    FDCPA does not allow a debt collector to divulge the details of the call unless the party verifies they are the right party otherwise the debt collector would open themselves up to a 3rd party violation. Then you have people who misrepresent themselves which causes 3rd party violation caused on behalf of that party.

      Right! This is so wrong. If a company is attempting to id the debtor and they wont verify that they are the correct individual, it wont make the legal liability go away, lol. They may not receive any more calls, but that wont stop a lawsuit. What are these people thinking? lol

      correct... Frank was never a part of the deal nor was anyone told about Frank in any case relating to a bill, paid or unpaid... Its a private contract just like any courtroom. If you acknowledge participation then they can legally bind you. It's all about knowing rights cuz no ones stopping people from violating them. It's not a judges job to protect our rights nor do they have to. If they allow a breach of rights you can appeal but they dont ever get held accountable. This whole system is setup to keep the general public at the bottom unless they get up and take a stand.

      This is exactly correct!!! If you refuse to confirm the collector cannot give you the info you may need, then proceed straight to a garn

      They can’t sue you if they can’t find you. And if they did sue you and it’s not for a whole lot then you make it as hard as possible to a point where there is no point to sue you because it would cost them more.

      @@deestraight7157they just cannot garnish your wages. They would actually have to take you to court and a judge would have to decide in their favor. The key thing is challenging it. I’ve had debts sold off to third parties before and I actually challenged one before asking for verification of the debt not validation because anyone can make that up. Verification is the amount that you owe and proof of it. The debt collection agency said that it would take up to 60 days for them to prove it and literally 45 days later I got a letter from Midland funding the debt collection agency said that this debt is no longer valid and has been closed out and the past due balance is $0.00 this is a letter from a debt collection agency and this is not an attempt to collect a debt.

    I thought they were always trying to protect my information under the FDCPA regulation and they needed to make sure my debt is not discussed with anybody but me, I think is good they do that, otherwise if I do what you are telling me I would never trust this people and my credit score will be negatively impacted for not taking care of it sooner , but is a great content , keep it up

      Due to the increase of cyber-crimes, which includes social engineering, it is your right to know who is trying to contact you, and their purpose BEFORE you validate your identity. If you get your identity stolen because a "debt collector validated your info" no one will respond to you, neither pay any damages. Indians are not the only scammers in the US. And since it is YOUR responsibility to protect your data/info, YOU establish how far or close you want to draw that line. It is up to them to decide if it's fair or not, regardless

      ​@@owiepabilona4867 The FDCPA does not states or specify how a debt collector will initiate the call, or how the debt collector have to validate your clients' information. It specifies the methods the debt collector can apply to reach the debtor, i.e.: phone not before 8:00AM your local time neither after 10:00PM your local time; the actions a debt collector cannot do to a debtor such as harassment the debtor, and other key points.

    Just make sure you tell them the conversation is being recorded when you start recording. Don't ask permission, just start recording and tell them you're recording. Some states have what is called "Eavesdropping" or "Wiretapping" laws. Which criminalizes recording private conversations without the parties knowing you're doing so. If you record your conversation with a debt collector, let them know the moment you start doing so. If they tell you to stop, just tell them you'd like to have your own record of the conversation and if they don't want to be recorded then they shouldn't call you or that they should get in touch with your lawyer.

    I honestly don’t even pick up anymore, they went from calling multiple times a day, Mon- Friday, to maybe once or twice a week. 😂been over a year, maybe they’re getting bored with me.
    I will never answer unsaved numbers, so they can waste their time.

      ​@@wakkablockablaw6025 If it's not past the Statute of Limitations, you need to go to court. Worst thing is to not show up. If you don't show, it's a default judgement. Then a WRIT is issued. They then can place a lien on property or possible garnish wages or even take property to pay off the debt. If I remember correctly, a judgement is good for 10 years but they can keep extending it. If you don't have any property, they most likely will not sue. If you're on SSI, SSDI, or VA compensation, they can't garnish this income. It's protected by law.

    I say if you owe a debt even if the creditors are asking debt collections company to call you should pay off your debt cause when you needed money you got it now you should be a real human to pay it back that’s what we all learn when we were small

      Debt companies buy your debt for pennies on the dollar. You shouldn't feel bad not paying the whole amount if you are unable to. Also debt is a trap created by the elite to keep us down so get out of that trap please

      Debt doesn’t always have to be from getting a loan….it could simply be the fact ur insurance couldn’t cover the costs of a hand brace.

