I am not siding with anyone but I think you need to be aware of something. Anyone can sue anyone for any reason. Filing something in court does not mean you have any evidence or proof whatsoever. It means you want someone to either stop doing something or you want money for something they did or are doing. Thats all. A lawsuit is not proof of guilt at all. Plenty of lawsuits get thrown out every day. Defamation is very hard to prove, especially because we have something called free speech and you have the right to have a shitty opinion. You have the right to be an idiot too. You can call people names and they can sue you for it but often it will get anti-SLAP'd down. Anti-SLAP is a law that basically prevents people from suing you to silence your speech. Anti-Slap allows you to use the 1st Amendment as a defense to people trying to silence things they didnt like. It essentially shuts the lawsuit down and forces the plaintiff to pay the defendents attorney fees. Now, I havent watched his video so its possible he crossed some line but usually...it is very hard to prove defamation especially because you have to prove knowledge that it was false, malicious disregard for the truth and most importantly, because Radke is a public person and there is a much higher bar to defamation you have to prove that there was some sort of harm to him or his brand that can be quantified financially. I think Radke has a very high bar here and ultimately wants to shut him up. It may not work. Edited for typos*

Burden of proof is significantly higher in the case of libel against public figures. It’s not just saying untrue stuff, you have to be able to prove “actual malice,” meaning you have to be able to prove the person deliberately lied to hurt you. Not an expert, but seems like it might be a difficult case to prove.

If the fact that the allegations he referred to had already been concluded in Ronnie's favor, that is easy to find online, and I would think that qualifies as a reckless disregard for the truth. Trust me, I hate both of these assholes, but Ronnie seems to have a case.

This is true of any lawsuit, the entire basis for the action is damage done to a plaintiff. I sincerely doubt that he can prove that a single youtube video damaged his career when he's never been more popular than he is right now.
In Fantano's case, the malice is the EASIEST element to prove. The alleged fiction element is the 2nd easiest. Damages are the hardest to prove, but it doesn't mean he shouldn't sue. Doesn't matter how much or little he may win in a suit, so long as the life-wrecking material is forcibly removed.
I am an attorney and your assessment of the law is off base. He has a solid case against Fantano. Actually, it's pretty cut and dry. Fantano is going to live with a judgment over his head. Fantano has been playing with fire and was asked, warned, and now he can enjoy the consequences.
Maybe I've missed something, but I looked up the court documents for Ronnie Radke's defamation lawsuit against Kacee Boswell, and everything I found seems to show it ended in a judgement by default before the trial even started? Which would absolutely NOT be the same thing as a judge ruling in favor of Ronnie or definitive evidence the accusations were false. All it would mean is the defendant (Kacee Boswell) didn't respond to the suit in a timely manner, which can happen for a lot of reasons, not just because of (alleged) lying: lack of resources / money for lawyers and court costs, mental illness, addiction issues, fear, a private agreement, etc. I also tried to research the (alleged) DNA evidence, and so far all I can find are Ronnie's claims on social media but no outside corroboration? Again, if I've missed anything, I would hugely appreciate being directed to that information.
You mix up cases! Kacee boswell accused Ronnie of r*pe and was caught lying big time. There was no charges and there was no case at all! He even sued her for defamation and won! The DV is about his ex girlfriend. They had a fight about him cheating and she accused him of violence which she couldn't back up. The DV was dismissed and he had a plea deal for disturbing the peace. By the way, Kacee Boswell named her own daughter after Ronnie's daughter Willow. That woman is mentally ill!

Anyone can sue for anything they feel like in America. Winning is another matter, but frequently the lawsuit itself is the punishment. If I have more money than you and want to drag you through court I can do that, whether I have a valid argument or not. But yes, if you do your research and make a good faith effort to present accurate information then you greatly reduce your chance of getting sued.

It just means a party succeeded in a legal effort to get a case dismissed. And it also means it was not able to be proven by the accused. IIRC, that case didn't even get to trial. Legally, that's presumed innocent - but as anyone knows - the system is exploitable and anyone intimidating and rich enough can easily pull this off, regardless of guilt or innocence. I'm not saying RR is guilty, either. I'm implying we (people uninvolved and were not witnesses) will never truly know one way or another. The only thing we _do_ know is he _legally_ succeeded in the case's dismissal.

