Tina translate lang sa bass so technically si Rico pa rin don yung kay Perf lang siguro solo talaga nya yun, kasi lang gumawa ng melody na yun.

If there is a bad taste on rico’s part toward Perf, then it is so sad naman. Musicians should support fellow musician.

I don't know the technicalities of the copyright law, but here's my two cents. It's like a man who built his own house from a very creative ideas that made the house really look beautiful. Then somebody decorated the house that made the house even look more beautiful. However, the person who decorated the house can never claim ownership of the house no matter what. And also, Perf's guitar solo was greatly influenced by this brilliant song. If not for the song, Perf would not have been able to create that magical guitar solo. But if I were Rico, I would let Perf perform 214 without restriction. Life is short, let's welcome our friends to our house, enjoy music and be happy.
I agree with your suggestion to Rico but I think the house analogy is a bit different kasi the guitarist did not just decorate the house that made it earn income and become loved by the public. He made structural or major contributions without which it may not be the same house.
214 can still sound good even if it's performed in acapella. I think the people who are making much ado about the guitar part are musicians who know music better than the majority of the public. In my opinion the 214's catchy melody and lyrics which were created by Rico, are the reasons why it's making tons of money. Mind you, I like the guitar solo a lot. I'm a big fan of Perf and I watch his youtube videos. I don't know what their agreement was about the copyright of the song. For this case with Rico Blanco and Perf de Castro ... you can look into how the intellectual rights of George Harrison's "While My Guitar Gently Weeps" where the guitar solo is credited to Eric Clapton. The main composer and lyricist is George but the guitar solo is definitely Eric Clapton's
I'm sure there are many similar cases… Look to Spandau Ballet where singer Tony Hadley, sax player Steve Norman and drummer John Keeble sued guitarist (and sole songwriter of "True", "Gold", etc) Gary Kemp to claim they were co-writers, including the iconic sax solo in "True." The courts were decisively in favour of Kemp.

I’ve always said that 214 is iconic simply because of how THE BAND made it as a masterpiece. Regardless of who wrote it, it came into what it is today because of how Bamboo sang it, rico wrote it, perf played it and of course the base and the drums that are less highlighted. If this conflict is true and not just some marketing strategy for the upcoming concert (which I really still hope is just what it is), this is truly disheartening. In general there is I think an unwritten rule that, musicians support fellow musicians. I've experienced this first hand, ages ago when I was part of a performing band. When we played in productions/shows especially in bars, fellow bands support and route for a each other. For example, when one band is playing, as much as possible others bands listen, or if some band member has a problem with his or her instrument / gear, members from other bands lend or help fix the problem. In short, musicians have a spirit of brotherhood among each other and if fellow bands practice this, the more should fellow band mates do the same thing. I hope sir Perf and sir Rico settle this with as brothers in music soon (or eventually reveal that this is just a stint for their upcoming concert, * fingers crossed*).
Very informative, this makes me more intrigued on the fact that Rico is only targeting Perf. Ever since when there's a time that Perf taught the guitar solo part there was also a the same claims about it to take down the video.
I was somewhat uncomfortable with the idea of a reunion concert without one of the original members specially the one who is abcent contributed 3bhit signles and 2 iconic guitar solos. But somehow this video gave a relief because the band is always silent about this issue for some legal matters. Now i understand. Im still a fan tho to the original lineup. I hope to see them in them all performing maybe part 2 of the concert.

The final song is a collaborative work. The first written one was not the same as the final work. Perf, Bamboo, and Nathan were not there when the lyrics were composed, but that composition was not the song we heard. It is the collaborative work of the band that we heard and learned to love.

this is exactly what I've been saying. Perf is specifically targetted probably due to personal conflict within their group. It's petty. I can search on youtube "214" and it will give me loads of home videos of people covering the song. What perf did was basically a cover performance just the same. So bakit si perf lang ang may takedown notice. I do believe rico is within his rights to do it but that doesn't mean he should have. Perf did contribute to the song after all and out of respect and personal code of ethics should be given freedom to cover the song so long as no malice is intended to slight it and it's composers.

simply put, The guitar lines are Perf De Castro, the song writing, lyrics, etc. is Rico Blanco's. Perf did not claim to be author of the song, his claim are the guitar lines in the song as his creative copyrights.