    Ironically that’s what I did prior to watching this video 😂 I also told them that if they have my information they can send that info to my address otherwise I told them I don’t give out personal info over the phone. It was weird receiving the call to begin with, I don’t owe anyone money 🤔

    What they should do is ask for the company name, search up the company or go to your bank and ask if the place they called from is a (LICENSED BUSINESS) Then call them back and pay your damn debts, trust me you don't want to ruin your life over small amount of money. Or else you will NEVER BE ABLE TO GET A MORTGAGE! Be smart guys and take care

    I currently work as a collector agent and its obvious that u need to give us that info, just to conitnue with the verification proccess. M y company is related to loan cars and all of that. And we ask that info for a verificatin proccess and avoid delinquent problems, Also the debt collector call you to you to make your payment or reach an agreement, we don´t want your car back in our warehouse. We only want that you to pay your due date and that´s it.

    this isn’t advised because they’ll report the confirmation of name as recent activity and then report the collection for a brand new 7 years from that date of last activity.

      @@unknown-bt5iz credit isn’t international. Other countries won’t automatically pull credit records. Although, legally you should disclose all your debts to any international banks for proper underwriting

      I'm mad this even resurfaced after watching a month ago. Yall do realize every company is not a scam company. And your receiving the calls because YOU didn't pay YOUR DEBT. We're working a 9-5 just like majority of the world. Yall think we like calling yall and automatically receiving rude and disrespectful responses from you?. Honesty as a debt collector the world Is sick and if you work in any type of call center you should understand some decency that if you don't want to talk just don't answer. But the sweetest revenge is when we have called you about the matter and yall have cursed us out or called us everything under the sun but the our names.     when you sign terms and conditions it’s in there that you give permission for it to be sold, if you payments fall behind :)

      I've never seen a contract stating that I give permission to sell the account or debt. Most of them simply say "share with a third party company" but they don't specify what company or what information they are selling. It is your right to know what exactly they are sharing, to who, and for what. That's where most of these collectors fail your claims. There is no contract between you and the collector just because the entity that you owe money "shared your info", all because that entity did not specified to who, why, what, and purpose.

      @@donaldlove4039not to mention that they buy the debts for pennies on the dollars so if someone says it’s legit no it’s not. You have the right to ask them how much it was sold for. They can buy the debt and get statements from the original creditor which they rarely do, but if they have statements of past due balance you can ask them how much that debt was purchased for and that’s when they get really nervous.

      @@donaldlove4039what you are saying is somewhat correct. I’ve worked for a collection company before and to me it’s a scam. They actually do have the right to sell the debt but the problem is that they literally write it off first making it already paid because the insurance company pays for it and then they sell it for pennies on the dollar and try to sell it for the original amount that you owed. You have every right to ask how much they purchased the debt for and the original agreement with the original creditor.

    Confirmation… I see this video here after getting a call today from a collection agency asking to speak to me & I said this is her. He said can I confirm my address I was like wait what who are u he said I said about ? He just repeated his co name I said I’m not giving you my address idk who u r. He said the name again I said that don’t help me. He asked again for security purposes & I said your security WHATS securing mine? He said u have a point then I said we are at a fence. He said look up his co & call him back with my info to know he’s legit. I looked up & was like oh no phone calling u back sir. And after seeing this im. Glad I went w/ my instincts. :)

    Any advice on debt? I had about 50k mixed in with credit cards and loans. I had lost my job and decided I couldn't pay them anymore. Screwed my credit. Now the cards are getting charged off and closed. Soon collections will start calling. Any advice

    The advice that he's giving is pretty decent and him telling you to get it fully recorded is a great idea however he's not telling you that depending on what state you're in by you have to get permission to legally recorded someone if you live in a state that requires you to ask them that question then he's telling you wrong information you end up being charged with a felony and don't even know what you're getting yourself into.

      The advice he is giving is not at all solid. He is spot on on requesting the name of the company that the collector is calling from. But the contract you sign with your original creditor allows them to hire a collection agency. Hes gonna get your credit score down to 200

      @@marjoriejune9787if they hire someone and it’s still with the original creditor then yes you still owe it, but once it’s been charged off and sold to a debt collection agency then you don’t owe the debt anymore. They can try to collect on it, but they better have everything available that if they sue you a judge could rule in there favor because if they don’t have any documentation or statements or contracts then they are screwed

    As far as i know im not in bebt ,I get debt collectors who don't ask for me by name. They said they need ssi to tell me my debt. I said no. I periodically keep getting calls.

    You signed the agreement with the creditor and anyone they name in the agreement. What they don’t name, they will generalize anyone they do business with.

      Check your state. I live in a one party state so I don't have to disclose that I'm recording. If you're a 2 party state, you have to disclose it. Tell them you're going to record anyways because they are.

