      It's amazing "these people" who go through 6 moths of training (which is not enough) to uphold laws(that they clearly don't know) think they're above it .They literally make shit up as things happen and most times actally wind up breaking the law while trying to enforce it.       @@thecrazyisreal there's no justification for qualified immunity. Every cop needs to be held liable in both criminal and civil court for their actions when they cause harm and/or violate someone's rights. Prisons should be filled by the bad cops, not drug addicts.

      @@wbg6500 What's a lot? There are hundreds of thousands, so no, nobody talks to a lot of police officers if you look at it that way. Every officer I've ever met, dozens, have been happy to pretend their department policy is the law instead of simply department policy. That's a major issue. It's pervasive. Look at the officers in this video as an example. Tons of years of experience and they can't answer VERY basic questions about the law. What do they rely on? Department policy. You heard it yourself. That's called what? Believing the law is whatever they say it is. They genuinely believe their personal department policy is the law. They believe the law is whatever they say it is. It's an epidemic that is killing trust in police officers on a nationwide scale.

      That’s because, generally speaking, the law is whatever they say it is.
      What exactly can an individual do if a cop pulls them over (let’s say for speeding), then decides to arrest them (for whatever reason), then holds them in the back of the car for a couple hours, then books them.
      Eventually, that person will probably be released, but there’s a lot of points in there that the cop can make ANYTHING up to justify wasting half your day, or possibly much longer. What can you really do about it? Really?
      What if they outright shoot you in the head after the stop. Sure, they will probably go to jail eventually, but you’re dead, and they may not go to jail at all.
      Now imagine this world without cameras (body cams and personal), cell phones, social media, and audio recordings.
      They are the law if they want to be and for every one that gets caught and punished accordingly, dozens don’t.
      I believe most cops are good, the vast majority, but boy can they get away with a ton if they want to (at least temporarily).

      Yet me and everyone else I know all knew what Miranda rights were by the time we were in grade school. And haven't forgotten since. So essentially the average third grader is better educated on their rights than these "police" officers.

      To be totally truthful he has been a county sherif lieutenant during that timeframe. ie he is not arresting anyone, he is the one checking that when you goto court you pass through the metal detector without carrying a bazooka in with you. All of his actions were illegal and many in uniform feel that they are above the law. I just wouldn't want people to assume he was a police officer as he is not. Hopefully he gets fired and jailed for the 5 or more years he shuold get. As this is Cook County he most likely will be forced to retire but no actual jail time.

    Im so disgusted that police officers are not required to know the law but are paid to enforce it. Doctors lawyers and judges all need certification and licenses to practice but Police officers dont have to, what a wonderful country

      Cops on average, do not do any of the above.

      yeah it's really hard to imagine the frustration you would feel in that moment. These cops follow company policy and not the law. To be perfectly honest the law is subtle and yet incredibly complicated. It's why a patrol officer was never intended to have the same right of interpretation as a judge. We need police, but they don't get the best and brightest. You can't expect cops to know the law as well as a judge, so they should be stripped of like 90% of their investigative abilities. Any invocation of constitutional law should be a required call to a judge or their representative, not the decision of some redneck captain who couldn't understand half the language in the law they enforce. Even if you eventually get justice in court, the process of bail/jail/awaiting trial should be considered one of the most despicable things a citizen can experience.

      Not shocking so many Copa have 0 clue what they can and can not do to you .....and I'm a cop supporter too but so many don't know shit ..... had a cop stop my wife last year for a broken headlight.... to save money she isn't on my insurance so she's excluded and he tried impounding the car and telling her she couldn't drive ..... had her there an hour ......even argued about our insurance wasn't current lmao😂 I called his super and 5 mins after he let her go and let him know that his men didn't know basic driving laws that you learn at 18 lol 😂

      These court officers (not street cops) have been coached on how to answer without (?) lying. They are not quite as stupid as they appear. Just because they can't quote a law doesn't mean that they are ignorant of the law. I wish the lawyer deposing them was as good at deposing them as they are at lying without lying.