I’m 32, almost 33. Two, he would have to demonstrate damages. Have any of his shows been cancelled as a result of Fantano’s actions? Does Fantano know that what he is saying is a lie? Can it be proven? This is the standard of evidence for a normal, non-public figure. It’s even higher for public figures, of which Ronnie Radke is. Ronnie Radke knows all of this and is using the legal system as a means to bully. This is what most First Amendment attorneys would say, and this will most likely settle out of court.
The fact that Fantano deleted his tweets looks VERY bad for Fantano. And everything you said is true. However, Ronnie knows this. This is about pressure after Fantano refused to take down the defamatory videos. Also, Fantano made money from the defamatory subject leaving the video up.

I've been personally affected by someone I trusted who was close to me constantly backstabbing me to everyone they knew with full out lies for years (even if I didn't know the person they were lying to). I didn't know about any of it but at a couple of stages throughout the years I'd have complete strangers approach me in my home town and spit on me / hurl verbal abuse at me. I've been kicked out of restaurants and stores on the first visit even before I had a chance to say or do anything. I will absolutely say that the level of obsessive hatred and behaviour from one single person has changed the way that I think and behave even when I'm alone. I am certain that I couldn't handle what Ronnie has had to tolerate and I support his legal action in this regard 100%.

I'm not familiar with Ronnie's "legal" cases. But as far as lawsuits and counter suits goes. Just because things were dropped doesn't mean they are true or false. This country's law system benefits those that have money. Ronnie sounds like he has engaged in what is colloquially referred as "slap suits" where a larger person or group files a bunch of motions against smaller people and entities to the point where financially the smaller person or group has no other choice but to submit or drop any civil charges to just make the allegations go away. John Oliver did a whole episode on slapsuits and it was eye opening for me, I suggest anyone thinking Ronnie's right blindly maybe considering learning about slapsuits, including Tank here. Because I think without that understanding it is easy to be mislead on situations involving lawsuits in this country. So ya, anyone who claims those with money and are aggressive against smaller groups, education on how not equitable the courts in this country are, especially in lawsuits, it might make you double think someone like Ronnie's many stories and claims.

Suing someone for making claims that were already public knowledge, regardless of the merit of the suit, will only result in the "Ronnie Radke sues content creators" type headlines that are why my friends who don't listen to any metal know who he is and clown on him regularly. He's turned a video that would have blown over in under a week into a media shit storm. I do not like Radke but even I can admit that Fantano was probably being intentionally misleading. However even if this ends up actually going to court, freedom of speech allowing you to share your opinions in a public forum will make it hell to actually resolve in his favor. Considering I can't find any evidence of him actually taking the woman who accused him of rape to court(despite all the attention he purposefully drew to that lawsuit), I highly doubt he has any intention of doing so here. He wants the spotlight, he wants to be seen fighting back. Once the media from this settles down the lawsuit will be quietly halted. See you all in two years when he sues another guy for attention I guess.

Innuendo isn't actionable and it is a very suspect term to use in a legal filing. There could be legit complaints that a court can address but I won't be surprised if this is mostly lolsuit material. This filing - not legislation - is merely one side of the case. Never take a filing like this as the absolute truth. He did two and a half years in prison so not all of his many cases have resulted in vindication. All of the charges (and convictions) that he has picked up makes it odd that anyone gives him the time of day. If anyone does mention him, it should just be "red flag collection" and move on. He also pleaded down a domestic violence arrest to a simple disturbing the peace where he pleaded no contest, which has most of the same effects of a guilty plea. That is not drugs. He was also arrested for assault at a show he and his shit band was playing and caught a ban from the venue. Again, not drugs. No one would care about a drug possession conviction. Like I said, a walking red flag collection.

I don’t agree with a lot of what Ronnie says.. but spending time in his twitch stream he’s always been a total sweetheart to a lot people when didn’t have to be. He’s been gracious and kind to those less fortunate than him. He’s given people money and contributed to peoples go fund me for everything from cancer treatments to funerals. He’s bought setups for people wanting to do youtube fulltime. IMO he has a good heart. 🤷🏻♀️
Almost all the hate he gets is for things he did 10 plus years ago. As someone who is older than Ronnie, and more than likely you yourself, I can tell you that we are all vastly different individuals than we were 10 years prior. From what I've seen I've seen, Ronnie has grown considerably as a perso,n especially after he left prison, and has tried to be a decent person going forward. Maybe that has something to do with having a daughter too.

