These name/word lawsuits never hit hard unless the company accused bends over. Look at Hello Games with the word "Sky" being used! Google caved with "sky drive", but Hello games just said no! And case closed! Copyrighting words and Sueing people doesn't go well together. The word Blade and Stellar have existed a long time. You can make a trade mark infringement lawsuit, but that would require them to either just pay a licensing fee or change the name. The only way they get away with Sueing them is if they knew that the term "Stellar Blade" was used knowing someone else was using it. It's easy to disprove something like that because you just don't know what you don't know.
They also waited till just under a month from launch to tell shiftup about the case to. you have to give companies more notice than that, plus his store title wasn't even trade marked so there's nothing to infringe on.

I've noticed at the moment you have Bungie being sued by a dude from louisiana saying the Red War story was stolen from his book he never released, and now Shift Up being sued by a company who is just some self employed dude trying to make a quick buck cause his filming has been trash. I would know cause I live an hour away from where they state their "Film Studio" is at and no one around here knows who dude is. Some more info: He is the only employee of his studio, his companies LinkedIn has only been up for 4 months, the company is marked as Freelance, their entire website is made with WIX and looks like a basic thrown together portfolio of a recent college grad, their "work building" is inside of a local post office, and at the moment of writing this they have like 6 actual reviews of generic "They did a great job on these photos" type stuff. Also, his so called livelihood must be terrible if he had this company for a so called "10+ years" and it has 6 reviews and no one recommends him.

Actually graduated from law school (not in the US) but if the laws regarding Trade Marks and patents are similar his company may actually have a case as I remember one of the biggest questions was does it cause confusion. The google search alone could possibly show that it does. God bless everyone.
The fact that this case is so similar as Take-Two, the publisher of rockstar filed a lawsuit against Hazelight Studios and Electronic Arts that making a game called it takes two.
Depending on how well or distinguish the one word company is, it could technically win the lawsuit. Because if his company is well know in his state/area, then it would be a trademark brand/icon, even if it wasn't filed. Don't get me wrong, i can see the cashgrab thing, but I also know lawyers advise against trademarking, unless you know you're going to actually make serious money etc. normally it's when you're like more stable and no longer a start-up business.
Platinumed it in June. Just now learning about the summer event. Needs a progress select option so I don't need to play half the game again or keep the progress paused to enjoy events.
i got a question, i played the demo for the game like it but dropped it after they anounce that they were essentail gonna cencor the game. but my question is did they leave it at that or did they put it back to what it was before int the demo and promoted as?
It's actually easy to imagine the devs were unaware of the studio if theres no trademark when they changed the name to Stellar Blade. I imagine big companies probably do a search in trademark databases rather than google. If nothing came up, its fair game. And since the film company made the trademark AFTER the game trade mark, theres just nothing to stand on imo.
Clearly, I need to get back to playing this game. I seem to have missed quite a bit, and have been procrastinating on finishing or even playing the game since there were other games I have been either replaying or finishing and buying new ones. Man, I’ve been living under a rock.
Will they ever allow you to go back to areas after beating the game without having to keep doing new game + for new outfits, updates, and such? I have nearly every outfits and such already, but sucks having to make a new save when I want to see events or get a new skin. LOL
They don’t own the name stellar blade it has nothing to do with that business. Its a game and has a space. Alot of logos are similar and so that shit does not matter unless its exact same.

This just seems like a case of jealousy.
A similar photo mode could have been there from the very beginning. Nothing special. The important thing is that I didn’t notice that it was possible to control the character’s skeleton. But it’s not difficult to give the player the opportunity to control IK\FK, but they didn’t do it.

I don't think shift up has much to worry about. If anything stellarblade should be praising shiftup cause without stellar blade they never would've been noticed. Hell I look all over the place for them and I've never heard of these people till they did this shit, plus using IGN as a source. Really they're at best the easiest way to lose the case cause IGN has done nothing but send hate and racism towards shiftup.

In the first place, it's a company in a different field. The same name does not matter. Just like a restaurant could call itself "Apple" and Apple (the tech giant) wouldn't have a case against it. That's because restaurants are not part of their business portfolio. Now, trademark would indeed apply regardless...but trademark is NOT just the name. Please do not imply it is. I could make a product (non-game!!!) called Stellar Blade and, assuming both sides had unlimited money, I would win in court. A trademark only applies for the ENTIRE artistic value. That means that the name Stellar Blade is only trademarked with the exact font, in exact style and colors that were in the trademark, and ones that are extremely similar to the point of being misleading. It does not apply to the combination of words 'Stellar Blade', but to the GRAPHIC of words "Stellar Blade" that it was reported on. That is how a trademark works.
And now ...I want a pizza-slice flotation device. The Louisiana SB business bringing a suit has some standing for compensation, or possibly a free re-branding on Sony's dime. But the requests they're making to the court are silly. And it's 100% possible that Sony missed it. I looked up the company, it has 1 ("one") employee, zero ratings with the BBB, and it's an LLC. Even if you lived in Covington Louisiana, you've likely never heard of it. Looks more like an approach to income tax calculations than a business.

