From my understanding. once the dog alerts and sits, that's when the cops can search the car. if the dog doesn't alert then at that point if they continue like they did here, its now an illegal search because there's no suspicions.

Seems you are confusing a K9 “walk-around” with a search. The Supreme Court has ruled a walk-around is not a search under the 4th Amendment as long as the dog is legally situated (just walking around a car). In a walk-around, there must be a “hit” in order to produce probable cause for an officer to enter the vehicle and search. THIS, however, is ALREADY a search, a boarder search to be precise. The officers are already searching the vehicle and no “ hit” is needed to search any compartment. They are just using the K9 to make the search easier and faster.

The only alert the dog showed was when the officer clearly gave it a hand signal to do so, and even then it didn't stop long enough to have found anything they were sniffing for.

It's possible to become a member of some Web sites where your video automatically is uploaded immediately to the Cloud. Even if they get the camera, your video up to that point is already unreachable to the searching officers.

Also if anyone else didn't hear whatever was happening in the back of that camera it did sound like buttons were being pushed so wondering if they were trying to turn the camera off. Dacrazy-can you do. I had it happen was told it can buff out and the interior was not damaged by the dog it was due to driver neglect. Then was told if I didn't have weed in my car I wouldn't of been stopped... the dog hit on nothing in my car but according to the chief of police they were in the right because the officer smelled weed in my car, they were pretty silent about the dog not smelling it.
Unfortunately, most PDs and LEAs will tell you that it's your responsibility to pay for any damages. However, you can take the agency to small claims court, or take it up with your insurance company, who will take them to court on your behalf.

If you don't consent to your car being searched they can bring in the K9 w/o a warrant (please correct me if I'm wrong). But then If the dog doesn't get a hit (meaning that the K9 didn't identify the scent of something that he was trained to pickup on), there's now no probably cause, there's still no consent to search and no warrant...so at this point isn't the vehicle search performed by the two agents illegal? If the vehicle is legally registered and insured in the US and the driver is a US citizen with a valid driver's license (and yes, with regards to these I am making the assumption that this is the case) he's protected against illegal search and seizures across the board, period. Doesn't matter what agency.
zeke They are allowed to do an exterior sweep with the K9. If the dog "alerts" then they are allowed to enter and fully search. However their loophole is simply saying the dog alerted so they search anyways. If they want to get in your vehicle they will.
I believe a way to fight the dog just alerting or so they say. you need to ask them what is the dogs signal to alert it has found something. they have to tell you then you can watch as well it's not much but it helps if they have to tell you the signal the dog shows

It was a very difficult thing to find in the grainy video footage from the officer's dash cam, but i was recording 1080p quality footage from much closer and from almost the opposite angle with a pair of $30 camera glasses i bought from banggood.com. and the hand signal was clear as could be, but it was, indeed, very subtle. The officer wasn't worried in the least about making the signal in my sight, but positioned himself so that his body blocked the signal from the dash cam of the car that initially pulled me over. That is why it was so hard to identify. They had no idea about my glasses, though, the fuckers. I didn't say anything about my video footage all the way through the pretrial process while the d.a. kept offering plea deals that i declined. Finally they made an offer the day before the trial date and told me "its not gonna get any better than this. If the jury finds you guilty, you are gonna get a gazillion years and blah blah blah." So i made a counter offer. I pulled a $20 dollar bill out and held it up and said, " How bout this: Here's $20 bucks if you just go away." The guy looked like he just watched me take a dump on his treadmill, mouth all open, big uncomfortable pause. Lmao! Finally he stutter/stammered "I can't do that. No way." I said, "Sure you can. You do it all the time." He said no again, so i held it out closer to him and said, "It isn't going to get any better than this. If the jury finds me not guilty, you're gonna take a loss on the record and destroy your 100% conviction rate. You know that, right?" Desired effect achieved. That fat fucker's face nearly turned purple, he got so mad, lol! We went to trial alright, and he thought he was gonna bury me with a slam dunker case. Arrogant as i've ever seen anyone. Swaggering around like it was his courtroom during the jury picking process. The second the jury was seated, i entered the video footage into evidence and long story slightly less long, i was found not guilty. The lackey deputy d.a. was shitcanned for fucking up the 100% conviction rate of the d.a. office. That's how you punch back.
Diego Ezeith in Canada atleast, you can apply to be reimbursed for damages caused by immigration procedures. Which includes K-9 searches at border crossings. I Imagine there's something similar in the U.S. or Canada is just all around a better country.