Im gonna be honest, i have a friend in the FIR camp so i try to just stay out of anything related to radke. Being an insufferable asshole is how Radke stays relevant. Its a gimmick to get and keep attention so people continue to talk about him. I couldnt tell you the last time anyone talked about FIR music for just what it is, its always about what obnoxious shit and behavior Radke is doing today. People just need to ignore him. He wants and craves attention and reacting to shit he does is just giving him what he wants. EDIT: People seem to be completely missing what I'm saying. I think Radke's public persona and antics overshadow his bands output and it's a problem that eventually will catch up with him. He's doing it on purpose because it gets attention on him, which in turn gets attention on his band, making them an afterthought to whatever dumbassery he's doing. It's an act, I know because I've met and worked with him on a show and he was the total opposite of how he comes across. It's eventually going to catch up with him in a bad way down the road and he's not going to be able to recover from it. It's not a sustainable way to function.

As someone who doesn't have much faith in our legal system, I don't think that being absolved in court is necessarily proof that someone did nothing wrong. Judges and juries can make mistakes. Plus, victims make SA accusations against famous people and then get threatened or bribed into silence all the time. I still think it's worth talking about those allegations, as long as you include all the relevant information.

What do you mean by "talking about those allegations"? It's not acceptable to perpetuate any kind of accusation on the internet. If somebody has some accusations, they can turn to law enforcement. The issue is the accusations don't have to be proven to damage somebody's name, however the accused isn't able to refute them. How would you prove something didn't happen? You can't. There have been too many false accusations made in last years. Accusations should be investigated, not perpetuated on the internet for eternity.
But in this case Ronnie got proven innocent via DNA testing, he went to a police station, they did the swabs on his and the Woman's areas and it was proven that there was no contact.
I have zero faith in the legal system but I have a lot of faith in DNA tests and the police swapped his entire tour bus where she said it happened and found nothing, that has nothing to do with the legal system persay, it didn't even get to a judge for that. Police dismissed the charges.

I think it’ll end up getting thrown out. Suing someone for directly accusing you of assaulting them is one thing. A music critic talking about it is different, even if he is talking shit. In order for him to win a defamation suit against Fantano, he will have to provide evidence in court that Fantano’s shit talking directly resulted in loss of income, which is not easy to do. Also, Radke straight up saying on video that he’s being litigious and will sue people who talk shit could be enough to have the case thrown out, depending on their states anti-SLAPP laws. Plus, Fantano is likely very well off financially and I would assume he has journalism insurance. He’s got the resources to fight it. I don’t have an opinion on either of the two personally, but people who abuse the legal system to bully people are straight fucking trash.
Proving loss of income isn't necessary in a defamation claim, only that the claim is untrue. Fantano would have to prove it were true. Compensation gets more complicated, especially with public figures but it is risky. So Radke could win but be awarded $1 but then Fantano may end up having to pay both sides legal costs. Its one of those journalism things were real journalists are taught that if you want to make potentially defamatory claims, you better have your facts straight. Especially if the person you've defamed can and will sue. Journalist or any legal insurance probably also wouldn't cover costs, especially if the defamatory claims have already been tested in courts and Radke was cleared. The whole point of defamation litigation is to prevent people making malicious claims. SLAPP probably wouldn't apply because its an attempt to stop lies that have previously been shown to be lies repeated. People are entitled to opinions, but not facts or lies.

Ok but here's the thing about RDJ - regardless of his past mistakes and legal troubles, I don't remember ever hearing him be accused of hurting people. He definitely hurt himself and negatively impacted people who cared about him, but there's a huge difference between having a history of drug abuse vs. history of committing sexual abuse. Given the way victims are treated by the legal system, I would really not call a court ruling proof of no wrongdoing. Not to say he did do it, but from law enforcement to judges, the system is absolutely biased against victims and rulings in favor of the accused just cannot be taken as definitive proof that nothing occurred.

I am not siding with anyone but I think you need to be aware of something. Anyone can sue anyone for any reason. Filing something in court does not mean you have any evidence or proof whatsoever. It means you want someone to either stop doing something or you want money for something they did or are doing. Thats all. A lawsuit is not proof of guilt at all. Defamation is very hard to prove, especially because we have something called free speech and you have the right to have a shitty opinion. You have the right to be an idiot too.
You can call people names and they can sue you for it but often it will get anti-SLAP'd down. Anti-SLAP is a law that basically prevents people from suing you to silence your speech. Anti-Slap allows you to use the 1st Amendment as a defense to people trying to silence things they didnt like. It essentially shuts the lawsuit down and forces the plaintiff to pay the defendents attorney fees.
Now, I havent watched his video so its possible he crossed some line but usually...it is very hard to prove defamation especially because you have to prove knowledge that it was false, malicious disregard for the truth and most importantly, because Radke is a public person and there is a much higher bar to defamation you have to prove that there was some sort of harm to him or his brand that can be quantified financially. Burden of proof is significantly higher in the case of libel against public figures. It’s not just saying untrue stuff, you have to be able to prove “actual malice,” meaning you have to be able to prove the person deliberately lied to hurt you. Not an expert, but seems like it might be a difficult case to prove.
You not only have to prove malice but Ronnie has to PROVE that he suffered financially because of the comments which is impossible.
Actual malice or "reckless disregard for the truth." If the fact that the allegations he referred to had already been concluded in Ronnie's favor, that is easy to find online, and I would think that qualifies as a reckless disregard for the truth.

