In my family court case, the forensic psychologist was extremely important because she was able to figure out the mother was the perpetrator of domestic violence and had serious mental health issues. Meanwhile, the judge kept rubber stamping the mother for temporary custody and disregarded the mother's violence. So it was very helpful to get an opinion outside of the judgers opinion, especially an intelligent and well-thought-out opinion.

Lawyers have ZERO SAY, and ZERO INVOLVEMENT during a CCE. Hire them after you receive the report.

Actually, under federal law- they do. The reason why is because commonly, Miranda and the fifth amendment may be implicated, as well as the fourteenth amendment due process and equal protection clauses. Counsel should also verify the competency of a given professional to give expert testimony before a CCE is done at the outset- because not ALL mental health professionals are legally qualified to involve themselves with a CCE as an expert- rather we have this thing called the Daubert standard via which an "expert" must qualify their credentials. the same way not all medical doctors are qualified as forensic pathologists.

No, not really- "conflict" is the nature of a "case and controversy" and as such has no proper bearing on a court's decision- least the court be reversed on appeal for abuse of discretion. Rather, expert testimony is limited to exactly that - impartial scientific information- rather experts may explain how the science and field supports or does not support an advocate's position- but an expert may not advocate on behalf of either party. Such is a violation of the APA rules and can result in a psychologist's license revocation and/or discipline by the APA.
