    Paralegal for a defense attorney for 20+ years here. I have noticed a significant change in our clientele's mindset as opposed to clients of times past. People usually know they screwed up and/or made a mistake. It seems like our clients these days cannot ever take any level of responsibility or accountability, it is always someone elses fault. It is frustrating to say the least. Regardless of all the negative connotations out there regarding defense attys, their job is not to get ppl "off" or "out" of their bad deeds. Their job is to make sure the law is followed and that LE has done their investigation properly in obtaining their evidence and ensure everone is treated with respect and dignity in prosecuting defendants.

      I will never forget what the public defender said while chatting during a hike. I'm sure I have it slightly wrong, but basically, he said that he knew they were guilty of something, just not necessarily what they were being charged with. That he and his staff try to get them the best outcome they can, and that often involves rehab, counseling, and other support because so many of the crimes are crimes of poverty and substance abuse.

      @tiktokjourney8472 Mental health and substance abuse. What is super sad is we don't have proper rehabs or mental health facilities and utilize the prison system to warehouse all these ppl. It is a terrible state of affairs.

    What I can't comprehend is why people not only decide which orders they're going to follow (if any) but feel entitled to make demands on officers and insult them.

    I remember asking a cop about whether or not radar detectors were legal in the state that I live in back in the 90s. His response was that they were legal, but if he pulls someone over with one, he'll write every ticket he can and cut zero breaks. Similarly, you may have a first amendment right to say just about whatever you want, but don't expect the interaction to go well for you if you do.

      @@sascandave That's why discretion exists. It's not about hurting feelings 90% of the time (not that there aren't cases of that, there definitely are), it's about the cop discerning whether or not the offender is remorseful in their actions. A mom with a child in a minivan who's apologizing and showing that she understands what she did was wrong is infinitely more likely to get off with a warning than a whiskey tango berating the cop for pulling them over when they were only doing ten over.

      I had the same conversation with a different cop in a different state. His postion, "If you have a radar detector, and still get caught, you were either unsafe, not paying attention to your driving or the detector, or incompetent, unable to use your car or radar detector correctly, so I'll write everything I can find."

    Just wanted to add something to the mention of the 1st & 5th ammendment rights. When the law gives allowances to officers and court officials to use their discretion regarding certain matters, if you've been calling them childish names, yelling and insulting them, how much do you think they would be inclined to help you at the times they have the power to do so? If they have actually done something wrong there are channels to go through. Venting at the wrong time can do nothing for you.

    Almost every attempt to force control of the situation from an inappropriate position results in a further loss of control as worse consequences are levied. Overarching lessons are to not let your emotions drive your behavior, don't display malice towards the system, and don't offer any information that isn't immediately essential or required by law. When you decide to draw cards in a game of legal poker you just need to play the hand (with the help of a lawyer naturally), yelling at the dealer and arguing the cards won't help.

    watching a video of karens (no lawyers) thats assult, thats battery, hat donsen't need a licens its a bike.
    This video has just calmed me and also helped me with resisting the urge to punch the screen. Great vidios keep up the great work.

    I watched the full video of that woman who was texting while driving (then lied about it). I have watched a whole lot of videos of people being stopped by police, and I don't think I have ever, ever seen anyone more obnoxious.
    Notice her little "okay" when the cop mentions the judge will love to watch his body cam video. That was her little "oops" moment. Loved it! But it wasn't as delicious as the cop responding to her social media rant, not counting that five years after the fact this still keeps popping up on social media. However, my little finger tells me that she has not changed her stripes, maybe just her approach when approached by cops.

    I think many people forget... just because we CAN say whatever we want, it doesnt mean we are free from the CONSEQUENCES of those statements. 🤷‍♀️ We still need to use discretion and wisdom as to whether those things SHOULD be said.
    But yeah... sure is entertaining in these cases. Haha!!

    I don’t understand why this is so hard for people. The first time I was ever pulled over was when I was 19 doing 45 in 25 and was nothing but polite and got a written warning. Police are more than happy to give you a warning if you are respectful.

    A question similar to using a mobile phone while driving: With the new electric vehicles coming out with massive iPad sized screens (tesla, ford, rivian, etc) The only way to adjust the cabin temperature, and honestly most things in the car, is through the touch screen. Since this is a device that could take your eyes off the road, are there laws/restrictions around using the giant screen while driving/sitting at a stop light? Thanks love the vids! ✌️

      Here in Illinois, the law exempts devices that are connected to and integrated into the vehicle.
      So, it’s perfectly legal to touch your massive iPad sized dashboard while driving, but not your phone.