In Fantano's case, the malice is the EASIEST element to prove. The alleged fiction element is the 2nd easiest. Damages are the hardest to prove, but it doesn't mean he shouldn't sue. Doesn't matter how much or little he may win in a suit, so long as the life-wrecking material is forcibly removed.
I am an attorney and your assessment of the law is off base. He has a solid case against Fantano. Actually, it's pretty cut and dry. Fantano is going to live with a judgment over his head. Fantano has been playing with fire and was asked, warned, and now he can enjoy the consequences.

Maybe I've missed something, but I looked up the court documents for Ronnie Radke's defamation lawsuit against Kacee Boswell, and everything I found seems to show it ended in a judgement by default before the trial even started?
Which would absolutely NOT be the same thing as a judge ruling in favor of Ronnie or definitive evidence the accusations were false. All it would mean is the defendant (Kacee Boswell) didn't respond to the suit in a timely manner, which can happen for a lot of reasons, not just because of (alleged) lying: lack of resources / money for lawyers and court costs, mental illness, addiction issues, fear, a private agreement, etc.
I also tried to research the (alleged) DNA evidence, and so far all I can find are Ronnie's claims on social media but no outside corroboration? Again, if I've missed anything, I would hugely appreciate being directed to that information.

The DV is about his ex girlfriend. They had a fight about him cheating and she accused him of violence which she couldn't back up. The DV was dismissed and he had a plea deal for disturbing the peace. By the way, Kacee Boswell named her own daughter after Ronnie's daughter Willow. That woman is mentally ill!

The point was that just legally getting a case thrown out doesn't always mean it didn't happen. It just means a party succeeded in a legal effort to get a case dismissed. And it also means it was not able to be proven by the accused. IIRC, that case didn't even get to trial.
Legally, that's presumed innocent - but as anyone knows - the system is exploitable and anyone intimidating and rich enough can easily pull this off, regardless of guilt or innocence.
I'm not saying RR is guilty, either. I'm implying we (people uninvolved and were not witnesses) will never truly know one way or another. The only thing we _do_ know is he _legally_ succeeded in the case's dismissal.

I've been personally affected by someone I trusted who was close to me constantly backstabbing me to everyone they knew with full out lies for years (even if I didn't know the person they were lying to). I didn't know about any of it but at a couple of stages throughout the years I'd have complete strangers approach me in my home town and spit on me / hurl verbal abuse at me. I've been kicked out of restaurants and stores on the first visit even before I had a chance to say or do anything. I will absolutely say that the level of obsessive hatred and behaviour from one single person has changed the way that I think and behave even when I'm alone. I am certain that I couldn't handle what Ronnie has had to tolerate and I support his legal action in this regard 100%.

I'm not familiar with Ronnie's "legal" cases. But as far as lawsuits and counter suits goes. Just because things were dropped doesn't mean they are true or false. This country's law system benefits those that have money. Ronnie sounds like he has engaged in what is colloquially referred as "slap suits" where a larger person or group files a bunch of motions against smaller people and entities to the point where financially the smaller person or group has no other choice but to submit or drop any civil charges to just make the allegations go away.
John Oliver did a whole episode on slapsuits and it was eye opening for me, I suggest anyone thinking Ronnie's right blindly maybe considering learning about slapsuits, including Tank here. Because I think without that understanding it is easy to be mislead on situations involving lawsuits in this country.