I remember a debt collector out of Florida told me the same shit that I don’t have their permission due to a two party agreement and I said well I live in New York State so tough shit that doesn’t apply to me and even so I’d still record you dumbfucks

      I live in New York State and I tell them that they are being audio recorded whenever they tell me that they are recording me for business and training purposes and when I tell them that they are being recorded as well they tell me that I don’t have their consent and I tell them I don’t fucking care I live in NY state so tough shit

      I just found out it's public use. It's fair rights under public use.
      So. I can record all I want. Now or might not work in a court of law. But it will work 99.9999% of the time people.
      I have stayed recorded things from workers, agents, lawyers, everyone. And it holds them accountable.

    If a company gives its customer's account to a debt collection agency. Does the agency pay the debt to the company and chases the customer or does the company spends money so that the customer can pay it ??

      Thank you for your question. When a company turns over an account to a debt collection agency, it typically does not receive payment for the debt upfront. Instead, the debt collection agency will work to collect the debt from the customer on behalf of the company.

    Dude, that's horrible advice. Courts have upheld time and time again that it doesn't matter if you contracted with a collection agency because your debt can legally be sold.

      It's not about deserving it or not. It's about paying the damn bill, at the end of the day your credit will get ruined. Not there's, and obviously sometimes you can take them to court but the ends up being even more expensive. And if you lose say go bye to all that money and u still owe them 😬 and you'll never be able to buy a new car, apply for a credit card, get any sort of loans. And completely forgot about getting a mortgage, might as well live in a apartment for the rest of your life. 😂 So next time you owe money pay it, I promise you'll thank me later. As a debt collector I see people paying crazy high interest for their mortgages

      Some steps could be:
      1. If it is a medical bill, contact your health insurance, and file a complaint/claim.
      Then ask them (the billing dept. of hospital/ER/etc.) to send you an itemized bill.
      Look for double-charges or charges for the things they did not do for you. 80% of medical bills contain INTENTIONAL. "errors", they are hoping you won't ask about, because they don't show you the itemised bill, unless you ask.
      Ask for what discounts they can offer for low-income indiv., if that may be the case or not; ask anyway.
      2. If it is the debt collection company sending you an itemized bill, you're in luck, because that is a HIPPA violation and now you take them to court and they owe you money.
      3. Send a written letter to the debt collector/billing dept of hospital/etc., asking for the following:
      a) To put your account on hold for xx amount of days. Usually it is 30, but you can ask for 45 or 60. Even insurance claims take longer than 30 days.
      b) Ask for a debt validation letter and an itemized bill.
      c) Ask for the exact amount they say you owe them and for what.
      d) Ask for the information of how to dispute this debt they claim you owe them.
      e) Say that you do not recognize this debt. (For example, this can mean that you had insurance at the time of service and all should have been paid in full for you.)
      For future medical visits anywhere, make sure to educate yourself on the No Surprises Act of Jan. 1, 2021, where they have to obtain your consent for out-of-pocket charges, of which you should never agree to. Sign the forms that you do NOT consent. If they do not give you the forms, print them at home and bring them with you (4 pages). Otherwise, WRITE BIG AND CLEAR ON THE INTAKE FORMS, THAT YOU ARE REQUESTING THEM TO NOT PROVIDE YOU WITH ANY OUT-OF-POCKET SERVICES, WHITHOUT YOUR WRITEN CONSENT. DON'T BELIEVE WHAT THEY TELL YOU VERBALLY, GET IT IN WRITTING, because as soon as you sign, they have you on the hook. And their intake forms are ALWAYS SHADY.
      MEDICAL BUSINESSES ARE CRIMINAL ENTERPRISES AND YOU SHOULDN'T TRUST OR RESPECT THEM ANY MORE THAN THE STREET DRUG-DEALER GANGS. SAME THING/BUSINESS: ONE WITH LICENSE TO $ILL AND ONE WITHOUT.
      ER/Hospitals would say that this bill is separate from the insurance-covered one, and it comes from the "doctors" (out-of-network, type of bull$hit), and that YOU should pay it, regardless of the insurance.
      LASTLY, DO SOME RESEARCH ON THE SUBJECT AND RETAIN THE INFO. THAT COMES FROM TRUSTED SOURCES.
      REMEMBER: Most hospitals in the U.S. are non-profit and receive gov. funds. They would lie and send to collections people who were never supposed to get a bill in the first place.
      Take the time to educate yourself on the subject and trust no-one.

    Read the contract for your real original creditor. It allows them to place debts in collections.

      I do not need any help with credit repair. I forgot the number, but the little credit meter thing on Equifax is well over to the right and in the first third or half of the green zone.
      I have had two collections. One was a medical bill after dislocatiing my shoulder. This took some years, but I paid the hospital. The other was Verizon. The sales rep at Verizon lied to me and told me I had a coupon for a new phone, and if I signed the coupon, I would get the new phone. It was a renewal contract. I complained. Verizon backed her, and I will never pay them.
      I pay my bills. I will not cheat anyone. Unless they tried to steal from me, that is.
      Now, what is it you think you can do for me?
