    Although spending > 6 months away is no longer grounds for denying a temporary renewal, it IS still grounds for denying Long Term Residence. The annulment took place the moment the Supreme Court handed down their judgement. It did not depend on publishing in the BOE. The rule was "annulled" which is different to it being "cancelled". Annulling means it never happened. Think about the difference between annulling a marriage vs a divorce. Divorce means the marriage has ended, whereas annulment means the marriage never existed. The big effect of this is that it now allows swallows to do their 5 months over winter without becoming tax resident in Spain.

      @@Upsticks I guess it goes without saying, it would need to be a pretty determined swallow to want to endure the pain and cost of a rolling NLV.

    Great channel. Do you think that there will be any leniency for home owners .
    In Spain in the future.? the present rules mean that you must keep two properties going. Before you could maybe stay with relatives or friends for a few weeks, but six months is far too long for any body.So you need to have a home in the UK also. It’s not fair as the Spanish can stay here in the UK for six months straight. That three month rule is a killer and totally messes up your life.

    What do you mean by saying it might be good for people who are not planning to get permanent residency??? Thought the NLV was about getting permanent residency. .

    Interesting Chris, how are they monitoring the dates that you are either in or outside Spain?. My understanding is the passport scans at the airport don't track that?

    I thought post Brexit it’s no more than 10 months out of Spain in the first 5 years. Is this right? Doesn’t matter to us as we wont ever be out that long but just wondered.

    Odd that a home owner in Spain has to jump through these hoops but an illegal immigrant in Britain gets asylum accommodation, benefit payments and a work permit.

      An asylum seeker is not allowed to work so no work permit, they get B&B in substandard accommodation and £8.86 a week. If you think that’s a great deal you are welcome to try living on it.

      Most aren’t asylum seekers they’re economic migrants and most of them are working for delivery companies and car wash establishments.

      You are a climate migrant (escaping the horrendous climate of the UK). 😂😂😂 I bet your home is sub 500k or else you would have been eligible for a Golden visa. So migrant. I am cool with calling the Golden visa chaps as expats. Rest of us are immigrants (legal or illegal is a separate discussion). Join the gang!

      @@Sailing_Antrice I'm afraid they do get work permits. Why would the British government be crowing about all the jobs they're going to fill if they cant get work permits? Doesn't quite add up does it?