I’m not a copyright lawyer but I am a songwriter. Pasensya na po sa haba nito but I wish to share my thoughts: 1. Magkaiba ang composition sa audio recording. The rights to a composition are controlled by a music publisher; the rights to an audio recording are controlled by the record label. When it comes to copyright registration of a composition, dito sa Pilipinas, sa pagkaka-alam ko, ang nireregister mo ay melody and lyrics. So kung melody at lyrics lang ang pinag-uusapan, at kung yun ay gawa ni Rico Blanco, siya po ang composer. 2. A guitar solo, bass line, drum fill - lahat ng yan ay bahagi ng audio recording, hindi ng composition. Unless of course the contract signed by the band members states that each member is to be given composer credits because of their performances. Ano ba ang nasa kontrata nila? Hindi natin alam. We may be of the OPINION that each of the band members deserves to be credited as composers of the song because indeed, all these instrumental performances on the RECORDING do add to its beauty. However, opinions don’t matter. What matters is whatever is stated in both the label contract (for the artist/s) and the publishing contract (for the composer/s). If there is no dispute as far as the ownership of 214 goes, and if only Rico has been receiving royalties as a composer, then malamang siya nga lang talaga ang composer, wala nang iba. 3. Assuming Rico controls all rights to 214, he has the right to allow or prohibit the usage of his composition HOWEVER HE CHOOSES. “He hasn’t stopped the bassist and the drummer, can he stop Perf De Castro?” YES, HE CAN. I mean they were bandmates before, for sure every one of them spent and had fair share happy days, countless nights of work collaboration, helping each other out that eventually made this song so ICONIC, so SUCCESFUL that it literally made an impact to their diehard fans, fellow musicians, and lastly this song added contribution to our very own OPM. Can they just set this one aside in honor to the “GREATWORK” that they had done? Let the people, the fans enjoy this song without any more controversy. At the end of the day as for me, every time I would hear this entire song, I won’t say, “Oh ang galing naman ni Perf sa solo nay un, or hanep ang galing naman ng lyrics and wordings ni Rico.” Hindi eh, what I would say, “ang aling talaga ng “RIVERMAYA….” Ang galing “NILA…” I would count them as one RIVERMAYA band. I don’t know about the technicalities, but I guess whoever will play their songs in the future whether new generation or not, it would be like a tribute to them because the fans knew that it was originally theirs. Technically what Rico Blanco can do is re track the song with out Perf De Castros guitar solos. Perf has a Performance Artist Rights. And can still continue playing his part of the song…
Yeah Ozzy Osbourne did it to his bass player Bob Daisley….Re-recorded the bass parts with a different bass player. This was due to Bob Dsisley claiming writing credits to the songs and seeking royalty payments.

Our vocalist, even if he's the principal song writer, put us all four in the band as song writers of our songs since we started our band in the late 90's (and we're still active, digitally, by the way). Is this a good practice, especially learning from what happened to Blanco v. De Castro?

Both of them has the right because 214 it was released under Rivermaya and not under Rico Blanco and both of them are the previous member of band. The sole owner of 214 is Rivermaya.

Perf should go to court to contend that the guitar solo is his composition thus he is a co writer and should recieve royalties for it. In the 60s a british band called Procul Harum had a hit song called A WHITER SHADE OF PALE. it was composed/wrtten by Gary Booker. A founding member, the one who played that iconic Hammond organ intro sued in The House of Lords ( britains court ) for equal co writing ctedits. He won. Given monetary compensation and continue to receive royalties. .Perfs guitar solo is integral part of music therefore, he IS CO WRITER not just RB

I am still confused. There are many parties I can see, the author, the band, the recording company. Who among these 3 has the legal ownership of the song? If it is the author, does it mean he can copyright strike the band (after he left) or even the recording company or other previous members of the band?
ok, technically Rico Blanco is the composer. As to "owner", it can be muddled. Bands, early in their career usually transfer ownership in the "recording agreement". He can always claim copyright. YT is not a court and they will just side with whoever claims the loudest
Thats right Atty. the selfishness of Rico Blanco is the issue in this matter. They both share the copyright ownership of 214 hence Rico has the most power to sue 3rd party in legal issue using the 214 but untoward to Perf de Castro.

I don't know the technicalities of the copyright law, but here's my two cents. It's like a man who built his own house from a very creative ideas that made the house really look beautiful. Then somebody decorated the house that made the house even look more beautiful. However, the person who decorated the house can never claim ownership of the house no matter what. And also, Perf's guitar solo was greatly influenced by this brilliant song. If not for the song, Perf would not have been able to create that magical guitar solo. But if I were Rico, I would let Perf perform 214 without restriction. Life is short, let's welcome our friends to our house, enjoy music and be happy.

