owner disagreed with Obama's statement 'that if you have a business, you didn't do that by yourself". The Obama campaign found another location. The same is legal for refusing to cut Trump's hair because you don't like him personally. it is only illegal if you refuse to cut all white males' hair. similarly, if a smelly black homeless person comes in for a cut, you can refuse him because he smells or looks bad. the client might think you are being racist but you can easily say that I cut black dudes' hair all the time...
@@lordoftheflies7024 i would just say that a Nazi web designer would be successfully sued for refusing to do a website for a bar mitzvah but not for refusing to design a website for a trans child documenting his/her transformation. Being Jewish is protected by federal anti-discrimination laws; being trans is not. Btw, I personally think that there is a difference in what is discrimination in that not believing in same-sex marriage and not liking gay people. Refusing to a business service all gay people is hate and should be illegal by federal law , not wanting to create an artistic expression that show that you agree with same sex marriage should be legal .
@@lordoftheflies7024 With Nazi artists, if they are creating a work of art that includes free speech advocating for Black lives Matter, the ruling allows that Nazi artist to refuse the BLM's request. The ruling does not allow a Nazi artist to refuse to make any art for BLM.
Now I think the ruling was an unwise one and also there was a lot of serious issues with the case in the first place including the plantiff didn't have standing. It is discrimination against gays but anyone can use the ruling. It's akin to the reason states can't secede from the US. The original reason was because of slavery. But since it was decided after the Civil War that the US is indivisible, no state has the option to secede anymore, the right is off the table, even for a more morally justifiable reason (like I don't know, a state opposes the illegal invasion of Iraq). A precedent has been set. Same with this court ruling, anyone can use the law even Nazis to not be compelled to say something they don't agree with regardless of the original reason the case was brought.

The issue with this particular case in my mind is that the person had no standing to bring it in the first place because it was a made up couple. That’s the part Alyssa is missing with this particular case.
I didn't. Sunny's rebuttal of her point was spot on. Homophobes are not a protected class. Donald Trump, the example given by Joy, is not a protected class. Sexual orientation is.
@@Adam-nw1vy it’s a protected class in the workplace and in other areas. Not when it comes to private business. In reality, a private business has much leniency when it comes to who they can discriminate against. But this case should never have been heard.
@@tjbes I disagree. Both federal and many state laws explicitly say you can’t discriminate against customers based on factors such as race, religion, sex or national origin. A private business may be private, but if they serve the public, they’re not exempt from following the law. Again, the comparison between "discriminating" against homophobes and discriminating against LGBTQ people is a really bad one.

We can't have boys who are "finding themselves and yet to determine their gender" being allowed to use female bathrooms, locker rooms, and dorm rooms. Once any sort of creative expression is involved, the cake maker can say "no" for any reason. You cannot force somebody to actively create something that goes against their values. That's a clear 1st Amendment violation

Cannot completely deny service to a targeted group of people if you are offering a public service in a location where infrastructure is taxpayer funded. Right to refuse service generally must be based on unruly customer behavior, etc. Not their religion, sexual orientation, or political party.

My only issue is that it needs to be clearly posted. I feel I have the right to walk into a business and assume under normal circumstances I will get service. If I find out later that I was wasting my time because the company didn't have clearly posted policies they should owe me compensation. They don't want to do that because then they would lose the straight allies money as well.

I think the issue that’s missing here is discrimination and promoting discrimination. You shouldn’t be able to discriminate or have to promote discrimination. In your example, the woman is discriminating against a group of people by refusing service simply based on who that person is, and not based on having to promote anything that is discriminatory nor denies anything other groups of people. But also, if a gay person (or any person) was asked to make a wedding website for a couple that involved the verbiage “anti-gay wedding” then that would be asking the person to create and promote active language of discrimination. But if a gay person was asked to just make a wedding website for a Christian couple that doesn’t include any discriminatory language or ideology, then that should be fine. If the gay couple was asking for a wedding site that discriminated against others, an “anti-Christian wedding” then sure. But a wedding website for 2 men doesn’t inherently discriminate against anyone, it doesn’t deny anything, it’s exclusionary to anyone. Just like a straight wedding website doesn’t inherently discriminate against anyone or is exclusive. The issue with not having to prove discrimination or promotion of as a reason for refusing service allows the opportunity to refuse service to anyone who you claim does not share your exact ideology. For instance, if your basis of service is fitting your personal view of religion (as this woman stated), this website designer could refuse anyone who does not share her specific set of ideology, period, even within sects of Christianity. For instance she could refuse to make a website for a Jewish wedding, and Catholic wedding (if she’s sat Babtist), a non-religious wedding, a wedding where someone has had premarital sex, a wedding involving a previously divorcee, a wedding where shellfish is served, the list goes on. It’s a slippery slope. That’s why having the basis of refusal line drawn on discrimination or promotion of discrimination makes sense and prevents it from becoming all encompassing. I hope that makes sense.
yes, that was the argument of the learned conservative members of the supreme court but, I'll admit that I don't have the education of these judges ...but ... as the dissenting members argued the difference is that sexual orientation is a protected class while being a bigot is not. So businesses can legally refuse you service for a bunch of random things i.e. not meeting a dress code, not having a certain G.P.A., not eating meat, not buying a Costco membership, even not agreeing with your political views - while controversial it would be perfectly legal for a business to say we only serve conservatives, Where the problem lies is when service is refused to a protected class -such as sexual orientation ... so gay bars can't say that straight folk are not allowed. I understand the Supreme Court judgment - they basically allotted more weight to the right of the "artist" (they considered the service provider more of an artist than a service provider) over the rights of the client. So Whoopi's argument is not inherently wrong (just a bit confusing) actually it is mostly correct. People on both sides I believe are confused by this ruling. I think that Alyssa is correct in saying that people on the left think this ruling is worse than it really is (at least as it currently stands) .... the biggest problem is the slippery slope demonstrated by the stylist who believes that she does not have to style a transgendered person's hair. She may in fact be correct ... then what's next? There are serious consequences to this ruling that we will see play out over the oncoming years.

