      Always! Especially in front of a judge unless the judge asks you a question; even then I always look at my lawyer and whisper in his ear and say “what do I say? Should I answer? Or whatever, but NEVER say anything to the judge. Don’t make faces, don’t shake your head in disgust or any nonverbal gestures. Always ask for a lawyer guilty or not

      Given what he knows he's facing by accepting a guilty plea, he's probably willing to take that chance if it means even a slight hope that he could be acquitted and retain a clean record and firearm privileges.
      Just like chronic drug addicts, some are willing to take straight jail time over probation/rehab because they can still get drugs behind bars, and once they're out they're free to party. People like that don't want help, they want to be able to do what they want, and that's the case with this guy. He doesn't want his freedom to come with strings attached (even though he deserves restrictions for the safety of the public), so he's willing to risk a heavier sentence for the chance that he may walk completely free.

      Super common for criminals/criminal types. Super insecure and take everything as disrespect, an insult or an offense because deep down they KNOW they are worthy of scorn. So instead of dealing with those feelings like well adjusted adults (why they aren't) and improving, they turn that frustration outwardly and lash out at any perceived "slights" further reinforcing people's beliefs of them. It's a sad endless cycle.

    "I hadn't been getting in trouble for the past year". He makes it sound like its commendable. I haven't been arrested in my ENTIRE LIFE. I'm 60. Most people go through their whole lives without ever seeing the inside of a holding cell.

      well, look, I have never been arrested and I'm about your age too, but let's show a little sympathy, some people have very difficult circumstances, dig themselves into a hole, and make efforts to make better choices. Many of them fail horribly, this guy got a year of not screwing up in. You don't know him. You don't know what he has been through.

    The judge is talking to you like you're an adult, dude. When you are convictedted of crimes, believe me, would-be-employers will treat you like a criminal, landlords will treat you like they don't trust you. A permanent conviction of family violence is SERIOUS as are DUIs. Wake up! Do you really want the judge to sugarcoat everything?

      @ voxpopuval: I think the problem here is that the judge may have overdone it a bit. He made the consequences of pleading guilty sound so bad that the defendant might have felt that he was better off by taking his chances at trial. Frankly, it sounded to me like the judge _wants_ the case to go to trial, although I can't imagine why.

    This judge is amazing. He speaks clearly and honestly. He shows empathy and concideration for the wellbeing of those before him. If every attorney has half the interest in the defendedents that he does there would be a lot more trust in our justice system. Unfortunately far too many defendants arent sharp enough to get much benefit out of that conversation. Im 52 years old so my world view and years of wisdom allows me to see things far differently than a kid in his 20's.

    This is an arrogant little f'er. Getting behind the wheel intoxicated is not a mistake. Domestic violence is not a mistake. Those were choices young man. It blows me away when someone gets an attitude with the judge and they have admitted guilt! He says he will not do it again. Hold on buddy, you did do it again! You may ask how do I know he will do it again? He still thinks he is not guilty of the DV, but he admitted to it! He thinks he can control himself, but if he got caught twice, there is a 99.999% chance he has done it many other times, bud didn't get caught.
    This is the kind of guy who gets mad at the court for pointing out what he is guilty of doing. He doesn't like having his dirty laundry out in the public eye. Then perhaps you should keep you your nose clean, and don't roll around in the mud. That way there is nothing for anyone to see, but he can not do it.

      I am a fan of this judge, and I like his style of jurisprudence, but he is dealing with family assaults and DUIs, and not murder or manslaughter cases, and he does have a tendency to pontificate, so to a degree I appreciate what the defendant was saying.

    Clients who won’t STFU. I had one. He was sentenced to 18 months, ended up doing 3 years on an 18 mo. sentence! Just STFU. Don’t talk to the court unless you’re instructed. Talk to your lawyer!

      583 days for a DUI and assault? He could have pled on day 90 and either been through the deferred adjudication,

      Sometimes they have to bend the rules to maintain order. I think everyone was happy to see him leave, but there could be grounds for an appeal. In CA we’re allowed to make 977 appearances (no client present) only in misdemeanor cases. No felonies or DV cases for obvious reasons. If you’re present and you don’t behave they put you in a room with audio. In the Catholic Church I grew up in, they had a “crying room” for mums w/ babies. There’s a thought!

    I think TV desensitizes people to how much trouble they are really in. It doesn't matter what you did, you should walk into a courtroom scared as hell.

    From the point of view as a former teacher and former deputy, if I'm telling you anything, I'm giving it out straight and not sugar coating it. It might not be what many people would want to hear but they have benefited better by listening. And yes, I've been on the opposite side of these conversations and instead of getting offended, I've taken my medicine and accepted what I deserve

    The judge is explaining to you the consequences of what will happen to you if you pick up future charges if you take the plea deal. Your attorney is advising you to STHU before your hurt feelings get you into deeper trouble.

    If you don' t like the lecture, go to trail with a jury and let them sort out if your broke the law. Did the judge say the man has waited more than 500 days for this to come to trial, it is no wonder the young man thought it was no big deal. His first charge of domestic violence wasn't recent and he had forgotten his past behavior. The accused was dismissive of the charge saying he was young and made a mistake and he wasn't a bad person but didn't like the judge was lecturing him, like a criminal. His lawyer sure jump in to protect him and stop the hearing.

    Sounded like the Judge tried to talk him out of the plea deal at first. 'You'll have no rights if you take this plea deal, but if you reject it you can get the chance of getting out of it.' That's what it sounded like to the defendant I'm pretty sure.

    Crazy to see a Judge explaining the specifics of a deal and what it means and have someone get offended. Dealing with the courts and government is confusing as hell, if someone is going to take the time to break it down and explain what it means, LISTEN.