Ronnie Radke seems to live up to every cliche and stereotype of the self righteous recovered addict.
Suing someone for making claims that were already public knowledge, regardless of the merit of the suit, will only result in the "Ronnie Radke sues content creators" type headlines that are why my friends who don't listen to any metal know who he is and clown on him regularly. He's turned a video that would have blown over in under a week into a media shit storm. I do not like Radke but even I can admit that Fantano was probably being intentionally misleading. However even if this ends up actually going to court, freedom of speech allowing you to share your opinions in a public forum will make it hell to actually resolve in his favor. Considering I can't find any evidence of him actually taking the woman who accused him of rape to court(despite all the attention he purposefully drew to that lawsuit), I highly doubt he has any intention of doing so here. He wants the spotlight, he wants to be seen fighting back. Once the media from this settles down the lawsuit will be quietly halted. See you all in two years when he sues another guy for attention I guess.

That idea is as old as time and often times was the only thing people had that meant anything. As someone who doesn't have much faith in our legal system, I don't think that being absolved in court is necessarily proof that someone did nothing wrong. Judges and juries can make mistakes. Plus, victims make SA accusations against famous people and then get threatened or bribed into silence all the time. I still think it's worth talking about those allegations, as long as you include all the relevant information.

What do you mean by "talking about those allegations"? It's not acceptable to perpetuate any kind of accusation on the internet. If somebody has some accusations, they can turn to law enforcement.
The issue is the accusations don't have to be proven to damage somebody's name, however the accused isn't able to refute them. How would you prove something didn't happen? You can't.
There have been too many false accusations made in last years. Accusations should be investigated, not perpetuated on the internet for eternity.
But in this case Ronnie got proven innocent via DNA testing, he went to a police station, they did the swabs on his and the Woman's areas and it was proven that there was no contact.
I have zero faith in the legal system but I have a lot of faith in DNA tests and the police swapped his entire tour bus where she said it happened and found nothing, that has nothing to do with the legal system persay, it didn't even get to a judge for that. Police dismissed the charges.
This is a dumb take because if somebody is proven innocent - via DNA testing, testimonies, trials, etc, then why should we keep mentioning it? Let's say you get accused of DV or SA by your ex-partner who's furious that you broke up with them, for valid reason, in a civilised way - you just don't want to be together anymore. It's proven that you're innocent and that vile person just wanted you to suffer. Should people around you always mention it? Should they always go "Ahh, this person is really nice, and I've been having fun with them but I'm hesitant about that bbq on the weekend because - you know - they were accused of SA 10 years ago.". It doesn't make sense.

I think it’ll end up getting thrown out. Suing someone for directly accusing you of assaulting them is one thing. A music critic talking about it is different, even if he is talking shit. In order for him to win a defamation suit against Fantano, he will have to provide evidence in court that Fantano’s shit talking directly resulted in loss of income, which is not easy to do.
Also, Radke straight up saying on video that he’s being litigious and will sue people who talk shit could be enough to have the case thrown out, depending on their states anti-SLAPP laws. Plus, Fantano is likely very well off financially and I would assume he has journalism insurance. He’s got the resources to fight it. I don’t have an opinion on either of the two personally, but people who abuse the legal system to bully people are straight fucking trash.
Proving loss of income isn't necessary in a defamation claim, only that the claim is untrue. Fantano would have to prove it were true. Compensation gets more complicated, especially with public figures but it is risky. So Radke could win but be awarded $1 but then Fantano may end up having to pay both sides legal costs. Its one of those journalism things were real journalists are taught that if you want to make potentially defamatory claims, you better have your facts straight. Especially if the person you've defamed can and will sue.
Journalist or any legal insurance probably also wouldn't cover costs, especially if the defamatory claims have already been tested in courts and Radke was cleared.
The whole point of defamation litigation is to prevent people making malicious claims. SLAPP probably wouldn't apply because its an attempt to stop lies that have previously been shown to be lies repeated. People are entitled to opinions, but not facts or lies.

Believe it or not I actually know one of this dude's ex's, I won't say how, but every time one of these accusations came up she was never surprised. They dated something like 15 years ago, but still. Ok but here's the thing about RDJ - regardless of his past mistakes and legal troubles, I don't remember ever hearing him be accused of hurting people. He definitely hurt himself and negatively impacted people who cared about him, but there's a huge difference between having a history of drug abuse vs. history of committing sexual abuse. Given the way victims are treated by the legal system, I would really not call a court ruling proof of no wrongdoing. Not to say he did do it, but from law enforcement to judges, the system is absolutely biased against victims and rulings in favor of the accused just cannot be taken as definitive proof that nothing occurred.

This can ruin a career, a family (Ronnies daughter and her friends might see this) and maybe a whole life. It also makes it harder for real victims to be believed, when there are false accusations everywhere.
