Most of the times it should you should bare all or 80 20 percentage among you and bellow floor,or society rules you can check as you use the floor most. If any modification is done in leakage area by above floor then definately above floor owner have to do it in whole.

Ideally, all leakages/seepages should be rectified and paid by the society unless any flat owner deliberately does something to cause the leakage/seepage. Secondly, Bathrooms are given for use of the flat. Just bcoz the upper floor person uses the bathroom, does it mean he/she is responsible for leakage? If we have to stop use of bathroom, we should also stop paying maintenance. Bcoz if we can't use our flat, what's the point of paying maintenance?
If above person is not co operative to repair then which government agencies we have to report.if he is not co operative to society what we have to do pl tell i am facing problem in Bangalore

If there is leakage from upper flat , society must send him notice to repair it but it does not happen and if owner of upper flat is not repairing it go to health branch of corporation and give complaint agains owner of upper flat on the ground of health issue. Concerned officers of corporation visit the sight and fix the spot of leakage. And issue notice under the provision of Mumbai prantik Mahanagarpalika Adhiniyam to concerned flat owner to get it repaired, if not then they register case and send to court This is legal provision.

One of RCC Piller/Column inside my flat is damaged & big crack is developed due to continuous rain water leakages in monsoon season--for last 14 years-- from the wall of open duct which is behind damaged Piller/column !! This is,in fact Structural damage to piller & thereby affecting stability of overall bldg.; in this case there is no fault from my side!!now Society is refusing to repair it--which is utmost dangerous to Stability of our society's bldg; in fact, this is case of structural repair. & Society must have to repair the said damaged Pillar, so please advise in this matter early--who will repair above piller which was damaged due to rain water leakages from duct's wall !! What if leakage is from terrace and society is not ready to repair and saying society doesnot have funds to repair? And society cannot do anything in that cos members not paying maintenance and society is lack of funds
First, find out the source of leakage. Most of the times, problem is in the concealed pipes/internal plumbings over which no member has any control . In such cases, society has to bear the entire cost.

Write a letter to society and ask society to request him to cooperate if it doesnt happen go to BMC And also file a complaint in police station and give legal notice through u r lawyer but avoid all these as much as possible if possible try to convince him and if doesn't happen than go into legal formalities else not

Problem is, lower floor people are often selfish in these matters. They don't realise that upper floor person are also normal human beings like them who are normally using the flat just like them. It's a very very bad practice of making the upper flat person pay for everything as if he is the one who jointly constructed the building along with the builder
Sir, are you from Gujarat? I am an owner of flat in a co-operative housing society in Gujarat. Lower flat is complaining of seepage/leakage. My flat is barely 5 yrs old. I have maintained the flat in same condition as received from builder. I have offered 50:50 cost sharing, but lower flat owner flatly refused. Why should upper flat owner bear the legal burden of everything? I have seen decided case laws (of other states) which are heavily skewed against upper flat owner despite no fault of upper flat owner. Society is still controlled by builder and I am regularly contributing to sinking fund. Need to talk to you personally. If possible, plz answer here. Thanking you in anticipation.
The logic here is simple. You're flat is causing seepage problems[ assuming} to the neighbor below you. Its not his fault that your pipes are leaking and causing damage to his walls & ruining his house. He also has to now bear the cost of repairing his own flat which wasnt caused by him. Hence, sololey you're responsible for it and you should bear the full costs not him.
@@hotlemonade6643 So one should never buy flat on any upper floor. The upper floor person uses the flat normally just like the lower floor person. But, just bcoz water flows from top to bottom, all blame falls on upper flat. If there is leakage, it has to be fixed but it is not necessary that upper floor person has to bear all the cost, especially if there is a problem with concealed pipes/internal plumbing over which no flat holder has any control.

When I shifted this month,last six days it was raining continuously and my flats bellow bathroom had a shepage problem .He talked to promoter but he advice him to talk with the upper flat owner i.e me.Socity kept aside the matter and told they will not interfere as it is a internal matter.(After rain stopped and there is no seepage now) Please advice me:- 1.What is the tenure of legally warenty period from promoter. 2.What is the legal aspect if I refused to pay the repairing work. 3. What legal action may be taken against promoter as ultimately it is a manufacturing defect. 4.Should i make a written submission to the promoter for future record. 5. Any other advice from you

Apply common sense and you can get the answer.Wherever leakage or defective item or poor workmanship is prevailing the owner of that particular flat/apartment is responsible for the repair and no one else.
Completely Wrong Advise, agar upar wale ka bathroom leakeho raha hai aur neeche wale ke flat damage ho raha hia to woh khud nahi karvayega, Bakwaas, mere saath same tha mene upar wale ka paani ka connection katwa diya aur bol diya ke legal notice dunga aur jitna damage huya hai flat uska compensation bhi dalunga. 1 din me theek karva diya. Haqq ke liya larna arta hai biggi billi bann ke nahi.

First, find out the source of leakage. Most of the times, problem is in the concealed pipes/internal plumbings over which no member has any control . In such cases, society has to bear the entire cost.

Write a letter to society and ask society to request him to cooperate if it doesnt happen go to BMC And also file a complaint in police station and give legal notice through u r lawyer but avoid all these as much as possible if possible try to convince him and if doesn't happen than go into legal formalities else not

Problem is, lower floor people are often selfish in these matters. They don't realise that upper floor person are also normal human beings like them who are normally using the flat just like them. It's a very very bad practice of making the upper flat person pay for everything as if he is the one who jointly constructed the building along with the builder

I am an owner of flat in a co-operative housing society in Gujarat. Lower flat is complaining of seepage/leakage. My flat is barely 5 yrs old. I have maintained the flat in same condition as received from builder. I have offered 50:50 cost sharing, but lower flat owner flatly refused. Why should upper flat owner bear the legal burden of everything? I have seen decided case laws (of other states) which are heavily skewed against upper flat owner despite no fault of upper flat owner. Society is still controlled by builder and I am regularly contributing to sinking fund. Need to talk to you personally. If possible, plz answer here.

The logic here is simple. You're flat is causing seepage problems[ assuming} to the neighbor below you. Its not his fault that your pipes are leaking and causing damage to his walls & ruining his house. He also has to now bear the cost of repairing his own flat which wasnt caused by him. Hence, sololey you're responsible for it and you should bear the full costs not him.
@@hotlemonade6643 So one should never buy flat on any upper floor. The upper floor person uses the flat normally just like the lower floor person. But, just bcoz water flows from top to bottom, all blame falls on upper flat. If there is leakage, it has to be fixed but it is not necessary that upper floor person has to bear all the cost, especially if there is a problem with concealed pipes/internal plumbing over which no flat holder has any control.

Hello sir I am new to your channel from west bengal.My flat was handed over by the promoter on feb2020 ,due to pandemic i was not staying in my flat. When I shifted this month,last six days it was raining continuously and my flats bellow bathroom had a shepage problem .He talked to promoter but he advice him to talk with the upper flat owner i.e me.Socity kept aside the matter and told they will not interfere as it is a internal matter.(After rain stopped and there is no seepage now) Please advice me:-
1.What is the tenure of legally warenty period from promoter.
2.What is the legal aspect if I refused to pay the repairing work.
3. What legal action may be taken against promoter as ultimately it is a manufacturing defect.
4.Should i make a written submission to the promoter for future record.
5. Any other advice from you

This lawyer is giving really bad advice. He is saying that the lower flats who suffer due to leakages from upper flats must themselves pay to get the problem solved. Crap advice. Other youtube lawyers have given way better advice.