214 can still sound good even if it's performed in acapella. I think the people who are making much ado about the guitar part are musicians who know music better than the majority of the public. In my opinion the 214's catchy melody and lyrics which were created by Rico, are the reasons why it's making tons of money. Mind you, I like the guitar solo a lot. I'm a big fan of Perf and I watch his youtube videos. I don't know what their agreement was about the copyright of the song. For this case with Rico Blanco and Perf de Castro ... you can look into how the intellectual rights of George Harrison's "While My Guitar Gently Weeps" where the guitar solo is credited to Eric Clapton. The main composer and lyricist is George but the guitar solo is definitely Eric Clapton's
I'm sure there are many similar cases… Look to Spandau Ballet where singer Tony Hadley, sax player Steve Norman and drummer John Keeble sued guitarist (and sole songwriter of "True", "Gold", etc) Gary Kemp to claim they were co-writers, including the iconic sax solo in "True." The courts were decisively in favour of Kemp.

I’ve always said that 214 is iconic simply because of how THE BAND made it as a masterpiece. Regardless of who wrote it, it came into what it is today because of how Bamboo sang it, rico wrote it, perf played it and of course the base and the drums that are less highlighted. If this conflict is true and not just some marketing strategy for the upcoming concert (which I really still hope is just what it is), this is truly disheartening. In general there is I think an unwritten rule that, musicians support fellow musicians. I've experienced this first hand, ages ago when I was part of a performing band. When we played in productions/shows especially in bars, fellow bands support and route for a each other. For example, when one band is playing, as much as possible others bands listen, or if some band member has a problem with his or her instrument / gear, members from other bands lend or help fix the problem. In short, musicians have a spirit of brotherhood among each other and if fellow bands practice this, the more should fellow band mates do the same thing. I hope sir Perf and sir Rico settle this with as brothers in music soon (or eventually reveal that this is just a stint for their upcoming concert, * fingers crossed*).

I was somewhat uncomfortable with the idea of a reunion concert without one of the original members specially the one who is abcent contributed 3bhit signles and 2 iconic guitar solos. The final song is a collaborative work. The first written one was not the same as the final work. Perf, Bamboo, and Nathan were not there when the lyrics were composed, but that composition was not the song we heard. It is the collaborative work of the band that we heard and learned to love.

How about the fact that perf didnt play the pinch harmonic sa solo? It is a slight variation from the original recording. Pwede ba gamitin yun na defense sa copyright claim?

this is exactly what I've been saying. Perf is specifically targetted probably due to personal conflict within their group. It's petty. I can search on youtube "214" and it will give me loads of home videos of people covering the song. What perf did was basically a cover performance just the same. So bakit si perf lang ang may takedown notice. I do believe rico is within his rights to do it but that doesn't mean he should have. Perf did contribute to the song after all and out of respect and personal code of ethics should be given freedom to cover the song so long as no malice is intended to slight it and it's composers.

The bottomline their is Rico Blanco is q bitter, selfish who think he must only be the most intelligent on their band so he doesn't want somebody to overcome his talent. Let's say for instance if Bamboo and perf did not ever joined Rivermaya and it was lead by Blanco and they will sing 214? Will that song became iconic? I don't think so. He should remember also that they developed that song not he alone. Rivermaya is nothing without bamboo and perf that's all. And Rico Blanco is nothing without his bandmates.

I’m not a copyright lawyer but I am a songwriter. Pasensya na po sa haba nito but I wish to share my thoughts:
1. Magkaiba ang composition sa audio recording. The rights to a composition are controlled by a music publisher; the rights to an audio recording are controlled by the record label. When it comes to copyright registration of a composition, dito sa Pilipinas, sa pagkaka-alam ko, ang nireregister mo ay melody and lyrics. So kung melody at lyrics lang ang pinag-uusapan, at kung yun ay gawa ni Rico Blanco, siya po ang composer.
2. A guitar solo, bass line, drum fill - lahat ng yan ay bahagi ng audio recording, hindi ng composition. Unless of course the contract signed by the band members states that each member is to be given composer credits because of their performances. Ano ba ang nasa kontrata nila? Hindi natin alam. We may be of the OPINION that each of the band members deserves to be credited as composers of the song because indeed, all these instrumental performances on the RECORDING do add to its beauty. However, opinions don’t matter. What matters is whatever is stated in both the label contract (for the artist/s) and the publishing contract (for the composer/s). If there is no dispute as far as the ownership of 214 goes, and if only Rico has been receiving royalties as a composer, then malamang siya nga lang talaga ang composer, wala nang iba.
3. Assuming Rico controls all rights to 214, he has the right to allow or prohibit the usage of his composition HOWEVER HE CHOOSES. “He hasn’t stopped the bassist and the drummer, can he stop Perf De Castro?” YES, HE CAN. That’s how it is with copyright and intellectual property. You get to decide who uses your composition and who doesn’t. You can call him selfish for enforcing his rights, or call him inconsistent or even a bully for targeting only Perf while allowing others to use it, and we can say Rico could have been nicer. Sure. Libre naman tayong umopinyon. But none of that really matters as far as the law goes (and I kind of thought this video was gonna be about the law). If Rico owns and controls the rights to 214, sorry na lang tayong lahat. Siya po ang may karapatan mag-decide and he enjoys legal protection. Yan lang po ang magiging basis ng UA-cam in processing any take down request from a composer or publisher.
4. When a songwriter who is a member of the band leaves that band, he does not cease to become the composer of the song, nor does he lose his rights to the composition! Oh my gulay naloks naman ako sa 6:17! Since when was it ever an issue na pag umalis ka ng banda, hindi na sa yo yung song?? When you write a song, and you are recognized as its composer at hindi yung buong banda, copyright belongs to you forever unless and until you assign it to someone else.

