Can people claim that you “violated” a restraining order when you were just walking/talking in your house? Psycho downstairs neighbor filed a restraining order on me to control what I do in my home. I did not contact them

    Here's a weird question:
    1. My wife filed for an order of protection because I blocked my mother in law's phone number from calling our home phone, and my wife won: I was ejected for 1 year.
    2. For the move-outs, i.e. to get some of my stuff, her lawyer said I could pick up my stuff at 8 AM two days later. It was all set.
    3. I showed up at 8 AM and my wife was outside and saw me, I saw her, and left.
    4. My wife's lawyer then claimed I violated the OP.
    5. So my question is: can I sue my wife's lawyer for malpractice?

The court informed me that my stalker refused to sign his NCO..why is that even a option?

Hello. Sorry to hear about your stalker. The order would be valid even if the stalker did not sign if the Court gave the stalker notice. Not entirely uncommon that people refuse to sign things. A signature is proof of service, but usually there is a court docket or recording that will satisfy that. Get a copy of the order and see what the Court wrote for service. Thanks for reaching out.

What if there is a no contact order in place, but the couple decided to text one another shortly after the accused bailed out from jail. Let’s say there’s a no contact hearing coming up… will the prosecutor (without permission of the victim or respondent) or state attorney LOOK UP those messages?

What I’m trying to say is, the victim and the respondent did in fact text one another to make sure each one is going to counseling and prepare to make sure this doesn’t happen again. Will the prosecutor (even though the victim never asked for the no contact order) investigate and look up to see if the couple texted one another?

@@ChristisLord553 thankfully the no context was lifted about 2-3 after I first wrote this message.