They say they they want compensation for “damages” but we all know that once it was reported that the game sold over a million copies that they just want to try to get in on somebody else’s earnings because they’re just jealous. I really hope that if any judge actually takes the case they just open the file and laugh
I don't like when a UA-camr tells me to comment something. I have to do it this time though for one simple reason. Lily is cute.
Lily might be the goat, but she needs more outfits.
Sorry rebirth, sb is goty for me, and waifu of the year ofc its eve.
I second that
I just started playing Rebirth. Now I can compare. I think SB will win though..
@@duannehaughton4893 most of us our goty is SB, but it get snubbed at golden joystick awards which is absurd. they even ignored wukong.
@@b3nt0t They're ignoring the majority of the games that ignored DEI that means stellar blade, wukong and first descendant are being ignored. FF:Rebirth might get nominated simply cause they did bend the knee for censorship but it's not gonna win. If anything the winner will either be Hades2 or pending on launch dragon age the veilguard, honestly I wouldn't be surprised if KTJL and concord get nominated and beat FF:rebirth cause they're along with the other nominated are flooded with DEI trash.
Ironically, now when you try to use search terms to specifically bring up the film company, all you get are results about the case. They've made it even more difficult to find them.
Lily is so cute ❤ I wish we get to control her in Stellar blade 2
Where did you get the bathing suit at 0:33?
Oasis, Great Desert where the section is ironically. First you need to have access to the area so complete Matrix 11. If you already have and started either Eidos 9 (90%+ Lily Affinity) or Spire 4: complete Spire 4 first. Either way use the phone booths (if earlier than Eidos 9/ Spire 4) or the Tetrapod (if Spire 4 is completed do not pick The Hive, choose- Travel to another location) and go to the Great Desert. The Oasis is just across from the Tetrapod in the Desert.
Next, make your way to the hut along the water edge and you meet Clyde. If not done so before, he ignores you so pick up the rod and catch one fish (open Settings - Accessibility and at the bottom toggle Fishing Controls if you struggle). Then he talks to you. This and the second outfit are about 1k Fishing Score each but there are sunglasses as well for about 500 Fishing Score. Talking to him after landing at least one of every fish gets a comical cutscene and the Ocean Maid suit which you hear the FreeStellarBlade idiots complaining about constantly.
@@claudijatzandrapova3347 Awesome! Thanks so much for the instructions!

