As the Republican National Convention opened on Monday, Donald Trump scored a major legal victory when a Trump-appointed federal judge in Florida dismissed the criminal case against the former president for illegally keeping classified national security documents after his presidency ended. Judge Aileen Cannon ruled Attorney General Merrick Garland had no power to appoint Jack Smith as a special counsel. Her ruling stunned many legal experts, and the Justice Department plans to appeal. This comes after the conservative-dominated Supreme Court recently granted Trump, and presidents more generally, almost complete immunity from prosecution for “official” actions taken in office. “This was an opinion in search of a result,” says Pulitzer Prize-winning investigative journalist David Cay Johnston, who has covered Trump for decades. “This is just deeply offensive, and I suspect it will be overturned, but the real result is there is no prospect that Donald Trump will be tried before the November elections.”

When someone says it is all Democracy is at stake than you can bet fear mongreling will follow. There is no threat to Democracy. If you believe what you heard last time that yes fraud takes place in all elections, but not enough to add up to anything than democracy is not at stake. If abortion is such a huge issue why did Biden and Harris not do anything about it. Most Dems and moderates including Trump would take a middle of the road approach. Trump prefers at state level, but could have likely been pushed through.

AMAZING, how all of a sudden, many of these Liberal Democrats woke the F up and actually started to notice these "JUDGEMENTS " being handed down by these judges. Just look at the location of the Judge and the Judgment, ALL in the same state. NOT like the BS judgements and INJUNCTIONS coming from judges thousands of miles away.
Trump appointed Aileen Cannon as a federal judge and she returned the favor by throwing out the legal investigation into Trump's storing of all those classified security documents at Mar-a-Lago and trying to avoid returning them to the National Archives. Call us any name you want, but many of us know that Trump's days of appointing Supreme Court Justices and other federal judges and his other ways of damaging the United States for his own benefit are coming to an end. (Unfortunately, many of the most corrupt judges will hold their positions for many years to come.)

That ruling will be overturned and hopefully it'll be the straw that finally gets Jack Smith a new judge. The appeals court in her district has ruled against Cannon at least twice on this case, and admonished her while they were doing it too. There's 50 years of case law backing up the fact that because AG's are approved by congress, they are then legally allowed to appoint a Special Council. She based her ruling on a foot note in an opinion about an unrelated case. Foot notes made by justices, who themselves have a vested interest in not being investigated for corruption by a SC, are not law.

Quantity of evidence is not the same as the quality of evidence. He had in his possession assumed secret documents that he had the authority to declassify at any time with out a process to do so. They have to prove that he didn’t declassify it, which is very hard to do when it is presumptive that he did declassify the documents.
Impartiality? Recusing oneself? Conflict of interest?

If Trump had that power, then why didn't he declassify these documents? Or did he do that telepathically? See, there is a process for that, and it must be followed. That way, our government agencies know this is no longer classified information and can take appropriate actions - like, I don't know - changing the nuclear codes! Updating war plans, etc. There is a reason for this process. But not only did Trump not follow the process, he attempted to hide these documents, pretended he didn't have them, and tried to play the shell game so the government couldn't find them. That is obstruction, and that is very very illegal, especially if you are no longer president. That is what he was charged for - it isn't the crime that gets these guys, it is always the coverup. Joe came clean. Trump continues to lie. That's the difference.

They ARE approved; by congress! 50 years of case law states that because AG's are approved by congress as a whole, they then have the ability, by law, to appoint an Independent Special Council. Cannon's ruling will be overturned by the appeals court, just like her other rulings, because it's incompetent. She took a foot note, made by Clarence Thomas in an unrelated case ruling and applied it as if it was law, when it's not.
