    This needs to be federal criminal charges, not just a lawsuit. Deprivation of Rights Under Color of Law can put the chief and others in prison for years. No "qualified immunity" available.

      Title 18 Sec 242 provides for a federal death penalty if Deprivation of Rights Under Color of Law results in a death. Don't let the judge off the hook because he was ultimately the one who allowed this crime.

    Facts: 1. Joel Ensey, who is the County Attorney for Marion Kansas, is the brother of Jeremy Ensey who owns the historic Elgin Hotel.
    2. The hotel has leased their restaurant to Keri (It was just a few drinks officer) Newell.
    3. The current liquor license for said restaurant is currently listed under Tammy Ensey, and is set to expire at the end of this month.
    4. On the surface it would appear that the Jeremy Ensey conspired with the Marion County Police Department, Keri Newell, Judge Laura Viar (Who has her own history of DUI’s) and his brother Joel Ensey, the County attorney, to ensure that Keri's DUI was hidden so that her application for a liquor license would be approved despite her DUI, and other driving violations.
    5. All of this mayhem, the trampling of our constitutional rights and the senseless death of Joan Meyer was done so that slimy people could serve alcohol.
    6. Anyone who give’s their money to the Elgin Hotel, Parlour 1886, or Kari’s Kitchen are supporting corruption and the death of Joan Meyer. RIP Joan Meyer

    I still would have their own go thru everything seized to make sure that the Sherriff or any of the police to include the KBI haven't added anything to their computers system that will allow the cops to snoop/watch what they are doing or find out who their news source/informants are that give the paper information. I hope the paper sues the shit out of the Sherriff, Judge and the town. I feel sorry for the loss of his mother, can only imagine how stressful this was on her during the last minutes of her life.

    I'll tell you, folks, Marion County is darn lucky to have a newspaper at all and to have journalists of the quality of those at the Marion County Record. We're seeing true grassroots integrity here. The main stream media can't hold a candle to these fine, traditional journalists. As far as the local police department, well, there's some jail time seriously warranted here, not least for 3rd degree manslaughter.

    First off, my condolences to Eric Meyer and his family for their loss. After that...I'm chomping at the bit...wanting to see into the future on this. Who requested the warrant? Where's the affidavit? Who gets jail time? What are the commissioners doing?

    Judge Laura Viar who signed warrant had many DUIs, once crashed government vehicle into a school building, drunk with suspended license for prior DUI.
    Police chief also have a criminal history.
    This search was the biggest mistake they made, now whole country get know them.

    When we have the FBI basically doing this same thing (thinking of Project Veritas and Ashley Biden Diary as one example), it's no wonder locals feel they can get away with this sort of thing. Corruption is rampant in law enforcement all the way to the top. If the national media were as good at their jobs as these folks, and owned by people with any journalistic integrity, they'd be acting more like Mr. Meyer and less like corporate stooges.

    I was there Tuesdays morning to express my feelings toward all the persons responsible for this criminal act. The security tried to have the state trooper charge me with a crime he called heckling. Seems marion county sheriff and marion police were uncomfortable with my 1st amendment right to redress my government in a public forum. They tried to strum up charges to silence me too. Guess i was stressing them out with my freedoms.

    I respect an old school Trekkie! Odds are they won't bring the items back. I had to go claim my own items after my brother used my computer to send a message to his ex-wife that had a protection order against him. then they lost track of it when everything was concluded. Took a year and a half to finally get it back. So sorry for the loss of his mother, I hope he can find a good attorney to sue them.

    The average person does not get seized property returned that fast. I'll also point out. Provided there was rudimentary security best practices implemented. Your local PD had ZERO chance of looking at anything on encrypted drives or phones. The KBI on the other hand has resources for that.

    I truly hope that this organization had the means, and the foresight to have a complete off premise back up of their files. This is not a typical reason to have regular back ups made, but it would’ve made a huge difference in their operation over the last week. We typically think of natural disasters, like floods or tornadoes or man-made disasters like fire or theft. In my opinion, what the police did was theft. They just use the legal system to do it. The cops in the situation where the pawns used to target a politicized personal indiscretion should we call it, to silence what should be a matter of public record.

      I was a trauma technician, and was on our on site crash team. We had a special red pager for crash calls. I managed to drop three down the john in under a month! They started charging me for them!

    Hopefully this does not stop the lawsuit. It was still an illegal warrant, and all involved are guilty of robbery, theft by unlawful taking, armed robbery, and likely RICO violations. Add in the first amendment civil suit and this department, all employees of the town, justice system and town should be in bankruptcy for at least the next century.

      We have to pay for that. I say Fire them all strip qualified immunity charge them and cage them. Sentence them under US CODE 18 SECTION 241 AND 242 DEPERIVATION OF RIGHT UNDER C9LOR OF LAW. I would say since life was lost Rest in piece then the life sentence under this statue should serve the community well. Sentence them to death so we don't have to pay for their crimes

    They rescinded the warrant for lack of evidence but why is no one asking how the warrant was issued and signed by a judge in the first place if the evidence was insufficient to begin with? The judge and requesting officer/agency need to be held to account for this or it will just keep happening. And I mean actual legal ramifications not just civil but boy do they have a lawsuit on their hands.

      I was there asking that question too. I spoke to Ksn reporter and he shared the concern. A magistrate signed the warrant based on computer fraud and identity theft. As so9n as the public gets to look at the affidavit we will have those facts. I will not rest even after the media is gone. They tried to have me arrested for asking these questions. The charge they were trying to pree on me " HECKLING "😅

You would think that they would have to have something more than just probable cause, if they even had that, to convince the judge/magistrate to sign off on it. I'm pretty sure there is a legal threshold that has to be met before a judge/magistrate can even sign a warrant. FOIA should be able to provide that info but it will cost money. Good Luck, and don't let their petty and empty threats dissuade you from exorcising your 1st amendment rights.