I mean they were bandmates before, for sure every one of them spent and had fair share happy days, countless nights of work collaboration, helping each other out that eventually made this song so ICONIC, so SUCCESFUL that it literally made an impact to their diehard fans, fellow musicians, and lastly this song added contribution to our very own OPM. Can they just set this one aside in honor to the “GREATWORK” that they had done? Let the people, the fans enjoy this song without any more controversy. At the end of the day as for me, every time I would hear this entire song, I won’t say, “Oh ang galing naman ni Perf sa solo nay un, or hanep ang galing naman ng lyrics and wordings ni Rico.” Hindi eh, what I would say, “ang aling talaga ng “RIVERMAYA….” Ang galing “NILA…” I would count them as one RIVERMAYA band. I don’t know about the technicalities, but I guess whoever will play their songs in the future whether new generation or not, it would be like a tribute to them because the fans knew that it was originally theirs. I hope this issue will be settled amicably para everybody happy….

Hello, sir. I also have a band. Our vocalist, even if he's the principal song writer, put us all four in the band as song writers of our songs since we started our band in the late 90's (and we're still active, digitally, by the way). Is this a good practice, especially learning from what happened to Blanco v. De Castro?
Well if youre a greedy start to copy rigth it with you now since your bandmates hadnt occur to their minds that owning a song migth migth earn you a buck in sueing your fellow bandmate in performing your collab songs.. hahaha..thats called pambuburaot by the way..
I call it the "Van Halen" principle. Even if only 1 composed, they put all then band members. It's good. For band unity and future considerations.

The melody the lyrics belongs to Rico Blanco. Maybe if we try to understand it if Rico did not composed the melody and lyrics siguro wala ding guitar solo. Pero kahit walang guitar solo 214 is still 214 the lyrics the melody and the intro. Opinion lang, i dont also agree with Rico for taking down Perfs live kasi may hati naman sya sa kita, kasi kung ganyan wala na pwedeng kumanta ng songs ng mga artists via live kung everytime mag live eh kina copyright. Both of them has the right because 214 it was released under Rivermaya and not under Rico Blanco and both of them are the previous member of band. The sole owner of 214 is Rivermaya.

We want to see perf in the reuinon but i think the reason na hndi sya kasama was he had then beef with the maya's managers or owners back then thats why he left.. on this copyright thing perf had a vlog back then about it the copyright issue.. i dont think that theyll go far with this..

Perf should go to court to contend that the guitar solo is his composition thus he is a co writer and should recieve royalties for it. In the 60s a british band called Procul Harum had a hit song called A WHITER SHADE OF PALE. it was composed/wrtten by Gary Booker. A founding member, the one who played that iconic Hammond organ intro sued in The House of Lords ( britains court ) for equal co writing ctedits. He won. Given monetary compensation and continue to receive royalties. .Perfs guitar solo is integral part of music therefore, he IS CO WRITER not just RB

@@TheDeanLawChannel yes Sir and im not a lawyer. Im just a person who might be called a Musicologist. I study Music, i love music, the bands or the groups, all songs, anything related to them.. Bands are Corporations actually ( im not sure about Filipino bands ). The case of Australian group called The Little River Band is an interesting study on how all orig members LOST their name. They can not use it even if they FOUNDED the band, wrote all songs, sang them, played instruments . I just added this comment bcos i read that RIVERMAYA name is owned by someone not the members

I am still confused. There are many parties I can see, the author, the band, the recording company. Who among these 3 has the legal ownership of the song? If it is the author, does it mean he can copyright strike the band (after he left) or even the recording company or other previous members of the band?
ok, technically Rico Blanco is the composer. As to "owner", it can be muddled. Bands, early in their career usually transfer ownership in the "recording agreement". He can always claim copyright. YT is not a court and they will just side with whoever claims the loudest

Thats right Atty. the selfishness of Rico Blanco is the issue in this matter. They both share the copyright ownership of 214 hence Rico has the most power to sue 3rd party in legal issue using the 214 but untoward to Perf de Castro.