      This case is not still ongoing, it has been dismissed years ago. The court found the actions of the officers lawful concluding: "Clearly, “videotaping other people, when accompanied by other suspicious circumstances, may constitute disorderly conduct” under an Illinois statute stating that a person “commits disorderly conduct' when they knowingly do “any act in such unreasonable manner as to alarm or disturb another and to provoke a breach of the peace.” Reher v. Vivo, 656 F.3d 772, 775 (7th Cir. 2011) (quoting 720 ILCS 5/26-1(a)(1)). In this case, Officer Barbaro testified that he observed Plaintiff “scanning back and forth with the camera up and down, people coming in and out possibly, possibly videotaping through the glass at the security post that I work at of the entry procedure.” [114-5] at 3. According to Officer Barbaro, the courthouse installed cameras outside the building after the 9/11 attacks to “watch the intakes for the air system in case someone wants to do something with that.” [114-5] at 3. Given such circumstances, Officer Barbaro had reasonable suspicion to believe that Plaintiff violated or was violating a general administrative order of the court, and/or the Illinois statute prohibiting disorderly conduct. He saw Plaintiff filming the entrance of the courthouse, a place where jurors, victims, witnesses, and litigants appear, and where security measures remain in place for the protection of all who come within the courthouse, including jurors, victims, witnesses, litigants, attorneys, courthouse security officers, and judges.’

    I'm a former deputy sheriff and I'm in absolute disbelief. To say that you don't know what is required to detain and arrest when you have been an officer for more than 5 minutes is insanity.       The problem isn't that "they" don't know...., the problem and issue is they are allowed to play coy and innocently ignorant to the facts and the law. They KNOW what the law is, but if they say it, now they're responsible for that knowledge which will in turn demand accountability. So, which is the easier and most discreet approach or route to take ...? To act as if they don't know the law, even at the expense of looking like they just don't remember or confused. When an individual (cop) is THAT cunning and sophisticated in hiding their deceptions, EVERY booking they have made, EVERY conviction the prosecution have won, should be revisited and reviewed with major scrutiny. (IMHO) Most COPS on the beat or anywhere will not give the the public the same consideration when confronting someone who they KNOW aren't out attempting to commit crimes. SMDH

    My biggest problem with this is how blatantly illegal all of this is, yet the cops remained employed and on payroll, and even worse, it somehow took several YEARS to reach a conclusion.       Being detained and arrested are legally the same. Every time you’re detained at a traffic stop, you’re legally under arrest, but you don’t have to go in to get booked or fingerprinted.

      That's a really tyrannical standard when you consider the potential millions of statutes on the books so far in the United States.
      ...that "no ignorance of the law" thing should really only apply to things that are generally known to be harmful to others. (and specific laws should have it as part of the text if the authors want ignorance to not be excused....it shouldn't just be the default for every law that is ever made.)

    I was blown away by this entire interview until I heard, Cook County. My uncle was a pedestrian killed by a reckless driver many years ago who was never held accountable for his death. My family learned the driver was a family member of that police department. It makes sense to me now, 30 years later.

      When I was in college in Chicago, a friend's 10 or 11 year old daughter was crossing the street with her bike and was killed when a delivery-type truck hit her, smashing her between his truck and a parked car. He was never charged with anything.

    Speaking for myself, this is terrifying. Officers like this are on the streets day in and day out, not knowing the law and arresting and who knows whatever else. Unfortunately in most cases it'll be justified, even when they are in the wrong.

    This is why I believe that qualified immunity needs to be a thing of the past. Police officers should be held at a higher standard. When caught breaking the law or willingly violating someone’s rights on a power trip it should be an automatic felony and prison time. Imagine all of the poor people these two have violated in the past

      I don't think qualified immunity should be abolished. It's imperative for protecting cops who might otherwise be too afraid to do their jobs for fear of reprimand.
      What we actually need is independent oversight of the police. Oversight that can justify or disqualify such immunity based on the circumstances of each interaction.
      What we have to remember is that cops are human beings. They're jerks and saints just like us. It would be so great if we could detect jerks and exclude them from law enforcement. Sadly, we can't. The best we can do is provide oversight. And not have the police police themselves. A truly independent, with full authourity, oversight board that keeps the cops honest.

