DUI = Driving Under the Influence. It doesn't matter what kind of stuff he's loaded on, be it alcohol, drugs, or illegal drugs.
IF he just came from the hospital (unlikely in a marked patrol cruiser and with a uniform on) the doctor will most certainly have told him he was NOT to drive any vehicle until the next day.

Because the cop that arrived at the scene couldn't brush this away *knowing* that this lady's son in law, as a State Trooper, would have an avenue to share what happened - and to access the dash cam footage. For most of us, if something like this happened, we would have no one in our corner in law enforcement.

Having been in law enforcement for 28 years I have seen many deputies ruin their careers by doing very stupid things like this trooper did. Each time I’ve been on the scene of incident like this as a supervisor the first thing I did was confiscate badge ID and gun so the deputy/officer understood clearly that there would be accountability and no special treatment would be given. Losing your integrity to uphold the law you’ve sworn to uphold is something you can never recover from

I know there is an increasing outrage across the nation regarding law enforcement. I understand the need for qualified immunity just like I understand the need for social welfare. I think the issue the public (me being a member of the public) has is when it is abused. When someone is suspected of welfare fraud, the people don’t try to shoe horn in a crazy justification for it, but when public servants that cannot perform their duties effectively and efficiently without the public trust betray that trust, there seems to be an enormous amount of effort spent on figuring out how to justify it. I’m only speaking generally and I know there are plenty of agencies that do it right. My Sheriff has been in office for decades. He’s tough, but he also knows that this is a rural county and people who live here don’t move out to the boondocks to be hassled. I’ve seen several deputies get fired for relatively minor things, but He doesn’t tolerate his deputies crossing the line.
I don’t know your health condition or what demands your life has, but I think you could continue to serve your community and your descendants by finding a way to bridge the gap between LEOs and the public. The nonsense of defunding the police is ludicrous. We all want law and order. We want LEOs that want to serve their communities, not lord over them. Cops are people, I get it, but cashiers are people, too. When a cashier commits a crime, well I think you get it.
This nation could use men like you (I’m assuming that you are Mr. Cody, if not, I will claim unqualified immunity!) and fellow professionals like you that can see the direction that local and state law enforcement is headed. If things don’t change, I foresee the federal government taking over all law enforcement functions in this country. If that happens, qualified immunity will be the license to burn the constitution. I do believe OP was referring to the fact that most off duty officers (obviously this one would be off duty had he actually had surgery) don’t typically drive around their squad cars. They have personal vehicles.

@@peanutthepoodle I think you misunderstood what the cop was doing. He was getting him to calm down. A supervisor was on the way, a supervisor which was going to handle the arrest. Cops commonly talk that way, even when they know they're going to make an arrest.
He's alone and waiting for a supervisor. The cop also hadn't performed any field sobriety tests/a breathalyzer. There was a chance (though admittedly slim) that the drunk trooper maybe was experiencing some strange health related problems. Regardless, he didn't want to have to cuff a drunk man with a gun alone. I can't say I blame him either.

Admittedly a risk factor but there is also a risk in trying to remove the perceived power this trooper would have had, especially if he was possibly drunk (innocent until proven guilty). Being a cop is a hard job and they dont get the respect they deserve. Things can go sideways very fast if your not careful.
It was a very delicate situation. There was no telling what he might do if confronted before backup arrived. This could’ve turned deadly.

Imagine the paranoia and fear that goes through you when you are rear ended by a cop like that. And then to find a drunk cop with his clothes inside out offering to pay you money. He has his weapon and you cant really run because of the gun, his intoxicationt, it would be evading police and he could follow in his cop car and you would be hindered as you would be assumed to be a criminal fleeing. Scariest situation ever! I don't blame her for calling her partner first. You'd be terrified to call the cops without getting some consult. You'd have no idea what to do

It won't SOLVE anything your very good analysis showed, but, it is an option. If it is a cop he can call for backup. If he refuses you better leave in a direction toward a LOT of people and get 911 asap. They won't be happy, and they'll likely tell you you're getting in more trouble, but they will work with you. And, you know, at least if you do get merked there will be a trail for who comes next to follow.