    I just looked it up and in Alabama you can use a cell phone while driving but you must not be texting. But TEXTING is defined as doing anything with texted based data which would include reading. And I expect it would include finding and activating the icon that starts voice to text and probably finding the icon that then sends the text.
    So you can use the phone for directions, as long as it was programmed when not driving!

    60 days for swearing is just out of order, by all means lock him up for 24 hours and get him back into apologize, but the judge in this case was over the top.

      Completely agree, I get the judge probably planned to let him go after those few days regardless but the thought that hurting a judge's feelings can have such bad consequences is awful

      I've always wondered how cussing at a judge or government agent and being incarcerated for it is legal.
      I mean what happened to the 1A where you have freedom from repercussions from the government for free speech.
      Note, I'm not an attorney, just curious.

      That's very often what happens. I'd be very surprised if he wasn't brought back before the judge after a few days and get an opportunity to apologize. Judges do that. The threat of another 119 days over his head when he talks to the judge again the next day is going to make him very polite. (unpaused the video and it said exactly that, he was released after 4 days).
      As for freedom of speech, that's not at issue here. You are totally allowed to publicly claim that this judge is a cunt. It's saying it while in court that you are not allowed to. You do not have unfettered freedom of speech while in court.
      1A is generally not absolute, either. There are many restrictions to it. Defamation, making false declaration to law enforcement, death threat, incitement, counterfeiting money, soliciting prostitution, blackmail,... and so on. All of these are kinds of speech that are forbidden.
      Many other amendments have exceptions too. You have freedom to bear arms except for arms that are restricted. You can vote, except if you're a convicted felon. Involuntary servitude is illegal, except as a punishment for a crime. Your property can't be searched nor seized, except through a legal process when the law authorizes it.

    People don't know about the 5 mile rule. Stay five miles away from leos at all times. If you don't break the law, you probably won't attract attention. And when confronted, learn the five most important words, am I free to leave? Then leave and quickly get five miles away.

    It's like these people came here from another country a few hours earlier. You rarely see a judge gavel down someone, especially within the first minute of testimony. The politicians should have just taken the ticket and held it up and said "see I'm a normal person like you" it would not hurt his campaign. The woman in the white SUV should have just taken the ticket and debated it in front of a judge and not with the officer on the street, which the cop said that she could do. And when you're in jail already after violating probation from a previous charge, pissing the judge off is probably the worst thing imaginable that you could do. And yes Ken's and Kevin's are the male version of a Karen or a Ms.anna.

    19:05 this is one I feel bad for it because if you were told you had certain charges and that's where you were getting prepared for and then you come in and then it's completely new sets of charges you getting bonded for most then, people would be pissed. Still stupid decision but really understandable to be upset and 60 days is kind of a lot.

    I wish cops were able to write 1000x more texting & driving tickets than they do right now. I saw someone in the next lane texting on their phone and steering the car with their knees going about 50mph. These people are a danger to literally everyone else on the road. I see people texting and driving pretty much every single day I'm out driving around.

    The DDT videos are so good. So many "average" people have such limited interactions with the legal system that they don't have an understanding of the nuances of the legal system. Derek and DDT help change that. Also, videos like this one are fecking hilarious to so another big reason to watch! Zoom clients - hahaha.

    20:03 man when people talk back to the judge w even one word they can be held in contempt immediately. Yet when someone berates officers for a half hour or more w everything you can think of even physical battery the cases get dismissed or they get a slap on the wrists etc. Citing that all that is part of an officers job & should have thick skin etc etc etc. Basically officers are verbal punching bags for anyone & it’s become acceptable & there’s very little that’ll be done.
    Judges get away with so much in court from having very bad attitudes to giving contempt charges for months at a time but if done by an officer would have them in the chief’s office suspended w o pay

    Driver Defense Team how do I handle having neuropathy if ever asked to do a field test? I fall over just by putting my head back with my eyes closed. PT showed me this and it is because my balance is by my vision, and not by my feet.

    4 days in jail with murderers for swearing seems a bit rough to Should be 1st thing a warning. Then a day, 2 days, 4 days etc. Its ridiculous that someone is in jail for swearing.

    Cell phone are so personal to us because we have ALL of our personal info on them these days. The calendar with doc appts birthdays and other. Phone book with our friends’ numbers. Perhaps downloaded documents of a personal or even legal nature. To give up a cell phone is to open your entire life up to the govt entity.

