That lawyer is worth every penny. He just saved his moron of a client from going to trial - cause from the sounds of what the judge was saying... he'd lose.
Given what he knows he's facing by accepting a guilty plea, he's probably willing to take that chance if it means even a slight hope that he could be acquitted and retain a clean record and firearm privileges. Just like chronic drug addicts, some are willing to take straight jail time over probation/rehab because they can still get drugs behind bars, and once they're out they're free to party. People like that don't want help, they want to be able to do what they want, and that's the case with this guy. He doesn't want his freedom to come with strings attached (even though he deserves restrictions for the safety of the public), so he's willing to risk a heavier sentence for the chance that he may walk completely free.

I am a fan of this judge, and I like his style of jurisprudence, but he is dealing with family assaults and DUIs, and not murder or manslaughter cases, and he does have a tendency to pontificate, so to a degree I appreciate what the defendant was saying.

In CA we’re allowed to make 977 appearances (no client present) only in misdemeanor cases. No felonies or DV cases for obvious reasons. If you’re present and you don’t behave they put you in a room with audio. In the Catholic Church I grew up in, they had a “crying room” for mums w/ babies. There’s a thought!

His first charge of domestic violence wasn't recent and he had forgotten his past behavior. From the point of view as a former teacher and former deputy, if I'm telling you anything, I'm giving it out straight and not sugar coating it. It might not be what many people would want to hear but they have benefited better by listening. And yes, I've been on the opposite side of these conversations and instead of getting offended, I've taken my medicine and accepted what I deserve
The judge is explaining to you the consequences of what will happen to you if you pick up future charges if you take the plea deal. Your attorney is advising you to STHU before your hurt feelings get you into deeper trouble.
If you don' t like the lecture, go to trail with a jury and let them sort out if your broke the law. Did the judge say the man has waited more than 500 days for this to come to trial, it is no wonder the young man thought it was no big deal. His first charge of domestic violence wasn't recent and he had forgotten his past behavior. The accused was dismissive of the charge saying he was young and made a mistake and he wasn't a bad person but didn't like the judge was lecturing him, like a criminal. His lawyer sure jump in to protect him and stop the hearing.

Sounded like the Judge tried to talk him out of the plea deal at first. 'You'll have no rights if you take this plea deal, but if you reject it you can get the chance of getting out of it.' That's what it sounded like to the defendant I'm pretty sure.
He just makes mistakes, not crimes. Repeatably. Over and over mistakes. It is everyone else is the problem, not him.
Crazy to see a Judge explaining the specifics of a deal and what it means and have someone get offended. Dealing with the courts and government is confusing as hell, if someone is going to take the time to break it down and explain what it means, LISTEN.

When you receive the huge gift of the plea you were offered, take it! Had the opportunity to stay out of serving time, and just couldn't do it.