So... this officer made ~110,000 a year at the time of the accident.. He took a plea deal for a $386 dollar fine, and 12 hours of community service. He had to forfeit his license for 7 months as well. The department gave him a 56 day suspension, and made him forfeit his personal and vacation time. Due to public outcry over this... the department forced him into retirement, where he will enjoy full benefits for a retiree from the state of New Jersey. Justice? I think not.
While any civilian does that your looking at an average of $10,000 for a dui, jail and that DUI will haunt you for ever. This guy got paid, it was probably the best thing he did, DUI for cop = Early retirement with full benefits. DUI for civilian = lose everything. It's time to hold cops 100% accountable for breaking any law the same way we are held for our mistakes.
OK, let's see now. He paid into his pension and was not fired. Being allowed to retire gave him the ability to receive his pension. It's not how you feel about it, it's what the law / regulations allow for.

How wonderful the trooper who arrives is telling his supervisor, "she already made phone calls." Wow! Is anyone investigating this entire troop for corruption?
When I tried to drive myself home after outpatient surgery the hospital called the police on me! I was threatened with being arrested if I tried to get in my car! You sign a form saying you won’t drive, drink, or make any important decisions for at least 24hrs after surgery. Thank God he hit her car! Imagine the damage he could’ve caused just coming to a dead stop on the highway? She’s the real hero!
Do you really think he was on the way home from surgery? As you said, they make sure I have a ride home before I go under anesthesia.
I think that was just the first excuse he could come up with. It doesn't make him any less liabile if true - we're warned not to drive afterwards!

I have very good friends who are LEO's, so I say this: the police need to reallly crack down on this shit. They need to hold other officers accountable and show the public they swore to protect that they won't let this shit happen. Throw the book at the bad ones so the good ones are left with at least some respect.

I'd like to know his dui arrest number of suspected dui traffic stops he had done while an officer. Sickens me seeing cops deal out those who served dui's when it's proven a driver is under the influence , give them the dangers speech them do the same thing. Working drunk driving crashes, seeing the victims impact and yet thinking because they have a badge they are OK to do so. Thankfully at this day the damage he caused was minor and he was stopped before worse could have happened. I'm disgusted by his actions and the punishment he recieved. He needs far more education classes that what the courts gave him as punishment and should be allowed to West a badge until he can prove he had been sobor for 6 months. Our officers need a higher punishment for doing this.

Alright, so technically yes he can be arrested. But it's just not going to happen, that's generally a level of courtesy exercised when an officer is going to be arrested. However, if the offense is heinous enough, the officer/perp in question will be taken into custody on sight. What they don't want is pictures of an Officer in uniform, now in handcuffs. What normally would happen is, they would have a secondary Office drive the drunken Officers vehicle back, drunken Officer would then change out of uniform and go home on unpaid or paid leave (probably paid, but it depends how much they like him) and then an investigation would take place. Most places would give him a warning or maybe even use some sort of reprimand, but they wouldn't charge him, at least not the first time. It's just the way it works, but I suppose if elige brown was a supervisor, he could arrest him on the spot. There's just protocols they follow, and most departments don't operate that way.

I usually support law enforcement BUT this guy needs to be locked up for 5 years. As an officer you are supposed to set an example and held to a higher standard. I think there should be a totally separate charge (more serious) for when an officer commits a crime.

Not sure where everyone is getting the "corruption" from, obviously this was a very sensitive situation and the Officer wanted to keep things calm. The Officer was obviously lying to the man to keep him calm, there's no way of knowing if he'd pull a weapon or panic and try to take off in these situations, looks to me like he handled it well.

I think everyone handled this very nicely. The female was very articulate, very classy, no malice, the arresting cop very calm and professional. This was handled very well up until the drunk guy almost got off lightly. Glad public outcry got the job done.. You cannot have a drunk cop with a gun on his belt.

After investigating ourselves, we found that we did nothing wrong. Officer claimed he was not drunk. Bottle cap was evidence from a non related case.

Pled guilty and license was suspended for 7 months in addition to fines and AA classes... Pretty standard for a first offense but it should've been more since he's sworn to uphold the law and knows better, in my opinion. Juris Prudence though... Judges have to sentence properly based on similar cases