@@claudijatzandrapova3347 Thanks!!
Some more info:
He is the only employee of his studio, his companies LinkedIn has only been up for 4 months, the company is marked as Freelance, their entire website is made with WIX and looks like a basic thrown together portfolio of a recent college grad, their "work building" is inside of a local post office, and at the moment of writing this they have like 6 actual reviews of generic "They did a great job on these photos" type stuff. Also, his so called livelihood must be terrible if he had this company for a so called "10+ years" and it has 6 reviews and no one recommends him.
This is going to backfire sooo hard for this court case...
Well any update for stellar blade gonna have to wait, bc i have about 100 and some GB left from my month Hotspot and im saving it for DragonBall sparking zero tomorrow at 6pm when it opens to download, i love stellar tho, havent finished it yet tho
DB sparking zero is only 26 GB. That image of 100 gb is fake. 😂😂
Stellar Blade put Stellarblade on the map for sure lol
This also happened to a company called Threads which was supposedly a Slack replacement. When Meta released their own Threads, it ate the other Threads.
Sue happy people and lawyers are one major reason the world is so screwed up.
Lily IS cute. Eve is FIRE though.
ShiftUp: already trademarked Stellar Blade's name & logo before the game even launch.
Some random 🤡 company: *release a game with copy pasted name and then claims that ShiftUp stole both the game's name & logo MONTHS after ShiftUp's Stellar Blade release* SUE!!! REEEE!!!
Actually graduated from law school (not in the US) but if the laws regarding Trade Marks and patents are similar his company may actually have a case as I remember one of the biggest questions was does it cause confusion. The google search alone could possibly show that it does.
God bless everyone.
Lilly is cute!
Squishy physics, improvements to wind physics and what's looking to be a kickass photo mode. Hats off to these developers 😁
Platinumed it in June. Just now learning about the summer event. Needs a progress select option so I don't need to play half the game again or keep the progress paused to enjoy events.
they're going to drop it with the finished near crossover that's what they're waiting for we all now that
The squish physics is going to make these feminists and woke Twitter freaks absolutely livid. Good.
Finally a game dev that understands that a Balance Patch is all about buffs and not about nerfs :)
Tassi was probably foaming at the mouth with excitement at the idea of Shift Up getting sued.
They should’ve reverted some of the older outfits that people were complaining about due to censorship
They did genius
@@Drawnartistno they didn’t the costumes that were censored upon release are still censored
There’s better outfits anyways
So, are they gonna change the title back to Project Eve?
The photo mode might be equal if not better than the one in Cyberpunk 2077
This is like when the town of Batman was suing warner bros because they were making a batman movie.
Should I play this game from the physical disk first without updating, then in new game + I'll update the game to enjoy the new content?
Twitter is gonna burn when they find out stellar is making eve even sexier than back when they tried to cancel stellar blade
Some dude of a company no one heard of: "They stole my name!"
Sony/Shift Up: "who?"
i got a question, i played the demo for the game like it but dropped it after they anounce that they were essentail gonna cencor the game. but my question is did they leave it at that or did they put it back to what it was before int the demo and promoted as?
How long for PC Release Date?
It's actually easy to imagine the devs were unaware of the studio if theres no trademark when they changed the name to Stellar Blade. I imagine big companies probably do a search in trademark databases rather than google. If nothing came up, its fair game. And since the film company made the trademark AFTER the game trade mark, theres just nothing to stand on imo.
Clearly, I need to get back to playing this game. I seem to have missed quite a bit, and have been procrastinating on finishing or even playing the game since there were other games I have been either replaying or finishing and buying new ones. Man, I’ve been living under a rock.
Lily is cute & Stellar Blade is beautiful💫🗡️ dope update 🤙
two seperate industries this won't go anywhere
I booted it up just yesterday to check out the game again after the update and instantly noticed the difference haha. 😅
Lily isn't just cute, she's adorable!
Will they ever allow you to go back to areas after beating the game without having to keep doing new game + for new outfits, updates, and such? I have nearly every outfits and such already, but sucks having to make a new save when I want to see events or get a new skin. LOL
Lily is cute
Yes photo mode + Nier, definitely.
They don’t own the name stellar blade it has nothing to do with that business. Its a game and has a space. Alot of logos are similar and so that shit does not matter unless its exact same.
"...it's difficult to imagine that Shift Up and Sony were unaware of Mr Mehaffey's established rights before adopting their identical mark." That has to be the most ridiculous statement I've ever heard. I've never even heard of this other Stellarblade and I'm sure there's a lot of people who haven't either, then again I'm not from the U.S and Shift Up aren't either. This just seems like a case of jealousy.
I would love for stellar blade to have a story DLC. I want that outfit we wear for the final boss. I want it so bad
I hope for this game to get a sequel in the near future
lol the best part for me is that the dude’s logo for StellarBlade is “remarkably similar” to one of the loading screens from 3DO’s 2002 game Shifters.
A similar photo mode could have been there from the very beginning. Nothing special. The important thing is that I didn’t notice that it was possible to control the character’s skeleton. But it’s not difficult to give the player the opportunity to control IK\FK, but they didn’t do it.
❤ stellar blade game, FANTASTIC AND BEAUTIFUL, i only wish, I had the money to buy it, and the system, 😢 I hope I can obtain it before it goes away. My respects to those who made it. 🎉
I have to mod my cyberpunk 2077 to get moveable lights like that in photomode. Love that a game can have that kind of thing native. Still not on PC though, so guess I'll wait a while before I can play it.
the guy suing is called Mehaffey Griffith, so he finally did something wrong. lol
Lily is cute.
I think Shift Up should sue him, for the free publicity their getting and as he was in the wrong if he's using their previously trademarked name.
never heard of that company, pretty sure no one outside of that particular part of louisiana has either
4:47, yeah that'll be nice, considering I was one of the players who misclicked and got x99 of an item and used up all my currency doin so. Lookin forwards to the Nier collab, photo mode, and neat to know about the summer event toggle, since I didn't even know that was a thing.
Got this game as a present and might wait a bit to play it if the update comes later rather than sooner!
@0:56 Never really cared to spend time in photo modes in games but thats kinda cute with the poses not going to lie haha. The characters and outfits look good too - quite stylish.
Remember that one south park episode where everyone started suing each other?
The "2 worlds collide" thing is something that already happened in the NieR universe. I think the wording there is very intentional...
A website registry is not a copyright or trademark. So he sh*t out of luck.
Lily is HELLA cute! I'm surprised 3d asset companies haven't made a model of her! I'm a 3D artist using Daz Studio and have many game character models including EVE but no Lily anywhere! I've even got 2B so I've already made fanart of EVE and 2B together. Anyway, looking forward to this update.
Photomode , Koreans know what people want .
I would like a Photo Studio Mode, Where you can select your model
Guess time to rename it jiggle blade. lmao
I'm from LA and this is embarrassing. Most likely some shit-kicker low tier "company" trying to make a name for themselves.
There is already precedent for the one word two word lawsuit with Nintendo and screw attack.