I think when the panel wants to talk about LGBTQ+ issues they should probably have a guest panelist to keep them on track and educate, cause some of the comparisons and conflations they make on topics like this are a bit ignorant and problematic.

America got a problem. Humanity has fallen so far from how they ought to treat each other and it's sad. I am a black West indian and it saddens me that people are discriminated for just being who they are especially when you are just living your life not harming anyone.
When it comes to sexuality, the only thing i do not agree with is teaching sexuality to primary level children regardless to what type it is. Let children be and find themselves in their own time. They're too young to even understand the complexity of sexuality, even adults can't even answer themselves yet they see it fit to involve children and possibly corrupt or influence their young, impressionable mind.
Parents teach your kids to love self and others and be accepting to people who are different to you. Racism and prejudice are taught. You are not born that way. Parents, do a better job on what you instill in your kids who grow up to be the adults we everyday people have to face with.
I’d be afraid to do a trans persons hair. I had one that lived above me who was violent and completely insane. Also she was a big Donald Trump supporter, which was very bizarre, and scream profanities all night long off the balcony to the Guatemalans who lived downstairs. She was a bully and aggressive and made it quite unpleasant to want to come home. She would often attack me when I was coming in and carrying my groceries .
Any other trans people that I’ve come across in South Florida all seem really crazy and dangerous as well. I have never had this problem with gay men only with transgender. Maybe because trans women are just mean and nasty and hateful towards biological women?? Not sure what it is, but I’ve had the worst experiences with them. They are just so aggressive and nasty. 🐍
I'm torn because I'm gay and have been a wedding photographer for 12+ years. Many of the weddings I've been hired to photograph take place in very conservative churches, identical to the kind of church that traumatized me growing up, forced me to go to conversion therapy, and shunned me when conversion therapy didn't work. There have been times when I've had to hide panic attacks while on the clock because being in these environments is very triggering. Theoretically, this law says that I can now turn down conservative Evangelical clients, something that would otherwise be considered religious discrimination. Right?
If serving conservative Evangelicals is against your religious beliefs the Supreme Court says you can legally refuse service.
Oh god, please have a little more intelligence. You shouldn’t judge a person based on any from of discrimination, not just the ones you don’t like. If you had a conservative evangelical come to you and wanted to create an anti gay website, you would have the right to say no because it is discrimination. You don’t need this law, which has been created to allow religions to discriminate against anyone that like, because they are religious. This is the part that is wrong. Change the word gay to black, or gay to women and then see if it makes sense that people should be allowed to say no to someone based on their religion. In South Africa, you cannot discriminate based on sexual orientation, race, gender, religion, gender etc. Maybe the land of the free should take a page out of their constitution.

This is the viewpoint people had during the civil rights movement when white businesses did not want to serve black people. Do u understand how flawed this logic is?
Simple fix LGBT+ community stop making clothes, doing makeup, hair etc. for all these people. We know a lot of that won't go well. I know we want to stop discrimination but at some point we have to give them the same energy.

You can refuse to do someone’s hair if you don’t like the way they look. If you don’t like the way they smell. If you’re not in the mood to serve that person. Whether they are gay or trans is insignificant. As a small business self-employed person you do not have to do someone’s hair or bake someone a cake or design a website if you don’t wish to. It would be stupid to say I’m not going to do it for you, because you’re gay… I admit that. But certainly turning down business is your prerogative as a self-employed business person.