    Derek, could the guy have a real argument if he answered like this at 18:16-- Congress shall make no law...abridging the freedom of speech. The SCOTUS has time and time again determined that vulgar/offensive language against the government, which you are judge, to address grievances is legal and shall not be infringed unless they are fighting words. However, if you believe that what I said are fighting words, then you must ask the prosecutor to open a case rather than you violating my 4th, 5th, 6th, 8th, and 14th amendment rights. This is not a dictatorship whereby they government gets to lock people with murderers and rapists because he is offended by the speech. In fact, there are judges who have in fact given less time to rapists and batterers. If you consider what I said equally as offensive as rape or a politician battering a journalist, then you must remand me for a new trial.

    Cell phones. Yeah, I often leave my phone in the car. That's if I remember to even bring it with me, that is. I'm just not that attracted to my cell phone. I'm usually the only person sitting in a waiting room without my face buried in my phone. I once was reading a text message and walked into a pole and got a small laceration to my forehead, so I definitely don't try to walk and look at my phone anymore, lol. I've needed my phone only to realize it's at home or in the car. So I'm a weirdo, I guess.

    Wait, is it legal to use your phone at a stop in Illinois if you're in neutral? Moving in neutral? In a manual transmission car when you're below around 4-10 MPH you're normally in neutral as you come to a stop.

    The first amendment says you have the right to speak, not that you have to speak.
    Also, if you are unsure whether somebody of authority, like a police officer or judge, can do something, assume they can. Voice your complaint then shut up and do it, as long as it's safe and reasonable to do so.

      They say you have “freedom of speech not freedom of consequence of speech” but that literally means you don’t have freedom of speech. That also means every country has ‘freedom of speech’ which is also not true. I’m not sure how people don’t even realise that

    I'm very confused by the Courts Contempt Powers and how they apply to the First Amendment and I'd like to hear your opinion on the subject if you don't mind. Both Cops and Judges are considered part of the Government. The Supreme Court has long held that it is legal to call a Police Officer a "cunt" and not be punished for the speech alone as it is a First Amendment protected activity. You call a Judge a "cunt" however, and you will be immediately found guilty of Contempt and punished. I think both are in bad taste and shouldn't be done, especially to the person responsible for whether or not you end up in jail, but both are protected by the First Amendment. The statement does not rise to the level of Threats of Violence, Violence itself, or so called "Fighting Words". Why is it legal in one and not in the other? Why do you not have a Sixth Amendment right to plead "Not Guilty" to the Contempt charge and have a Jury Trial on the Contempt charges themselves?

    19:00 this should be considered an absolute legal abuse of power that this is allowed that a judge can submarily sentence someone on contempt of court without trial without jury. Also revoking a person's bond because of allegations they have not been proven guilty of should be somely illegal as well because it allows the prosecution. Essentially, if someone is on bond to have that bond revoked with charges, they know will immediately get dropped but that initial bond will not be reinstated. Therefore, forcing the alleged criminal to not have access to the resources they had prior while they were on bond and therefore diminishing the ability for them to defend themselves or be defended by an attorney and judges should not and any way shape or form be allowed this power

    14:15 you know the law can say all sorts of things about she needed the citation or whatever. But as soon as she said that the child had had an accident and the officer did not allow that child's welfare to be taken care of in that moment. He was immediately guilty of child endangerment for forcing that child to sit in whatever mess they had just made in, presumably their pants, presumably of either you're in or fecal matter

    I mean... 120 days for saying "C*nt" is really excessive. I know it's not the type of language you should use in court and it should be punished, but like... people who attack the defendant after the verdict because they feel it is too lenient get less than that. The judge was either PMS-ing heavily or there was a history to that case or that defendant that made the judge have a short fuse in this particular circumstance.
    [Edit: But maybe that's just because I watched a lot of australian TV lately, so "C*nt" kinda has lost any meaning for me as it is used as punctuation down there...]

      He got out after 4 days but i 100% agree. Swearing and you get thrown in jail with murderers is ridiculous in my view. Should have been a warning for saying it first time and nothing more. I swear fluently and having to spend time in a cell with a murderer because a judge did not like my langauge, wtf..

    Honestly 120 days for contempt of court for a 1st Amendment protected activity should be considered cruel punishment. That is complete bullshit for "addressing his grievance of a government authority", complete bullshit. Another example of boot licking from ya'll.