The fact that these two have the authority to restrict someone's freedom , while in an official capacity , with arrest powers , a badge , a weapon , access to long guns , chemical agents , tasers , batons , mace , and the ignorant intimidation factor is mind boggling , terrifying , and if I hadn't witnessed this scenario with my own eyes , something from George Orwell's 1984 novel , and worse.       Well no, they don’t have access to all of that, as they work in the jail. They are not road deputies. They are sworn police, however do not operate in the same manner as municipal police. (Hence why he hasn’t made in arrest in 27 years etc) the officers in black work in the jail. Officers in tan work streets.

      I was disgusted too, not trying to get them an excuse… but if you got promoted to a leadership position after just a few years of police work, and it’s been more than 2 decades since you needed to know any of that, would you do any better? All you have to do is be involved with the backside investigation processes, not mess up and boom. Promotion. There are tons of policing jobs that don’t involve getting “hands on”, and hence why he was the LT of the police station and not for patrol officers. Same thing as the military, just because you were a marine or solider doesn’t mean you were close to a firefight or know what to do in one.

    If he became Lt. Malazzo 22 years ago and he still does not know the basic laws or the Constitution, why is he even still in the job?
    The thought of how dumb the rest of this department must be, if this is the calibre of the rank of Lt., is very worrying. When Sgt. Jennifer Larson is introduced into the picture it becomes even more evident that ignorance of the law and being unfit for office in law enforcement seems to be the only qualification necessary to be employed in this department.
    The actions of these officers were so blatant and obviously unlawful and illegal, so why the hell has the case been going on for years.
    Both officers should have had qualified immunity revoked, been fired from the job and prosecuted/sentenced to prison terms for their unlawful actions.
    Always remember, ignorance of the law is no defence.

      These deputies have obviously been on court duty thier whole careers. Most Sherriff's Departments rotate court duty or have as off duty extra work for thier regular deputies.
      This really rises to a full State or even Federal investigation into the department. The cavalier manner in which civil rights are violated is stunning. A challenger for Sheriff is in order for sure.

    I was a truck driver for 30yrs, pulled over for 3mph over the speed limit in a small town the cop said ignorance of the law is no excuse but yet you have 20yr veteran cops don't know the law is really disgusting and they wonder why people don't have any respect for them anymore WOW

      Someone else in the comment section theorized that probably attempt to avoid _mens rea_ -- which only works if you are _not_ working in law (enforcement) and expected to know it.

    Why this case wasn't swiftly concluded is beyond me. It is obvious these officers are incompetent and violated rights. Their deposition answers are truly frightening.

      The court ruled in their favour, because apparently there is a court order that prohibits filming in the court that somehow means that you can't film outside because you might get a glimpse inside.
      This means they had probable cause to do all the rest.
      Oh and you can't fight the claim that the law making it illegal to film is itself an infringement of the first amendment because (and this takes the cake for backwards) you need to have a successful complaint for your right being violated first.
      So her rights get violated, she gets detained, they get cleared because of a law directly against the first amendment, but you can't fight that law because you need to first show a violation of rights. Which you can't get because the law makes it legal to violate the first amendment...

      @user-dw4cs4xv8y yeah but she was filming near the entrance, and could see inside and see the security checkpoint, meaning the cops had a reasonable excuse to assume she was filming the security at the place for something bad

      Or they do understand the law,but choose to abuse their power because they know some citizens who don't actually fully understand the law so these cops just take advantage of the victim and they think they can get away,they get away.But cops should respect the laws not abuse their power and act above the laws.

      Most cops are trained in apprehension, pursuit, questioning witnesses and suspects, and there is always a bit about the Constitution, later on in service always makes a reference to these laws and how recent court cases change the way the laws are enforced. I was amazed at how much I didn't know about the law when workers comp sent me to college to become a paralegal after 24 years as an officer. Sure we understood a bit about the law but had no idea how those laws actually worked when cases went to court. We would see the lawyer who questioned us, and the prosecutor who was supposed to protect us a bit and lead us through our testimony on the stand. I wish every cop could attend some of the classes we took in that course, it would make a huge difference.

      They settled. She got 15000 dollars, nowhere near the amount of cost of her lawyers likely. This county has around 100 million dollars of lawsuits they've had to pay. From offenses against its jails, officers, and even judges. This entire county is corrupt. We need to end qualified immunity