A friend of mine Won a suite against a department because they had a dog wander all over inside his car. he's seriously allergic to pet dander and told the officers several times he was. they ignored him. Mocked him about being allergic. Sent the dog in several times for no reason. Never found anything and then told him. You're free to go. He said he could no longer enter the car because of all the dander, the officer mocked him again saying, My dog perfectly clean. my friend called his lawyer who came to the scene. lawyer spent several minutes collecting information about the officers and exactly why they searched his car. In the end, he had to call a tow truck to have a car hauled to an auto detailer. Spent in the area of 1500 to 1600 to have all the seats, carpet shampooed, interior almost completely disassembled for a deep clean and even had to have the seat belts removed and cleaned. They completely cleaned everything. he had a recording of him telling officers of his allergies. the dog crawling all over the car multiple times. how the officers mocked him. Yeah it was pretty bad.

I sure hope that someone comes up with something that when your GoPro is recording that it also records somewhere else so that if they try and erase a recording or all of a sudden it goes missing you can go back and retrieve the recording until it was stolen or erased.

Seems you are confusing a K9 “walk-around” with a search. The Supreme Court has ruled a walk-around is not a search under the 4th Amendment as long as the dog is legally situated (just walking around a car). In a walk-around, there must be a “hit” in order to produce probable cause for an officer to enter the vehicle and search.
THIS, however, is ALREADY a search, a boarder search to be precise. The officers are already searching the vehicle and no “ hit” is needed to search any compartment. They are just using the K9 to make the search easier and faster.

If you don't consent to your car being searched they can bring in the K9 w/o a warrant (please correct me if I'm wrong). But then If the dog doesn't get a hit (meaning that the K9 didn't identify the scent of something that he was trained to pickup on), there's now no probably cause, there's still no consent to search and no warrant...so at this point isn't the vehicle search performed by the two agents illegal? If the vehicle is legally registered and insured in the US and the driver is a US citizen with a valid driver's license (and yes, with regards to these I am making the assumption that this is the case) he's protected against illegal search and seizures across the board, period. Doesn't matter what agency.

They are allowed to do an exterior sweep with the K9. If the dog "alerts" then they are allowed to enter and fully search. However their loophole is simply saying the dog alerted so they search anyways. If they want to get in your vehicle they will.

I believe a way to fight the dog just alerting or so they say. you need to ask them what is the dogs signal to alert it has found something. they have to tell you then you can watch as well it's not much but it helps if they have to tell you the signal the dog shows

It was a very difficult thing to find in the grainy video footage from the officer's dash cam, but i was recording 1080p quality footage from much closer and from almost the opposite angle with a pair of $30 camera glasses i bought from banggood.com. and the hand signal was clear as could be, but it was, indeed, very subtle. The officer wasn't worried in the least about making the signal in my sight, but positioned himself so that his body blocked the signal from the dash cam of the car that initially pulled me over. That is why it was so hard to identify. They had no idea about my glasses, though, the fuckers. I didn't say anything about my video footage all the way through the pretrial process while the d.a. kept offering plea deals that i declined. Finally they made an offer the day before the trial date and told me "its not gonna get any better than this. If the jury finds you guilty, you are gonna get a gazillion years and blah blah blah." So i made a counter offer. I pulled a $20 dollar bill out and held it up and said, " How bout this: Here's $20 bucks if you just go away." The guy looked like he just watched me take a dump on his treadmill, mouth all open, big uncomfortable pause. Lmao! Finally he stutter/stammered "I can't do that. No way." I said, "Sure you can. You do it all the time." He said no again, so i held it out closer to him and said, "It isn't going to get any better than this. If the jury finds me not guilty, you're gonna take a loss on the record and destroy your 100% conviction rate. You know that, right?" Desired effect achieved. That fat fucker's face nearly turned purple, he got so mad, lol! We went to trial alright, and he thought he was gonna bury me with a slam dunker case. Arrogant as i've ever seen anyone. Swaggering around like it was his courtroom during the jury picking process. The second the jury was seated, i entered the video footage into evidence and long story slightly less long, i was found not guilty. The lackey deputy d.a. was shitcanned for fucking up the 100% conviction rate of the d.a. office. That's how you punch back.

In the end, he had to call a tow truck to have a car hauled to an auto detailer. Spent in the area of 1500 to 1600 to have all the seats, carpet shampooed, interior almost completely disassembled for a deep clean and even had to have the seat belts removed and cleaned. They completely cleaned everything. he had a recording of him telling officers of his allergies. the dog crawling all over the car multiple times. how the officers mocked him. Yeah it was pretty bad.
